process that will be used to resolve any dispute over retail service area. A new public<br />

water system will not be permitted unless the designated water system is "unable or<br />

unwilling" to provide water service in a "timely and reasonable" manner.<br />

Within designated retail service areas, an applicant will be referred to the designated<br />

utility to arrange for the desired level of utility service. In the event the utility cannot<br />

provide timely service to the proposed activity, it will advise the applicant of the utility's<br />

design standards and discuss the feasibility of creating a new water system to serve the<br />

project. If the applicant does not install a water system to the designated utility's<br />

standards, then the interim system must at least meet the minimum Group A or Group B<br />

standards, as prescribed by the CWSP.<br />

As a condition of the final plat, short plat, or land use approval, where facilities less than<br />

the designated utility's design standards are utilized, the designated utility will review<br />

with the applicant the potential of paying additional costs at a later date in order to<br />

upgrade piping and other facilities to integrate the interim system with the utility. Also at<br />

the time of plat, short plat, or land use approval, the <strong>County</strong> will ensure that a covenant is<br />

entered on the title report for each parcel. The covenant will acknowledge that the owner<br />

of the parcel may be responsible for paying to upgrade interim water utility facilities to<br />

the designated utility's design standards when it is connected to the designated utility at<br />

some time in the future. This covenant will remain on the property title report until the<br />

interim system is incorporated in the designated utility’s system.<br />

When a new system is formed, the approving agency should require a demonstration of<br />

financial viability and system capacity for system operation and management.<br />

Recommended guidelines for determining financial viability are set forth in the State<br />

Department of Health Financial Viability Manual (DOH Publication # 331-104,<br />

March 1995).<br />

Some water purveyors provide or may in the future provide wholesale water to other<br />

water systems. Such purveyors will designate the area in which they are willing to<br />

provide wholesale water service. To maximize flexibility, wholesale water service areas<br />

may overlap, as a water system may want to have multiple outside wholesale water<br />

supplies. Wholesale water sales will be conducted based on individual agreements<br />

between the parties involved.<br />

1.2.6 Classification of Existing <strong>System</strong>s<br />

DOH classifies Group-A water systems employing the following criteria:<br />
