enforcement appeals board created by the relevant County of Riverside ordinances and
resolutions, which the City has adopted by reference as required by law.
Section 2. Proposed Amendment. The proposed zone code amendment will:
(a) add a new Section 9.10.030, Removal of Certain Heavy Industrial Uses as
Permitted Uses, to Chapter 9.10, Amendments to the County Zoning Ordinance, of Title 9,
Planning and Zoning, of the Jurupa Valley Municipal Code to amend and supersede certain
provisions of Riverside County Zoning Ordinance No. 348 by removing certain heavy industrial
uses as permitted uses; and
(b) add a new Chapter 9.20, M-O Heavy Industrial Overlay Zone, to Title 9,
Planning and Zoning, of the Jurupa Valley Municipal Code to amend and supersede certain
provisions of Riverside County Zoning Ordinance No. 348 by requiring applicants seeking to
engage in certain heavy industrial uses to apply for an overlay zone change in order to establish
such uses.
Section 3. California Environmental Quality Act Findings. The Planning
Commission hereby finds, in the exercise of its independent judgment and analysis, that this
proposed amendment will not have a significant impact on the environment as documented in the
Negative Declaration and is considered under CEQA Guideline 15074(a) which specifies that
any advisory body of a public agency making a recommendation to the decision-making body
need only consider the proposed negative declaration before making its recommendation.
Section 4. Recommendation. Based on the foregoing, the Planning Commission
hereby recommends that the City Council adopt an ordinance to add a new Section 9.10.030,
Removal of Certain Heavy Industrial Uses as Permitted Uses, to Chapter 9.10, Amendments to
the County Zoning Ordinance, and add a new Chapter 9.20, M-O Heavy Industrial Overlay
Zone, to Title 9, Planning and Zoning, of the Jurupa Valley Municipal Code to amend and
supersede certain provisions of Riverside County Zoning Ordinance No. 348, in substantial
compliance with Attachment “A” attached hereto.
Section 5.
Resolution.
Certification. The Planning Manager shall certify to the adoption of this
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of
Jurupa Valley on this ____ day of _____, 2012.
