adopting the Declarati<strong>on</strong> as nati<strong>on</strong>al law and a court<br />
decisi<strong>on</strong> in Belize that invoked <str<strong>on</strong>g>UNDRIP</str<strong>on</strong>g> were<br />
important developments. “But to open it up to more<br />
people and to make <str<strong>on</strong>g>UNDRIP</str<strong>on</strong>g> an easily accessible<br />
tool, where are those different spaces and processes<br />
where we can actually get tracti<strong>on</strong> from the<br />
Declarati<strong>on</strong>’s different principles?” asked Menotti.<br />
Juan Carlos Jintiach of the Amaz<strong>on</strong> Alliance<br />
resp<strong>on</strong>ded to previous comments by saying,<br />
“Sometimes, the government makes c<strong>on</strong>tracts with<br />
some indigenous leaders by c<strong>on</strong>vincing and<br />
corrupting them with their own politics. They know<br />
how to trick the people.” He hoped that NGOs<br />
would help indigenous people identify coerci<strong>on</strong> and<br />
corrupti<strong>on</strong> within these questi<strong>on</strong>able negotiati<strong>on</strong>s. In<br />
additi<strong>on</strong>, he hoped NGOs would help indigenous<br />
groups who are fighting against mining and oil<br />
c<strong>on</strong>cessi<strong>on</strong>s, but do not have the funds or support<br />
and d<strong>on</strong>’t know how to use media resources. “We<br />
must advise the legitimate alliances and<br />
organizati<strong>on</strong>s to work together,” said Jintiach.<br />
Victoria Tauli-Corpuz said, “In my view, any<br />
Declarati<strong>on</strong> will be a living document if there is a<br />
c<strong>on</strong>stituency that is pushing its implementati<strong>on</strong>.” She<br />
compared <str<strong>on</strong>g>UNDRIP</str<strong>on</strong>g> to the UN Declarati<strong>on</strong> <strong>on</strong> Human<br />
Rights in terms of its basic principles. C<strong>on</strong>venti<strong>on</strong>s,<br />
which are legally binding, usually follow the passage<br />
of declarati<strong>on</strong>s, she explained. Tauli-Corpuz called<br />
the Declarati<strong>on</strong> “an internati<strong>on</strong>al instrument that<br />
defines the minimum standards that should be<br />
observed to ensure that the rights of the indigenous<br />
peoples are being respected and protected.” She<br />
countered previous arguments by the World Bank by<br />
stating, “Now that there is a Declarati<strong>on</strong>, instituti<strong>on</strong>s<br />
cannot excuse themselves from using it as a standard.<br />
Actually, now there is a thin dividing line between<br />
c<strong>on</strong>venti<strong>on</strong>s and declarati<strong>on</strong>s, because the Universal<br />
Declarati<strong>on</strong> of Human Rights has become customary<br />
law.”<br />
Because of the comm<strong>on</strong> language in human rights<br />
documents, Tauli-Corpuz said that “maybe some of<br />
the Declarati<strong>on</strong> is legally binding because many of<br />
this is already found in the c<strong>on</strong>venti<strong>on</strong>s that have<br />
already been adopted.” In additi<strong>on</strong>, she stated that<br />
the Declarati<strong>on</strong> is now influencing all the other<br />
policies being developed by other agencies. “They<br />
have now come up with the agency called the UN<br />
Development Group, which…will be a guide at a<br />
local level to ensure that when they come up with<br />
their own country’s strategy and programs, [they]<br />
will really fall within those [Declarati<strong>on</strong>] guidelines,”<br />
said Tauli-Corpuz.<br />
She named a number of c<strong>on</strong>ferences that create<br />
spaces for discussi<strong>on</strong> of the implementati<strong>on</strong> of the<br />
Declarati<strong>on</strong>, such as a November 2008 Southeast<br />
Asian Indigenous Peoples’ C<strong>on</strong>ference <strong>on</strong> Reduced<br />
Emissi<strong>on</strong>s from Deforestati<strong>on</strong> and Degradati<strong>on</strong><br />
(REDD), followed by a global c<strong>on</strong>ference <strong>on</strong> REDD.<br />
There will be workshops at the 2009 Permanent<br />
<str<strong>on</strong>g>Forum</str<strong>on</strong>g> held by facilitators from regi<strong>on</strong>al processes to<br />
help indigenous peoples identify their own<br />
indicators for well-being, sustainability and poverty.<br />
“We want to develop this very str<strong>on</strong>gly, because<br />
these are also indicators of how the Declarati<strong>on</strong> is<br />
being implemented,” said Tauli-Corpuz.<br />
Resp<strong>on</strong>ding to Menotti’s questi<strong>on</strong> about how to gain<br />
tracti<strong>on</strong> in the implementati<strong>on</strong> of the Declarati<strong>on</strong>, she<br />
explained that the UN Permanent <str<strong>on</strong>g>Forum</str<strong>on</strong>g> has a<br />
dynamic, representative body with ample resources<br />
to direct toward implementati<strong>on</strong> issues. “In March<br />
2008, the UN Human Rights Council mandated<br />
James Anaya, who is an indigenous pers<strong>on</strong> and a<br />
lawyer, as Special Rapporteur for Indigenous Human<br />
Rights. His six-year mandate is to m<strong>on</strong>itor how the<br />
Declarati<strong>on</strong> is being implemented,” said Tauli-<br />
Corpuz. The Human Rights Council also has an<br />
Expert Mechanism <strong>on</strong> Indigenous Peoples Rights<br />
composed of five experts who are m<strong>on</strong>itoring the<br />
implementati<strong>on</strong> of the Declarati<strong>on</strong>. There is also<br />
crossover with several other bodies in the UN system<br />
that can support the Declarati<strong>on</strong>, such as is the case<br />
regarding the rights of indigenous children to have<br />
bilingual educati<strong>on</strong>, and not to be taken away from<br />
their communities; these aspects of the Declarati<strong>on</strong><br />
are also supported by legislati<strong>on</strong> supporting<br />
children’s rights. So several existing committees and<br />
instruments, such as the Committee <strong>on</strong> the<br />
Eliminati<strong>on</strong> of Racial Discriminati<strong>on</strong> and the<br />
Committee <strong>on</strong> Discriminati<strong>on</strong> Against Women, can<br />
aid in the implementati<strong>on</strong> of <str<strong>on</strong>g>UNDRIP</str<strong>on</strong>g>.<br />
She also cited the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Biological Diversity<br />
and the UNCCC as future spaces for implementati<strong>on</strong><br />
mechanisms. Tauli-Corpuz stated the need to<br />
establish mechanisms in the form of tribunals of<br />
indigenous peoples and their allies to collaborate as<br />
independent experts <strong>on</strong> issues such as the UNCCC or<br />
