eclassification to a job classification outside <strong>the</strong> bargaining unit. The City will<br />

notify <strong>the</strong> employee <strong>of</strong> his transfer to a job outside <strong>the</strong> bargaining unit; and<br />

[ c] Employees in <strong>the</strong> bargaining unit may join <strong>the</strong> Union any time from <strong>the</strong>ir date <strong>of</strong><br />

hire.<br />

24. All bargaining unit employees who do not become members in good standing <strong>of</strong> <strong>the</strong><br />

Union shall be required to pay a fair share fee to <strong>the</strong> Union. Employees who transfer into <strong>the</strong><br />

bargaining unit and employees who revoke such authorization pursuant to Paragraph Twenty­<br />

Three [a], (23a), shall be immediately required to pay a fair share fee to <strong>the</strong> Union. This<br />

provision shall apply also to any additional titles which may be added to <strong>the</strong> Contract during its<br />

term.<br />

The fair share fee an1ount shall be certified to <strong>the</strong> City by <strong>the</strong> Union. The Union<br />

shall make every effort to provide <strong>the</strong> City with thirty (30) days advance<br />

notification <strong>of</strong> any change in <strong>the</strong> fair share fee amount. The deduction <strong>of</strong> <strong>the</strong> fair<br />

share fee from any earnings <strong>of</strong> <strong>the</strong> employee shall be automatic and does not<br />

require a written authorization for payroll deduction.<br />

Payment to <strong>the</strong> Union <strong>of</strong> fair share fees deducted shall be made in accordance<br />

with <strong>the</strong> regular dues deductions as provided herein.<br />

[ c] The City shall provide <strong>the</strong> Union with a list <strong>of</strong> newly hired employees and <strong>the</strong>ir<br />

addresses by <strong>the</strong> first <strong>of</strong> each month.<br />

[ d] The City shall provide each newly hired bargaining unit employee with a copy <strong>of</strong><br />

AFSCME's Fair Share Fee Notice. Such Notice shall be presented to each newly<br />

hired bargaining unit employee within <strong>the</strong> first thirty (30) days <strong>of</strong> employment.<br />

AFSCME shall provide a sufficient supply <strong>of</strong> Fair Share Fee Notices to <strong>the</strong> City<br />

to allow <strong>the</strong> City to meet this obligation. The City shall require each newly hired<br />

bargaining unit employee to sign a receipt acknowledging that <strong>the</strong> Notice was<br />

presented. The City shall mail each original receipt to <strong>the</strong> Ohio Council 8<br />

Regional Office.<br />

25. Deductions shall be made during each pay period <strong>of</strong> each month, but, if an employee's<br />

pay for a period is insufficient to cover Union dues or fair share fees, <strong>the</strong> City will make a<br />

deduction from <strong>the</strong> pay earned during <strong>the</strong> next pay period.<br />

26. All deductions, accompanied by two (2) alphabetical lists <strong>of</strong> all employees containing <strong>the</strong><br />

names, job classifications, social security numbers, employee identification and organizational<br />

numbers along with <strong>the</strong> amount <strong>of</strong> <strong>the</strong> deduction shall be transmitted to <strong>the</strong> Union no later than<br />

<strong>the</strong> fifteenth (15t 11 ) day following <strong>the</strong> end <strong>of</strong> <strong>the</strong> pay period in which <strong>the</strong> deduction is made and,<br />

upon receipt, <strong>the</strong> Union shall assume full responsibility for <strong>the</strong> disposition <strong>of</strong> all funds deducted.<br />

27. The City shall place back on check-<strong>of</strong>f those employees who return to <strong>the</strong> active payroll<br />

from a leave <strong>of</strong> absence, lay<strong>of</strong>f or suspension, or who are transferred from one division to<br />
