§31685.9. Disability <strong>of</strong> member<br />

If a member becomes disabled, the combined benefit payments to both the member and<br />

nonmember shall not exceed the amount that would otherwise be paid to the member alone.<br />

§31685.95. <strong>Retirement</strong> plan payments resulting in increased benefits; actuarial economic and<br />

demographic assumptions and valuations<br />

(a) Under no circumstances shall a retirement plan be required to make payments in any<br />

manner that will result in an increase in the amount <strong>of</strong> benefits provided under the plan.<br />

(b) All benefits determined pursuant to Part 5 (commencing with Section 2610) <strong>of</strong><br />

Division 7 <strong>of</strong> the Family Code and this article shall be determined on the basis <strong>of</strong> the actuarial<br />

economic and demographic assumptions and values prescribed by the board <strong>of</strong> the affected<br />

retirement plan.<br />

§31685.96. Age factors<br />

(a) The age factor applicable to the nonmember shall be based on the age <strong>of</strong> the<br />

nonmember at the time <strong>of</strong> his or her retirement.<br />

(b) The board shall adopt age factors as recommended by the actuary.<br />

§31685.96. Operation <strong>of</strong> article; resolution by county<br />

This article shall not be operative in any county until the board <strong>of</strong> supervisors shall, by<br />

resolution adopted by a majority vote, make this article applicable in the county.<br />

§31691. Ordinance or resolution for contribution toward premiums<br />

(a) The board <strong>of</strong> supervisors <strong>of</strong> any county by ordinance, or the governing body <strong>of</strong><br />

any district under the <strong>County</strong> <strong>Employees</strong> <strong>Retirement</strong> <strong>Law</strong>, by ordinance or resolution, may<br />

provide for the contribution by the county or district from its funds and not from the retirement<br />

fund, toward the payment <strong>of</strong> all or a portion <strong>of</strong> the premiums on a policy or certificate <strong>of</strong> life<br />

insurance or disability insurance issued by an admitted insurer, or toward the payment <strong>of</strong> all or<br />

part <strong>of</strong> the consideration for any hospital service or medical service corporation, including any<br />

corporation lawfully operating under Section 9201 <strong>of</strong> the Corporations Code, contract, or for<br />

any combination there<strong>of</strong>, for the benefit <strong>of</strong> any member heret<strong>of</strong>ore or hereafter retired or his or<br />

her dependents.<br />

At least one <strong>of</strong> these plans shall include free choice <strong>of</strong> physician and surgeon.<br />

(b) The benefits provided by this section are in addition to any other benefits provided<br />

by this chapter.<br />

(c) The board <strong>of</strong> retirement may provide on behalf <strong>of</strong> a member who has retired, or an<br />

eligible surviving spouse who was married to the member for one year prior to the date <strong>of</strong><br />

retirement <strong>of</strong> the member, or, if there is no such spouse, the surviving unmarried children <strong>of</strong><br />

the member who are under 18 years <strong>of</strong> age, or under 22 years <strong>of</strong> age and full-time students,<br />
