STATE AFFAIRS/SUNSET<br />

Authorizes <strong>the</strong> board, during reasonable business hours, to conduct an on-site inspection <strong>of</strong> <strong>the</strong> chiropractic facility.<br />

Establishes provisions for cooperation with <strong>the</strong> <strong>Texas</strong> Department <strong>of</strong> Insurance (TDI) in sharing information, tracking<br />

investigations, and collaborating on disciplinary action.<br />

Establishes provisions for peer review committees.<br />

Requires TDI to provide to <strong>the</strong> board any information received regarding a settlement <strong>of</strong> a malpractice claim against a<br />

chiropractor.<br />

Sets forth behavior constituting prohibited practice by a chiropractor or an applicant for a chiropractic license.<br />

Sets forth examples <strong>of</strong> unpr<strong>of</strong>essional or dishonorable conduct that is likely to deceive or defraud <strong>the</strong> public.<br />

Authorizes <strong>the</strong> board to order a license holder to pay a refund to a consumer instead <strong>of</strong> or in addition to imposing an<br />

administrative penalty.<br />

Requires <strong>the</strong> board to suspend a chiropractor's license on pro<strong>of</strong> that <strong>the</strong> chiropractor has been initially convicted <strong>of</strong><br />

certain <strong>of</strong>fenses.<br />

Allows <strong>the</strong> board to issue a cease and desist order.<br />

Establishes a criminal penalty for providing chiropractic treatment or services while intoxicated.<br />

<strong>Texas</strong> State Board <strong>of</strong> Examiners <strong>of</strong> Psychologists—H.B. 1015<br />

The <strong>Texas</strong> State Board <strong>of</strong> Examiners <strong>of</strong> Psychologists (board) was created in 1969 to license qualified individuals to<br />

provide psychological services in <strong>Texas</strong> and to enforce <strong>the</strong> Psychologists' Licensing Act, including investigating and<br />

resolving complaints. This bill:<br />

Continues <strong>the</strong> board until September 1, 2017.<br />

Modifies <strong>the</strong> board's oral examination requirement for psychologist licensure and prohibits <strong>the</strong> board from using <strong>the</strong><br />

oral examination to assess a person's personal characteristics.<br />

Abolishes <strong>the</strong> Psychological Associate Advisory Committee and requires <strong>the</strong> board to seek stakeholder input earlier<br />

in its rule development process.<br />

Incorporates across-<strong>the</strong>-board recommendations <strong>of</strong> <strong>the</strong> Sunset Advisory Commission.<br />

Establishes provisions for practicing psychology by applicants who are licensed out <strong>of</strong> state.<br />

Establishes provisions and restrictions in assessing <strong>the</strong> oral examination.<br />

Establishes provisions for a temporary license to practice psychology in this state for a limited time and limited<br />

purpose.<br />

Establishes a schedule <strong>of</strong> sanctions and provisions for disciplinary action.<br />
