(b) In a county with a population in excess <strong>of</strong> four million, the provisions <strong>of</strong> subdivision<br />

(a) shall also apply to persons employed under the titles and to perform the duties <strong>of</strong> division<br />

chief-public safety, assistant division chief-public safety, or district manager-public safety.<br />

§31470.7. Status as “member” during public or county service<br />

The election by a member to receive credit for employment in public service or in county<br />

service pursuant to Section 31641.1 or 31641.5 does not make such person a member during any<br />

part <strong>of</strong> such public service or county service.<br />

§31470.8. Determination <strong>of</strong> eligibility<br />

In cases <strong>of</strong> doubt as to whether a person is eligible to become a safety member, the board<br />

shall decide.<br />

§31470.9. Eligibility <strong>of</strong> public administrators, coroners, and coroner-public administrators<br />

All public administrators, coroners and coroner-public administrators, whether<br />

compensated on a fee or salary basis, are eligible, except that the membership <strong>of</strong> such persons<br />

is subject to the approval <strong>of</strong> the board <strong>of</strong> supervisors.<br />

§31470.10. Welfare fraud investigators and administrators budgeted within Orange <strong>County</strong>;<br />

eligibility (Orange)<br />

Notwithstanding Section 31470.2, all welfare fraud investigators and administrators<br />

budgeted within Orange <strong>County</strong> shall be eligible, regardless <strong>of</strong> which county department<br />

actually supervises or funds them, and shall receive those benefits upon a majority vote <strong>of</strong> the<br />

board <strong>of</strong> supervisors.<br />

ineligibility; exceptions (Santa Barbara)<br />

Notwithstanding Section 31470.2, all welfare fraud investigators and administrators in<br />

counties <strong>of</strong> the 16th class, as described by Sections 28020 and 28037, as amended by Chapter<br />

1204 <strong>of</strong> the Statutes <strong>of</strong> 1971, shall be ineligible for safety membership, unless and until the<br />

board <strong>of</strong> supervisors shall elect, by resolution adopted by a majority vote, to make those<br />

investigators and administrators eligible.<br />

§31470.12. Child support investigators and administrators; counties in the 16th class;<br />

eligibility; operation <strong>of</strong> section (Santa Barbara)<br />

Child support investigators and administrators in counties <strong>of</strong> the 16th class, as described<br />

by Section 28020 and 28037, as amended by Chapter 1204 <strong>of</strong> the Statutes <strong>of</strong> 1971, are eligible.<br />

This section shall not be operative in any county until such time as the board <strong>of</strong><br />

supervisors shall elect, by resolution adopted by a majority vote, to make this section<br />

applicable in the county.<br />
