118. There shall be two (2) fifteen (15) minute rest periods on each shift, each work day. The<br />

rest periods, to <strong>the</strong> extent practicable, will be scheduled during <strong>the</strong> middle two (2) hours <strong>of</strong> each<br />

one-half (2) shift but <strong>the</strong>y may not be scheduled immediately before or after <strong>the</strong> meal period or at<br />

<strong>the</strong> start or <strong>the</strong> end <strong>of</strong> <strong>the</strong> shift.<br />

119. When an employee works beyond his regular quitting time, <strong>the</strong> employee shall receive a<br />

fifteen ( 15) minute rest period if <strong>the</strong> employee works two (2) hours, but less than four ( 4) hours,<br />

for each four (4) hour period and, in addition, a thirty (30) minute meal period if <strong>the</strong> employee<br />

works four ( 4) hours or longer.<br />

DOCKING<br />

120. The City will dock employees on <strong>the</strong> basis <strong>of</strong> one-tenth (1/1 0), or six (6) minutes per<br />

hour.<br />

EQUALIZATION OF OVERTIME<br />

121. The City shall be <strong>the</strong> sole judge <strong>of</strong> <strong>the</strong> necessity <strong>of</strong> overtime. Overtime shall be <strong>of</strong>fered<br />

to employees within <strong>the</strong> same job classification within <strong>the</strong> same division in accordance with job<br />

classification seniority.<br />

122. In cases where <strong>the</strong> City maintains that <strong>the</strong> employee's regular work assignment is unique<br />

to an operational work unit within <strong>the</strong> division and cannot be performed by o<strong>the</strong>rs in <strong>the</strong> same<br />

job classification within <strong>the</strong> division, <strong>the</strong> City shall meet with <strong>the</strong> Union for <strong>the</strong> purpose <strong>of</strong><br />

attempting to agree upon a waiver <strong>of</strong> this provision. If <strong>the</strong> parties cannot agree, <strong>the</strong> Union may<br />

submit a grievance directly to Step Three (3) <strong>of</strong> <strong>the</strong> Grievance Procedure. During <strong>the</strong> pendency<br />

<strong>of</strong> <strong>the</strong> grievance, <strong>the</strong> City may <strong>of</strong>fer <strong>the</strong> overtime solely within <strong>the</strong> operational work unit and <strong>the</strong><br />

grant <strong>of</strong> this right does not constitute a waiver <strong>of</strong> any remedy in <strong>the</strong> event <strong>the</strong> grievance is<br />

sustained.<br />

123. Emergency overtime cannot be refused. An emergency is defined as an impairment to<br />

City services or operations which cannot be delayed until <strong>the</strong> beginning <strong>of</strong> <strong>the</strong> next regular work<br />

day. However, an employee may be excused from emergency overtime provided a replacement<br />

can be obtained in time to meet <strong>the</strong> City's emergency.<br />

124. Overtime shall be equalized on a continuing basis. The City shall credit employees for<br />

all overtime hours worked and/or for overtime hours <strong>of</strong>fered for which employees have declined<br />

or failed to work for any reason.<br />

125. A record <strong>of</strong> all overtime hours worked and all overtime hours <strong>of</strong>fered which employees<br />

declined or failed to work for any reason shall be recorded on a list by <strong>the</strong> City and <strong>the</strong><br />

supervisor, timekeeper or payroll clerk keeping <strong>the</strong> record shall make <strong>the</strong> overtime record<br />

available to <strong>the</strong> employee or <strong>the</strong> Union upon request.<br />

126. Supervisors shall not be assigned overtime work that is conventionally performed by<br />

members <strong>of</strong> <strong>the</strong> bargaining unit unless employees in <strong>the</strong> classification needed for <strong>the</strong> work who<br />

are on <strong>the</strong> appropriate list for ove1iime are unavailable or refuse <strong>the</strong> overtime work.<br />
