10 { ADULT DAY-CARE SERVICES — ADVOCACY } WINNEBAGO COUNTY SENIOR RESOURCE GUIDE 2009 Wisconsin Elder Abuse Law Chapter 46.90 DEFINITION: An elder person, age 60 years or older, who may be subject to abuse, material abuse, neglect or self-neglect as defined below: 1. Physical Abuse means “willful infliction on an elder person of physical pain or injury or unreasonable confinement.” This could include direct aggressive behavior such as bodily assault, sexual abuse, physical restraint, torture and imprisonment. 2. Material Abuse means “the misuse of an elder person’s property or financial resources.” This would involve misuse, misappropriation of money, valuables or property; denial of right to access or control of personal funds, or interference in financial decisions, passive neglect of financial affairs or failure to intervene in financial mismanagement or exploitation. 3. Neglect means “a significant danger to an elder person’s physical or mental health because the person who takes care of the older person is unable or fails to provide adequate food, shelter, clothing, medical or dental care.” This would include neglecting, withholding or refusing to permit others to provide food, clothing, shelter, medication, medical attention, or personal care and neglectfully permitting or deliberately causing exposure to unsafe, unsanitary, or unhealthful conditions. 4. Self-Neglect means “a significant danger to an elder person’s physical or mental health because the elder person is responsible for his or her own care, but is unable to provide adequate food, shelter, clothing, medical or dental care.” I. REFERRAL: Cases of elder abuse need to be referred to the Winnebago County Department of Human Services, Crisis Intervention/Adult Access Team Oshkosh - 920-236-4615 Fox Cities - 920-727-2882 TDD/TTY - 920-236-4612 A social worker will be assigned to assess the situation. II. DISPOSITION: There are four basic types of situations: 1. The elder person who consents to assessment and service delivery and who appears to be mentally competent. 2. The elder person who refuses assessment and service delivery and who appears to be mentally competent. 3. The elder person who (regardless of his or her degree of cooperation) appears to lack sufficient mental capacity to make decisions regarding his/her own care or an elder person who has a legal guardian. 4. The elderly person is in danger of immediate and grievous bodily harm regardless of competency (emergency situations). LIMITATIONS: Competent adults have the legal right to refuse assessment and/or services regardless of the opinion of professionals, family, friends, neighbors and the community at large.
