STATE AFFAIRS/SUNSET<br />

Increases <strong>the</strong> amount <strong>of</strong> administrative penalty <strong>the</strong> board can impose on a license holder to $5,000 per violation per<br />

day, ra<strong>the</strong>r than $2,500 for each violation.<br />

Requires <strong>the</strong> board to adopt rules to ensure that its examinations are accessible to persons with disabilities in<br />

accordance with <strong>the</strong> Americans with Disabilities Act.<br />

Establishes provisions for license renewal and fees.<br />

Increases <strong>the</strong> license renewal fee for those whose license has been expired for a certain time.<br />

Expands <strong>the</strong> range <strong>of</strong> disciplinary sanctions for pharmacy technicians and authorizes <strong>the</strong> board to discipline a<br />

pharmacy technician who receives deferred adjudication for any felony or for misdemeanors involving moral<br />

turpitude.<br />

Requires <strong>the</strong> board to register pharmacy technician trainees and to hold <strong>the</strong>se trainees to <strong>the</strong> same disciplinary<br />

grounds and actions that are applied pharmacy technicians.<br />

Establishes provisions for licensure <strong>of</strong> pharmacists from ano<strong>the</strong>r state.<br />

Eliminates <strong>the</strong> Pharmacy Board Operating Account and transfers <strong>the</strong> money to <strong>the</strong> General Revenue Fund.<br />

Provides that information regarding <strong>the</strong> home address and telephone number <strong>of</strong> licensees and registrants is<br />

confidential and not subject to disclosure under <strong>the</strong> <strong>Texas</strong> Public Information Act.<br />

Regulation <strong>of</strong> Barbers and Cosmetologists—S.B. 411<br />

The <strong>Texas</strong> Board <strong>of</strong> Barber Examiners and <strong>the</strong> <strong>Texas</strong> Cosmetology Commission regulate barbers and<br />

cosmetologists to protect <strong>the</strong> health and safety <strong>of</strong> <strong>the</strong> public. The agencies license barbers and cosmetologists,<br />

instructors, shops, salons, and schools and enforce <strong>the</strong> Barber and Cosmetology Acts and agency rules by<br />

investigating complaints and conducting inspections. This bill:<br />

Abolishes <strong>the</strong> <strong>Texas</strong> State Board <strong>of</strong> Barber Examiners and <strong>the</strong> <strong>Texas</strong> Cosmetology Commission.<br />

Transfers <strong>the</strong> agencies' functions to <strong>the</strong> <strong>Texas</strong> Department <strong>of</strong> Licensing and Regulation (TDLR).<br />

Requires <strong>the</strong> agency to focus its resources on inspection <strong>of</strong> barber and cosmetology facilities that require <strong>the</strong> most<br />

attention, those that violate sanitation rules.<br />

Requires that facilities be inspected at least once every two years and clarifies TDLR's authority to charge inspection<br />

fees.<br />

Authorizes provisional licenses for barbers, standardizes license renewal processes.<br />

Requires barber and cosmetology schools to maintain student records.<br />

Requires development <strong>of</strong> a method for violation and complaint trend analysis and an annual compilation <strong>of</strong> detailed<br />

statistics on violations and complaints.<br />
