2.A Presentation: Planning & Development Services Annual Report 2009 [LP]<br />

The Planning & Development Services Department will be providing a short<br />

presentation on activities for each <strong>of</strong> the Department's four divisions: Planning,<br />

Building, Code Enforcement and Animal Control. In summary, 2009 was a very<br />

productive year for the department. Several major commercial/industrial projects<br />

were completed and several others started construction. Single-family housing starts<br />

remained sluggish; however, local builders have indicated an interest in starting new<br />

projects and significant gains we made in 2009 over 2008 permits. Code enforcement<br />

and animal control activities kept personnel busy throughout the year. The<br />

department's personnel are committed to providing a high-level <strong>of</strong> customer service<br />

with the goal <strong>of</strong> improving the quality <strong>of</strong> life in the community.<br />

Staffing Changes:<br />

Code Enforcement/Animal Control Officer, Domingo Zapata has recently tested for<br />

and been transferred to the Public Works/Water & Sewer Division to train for the<br />

WWTP Operator position. Mr. Jay Gamez has transferred from Public Work/W & S<br />

Division back to the Code Enforcement/Animal Control Position which will now be<br />

under the Police Dept. Some areas such as Weed Abatement will remain with<br />

Planning & Development Services.<br />

Recommendation: This is an informational item only with a PowerPoint presentation to<br />

be distributed at the meeting.<br />

7.A Mid-Year 2009/2010 Budget Report [TLP]<br />

As <strong>of</strong> December 31, 2009, the <strong>City</strong> <strong>of</strong> <strong>Kerman</strong>, considering the fiscal state <strong>of</strong> the Country<br />

and State, is doing very well General Fund Revenues are right at 50% and General<br />

Fund Expenditures, after extensive cutbacks in appropriations, are at 48% <strong>of</strong> the annual<br />

budget. The Enterprise Funds are doing well overall, also, with the Water Fund<br />

expending more than it has taken in so far due to the capital expenditures and energy<br />

costs and the Sewer Fund doing well enough to set aside funds to service the debt on the<br />

WWTP Expansion Project. The approved FY 2009/10 General Fund Budget anticipated a<br />

$230,500 deficit. At the Dec. 31st Mid-Year report this deficit was only $26,400. We<br />

hope to keep the deficit for the entire year under $50,000 vs. the previously anticipated<br />

$230,500.<br />

Finance Director, Tim Przybyla, has attached spreadsheets <strong>of</strong> the Mid Year Budget<br />

Report, along with a General Fund Revenue detail. A brief PowerPoint presentation<br />

with bar graphs demonstrates Revenues vs. Expenditures for these categories.<br />

Recommendation: Council accept the Mid-Year Budget Report as presented.<br />

7.B Sales Tax Update Report [RM]<br />

After several years <strong>of</strong> significant increases, gross sales tax decreased about 9% in 2009<br />

($820,886) vs. 2008 ($903,910) comparing 3rd quarter to 3rd quarter <strong>of</strong> each yr. This<br />

was significantly less that most cities experienced across the State. We also experienced<br />

improvements in the later part <strong>of</strong> 2009 that we hope will continue in 2010. However, total<br />

sales tax revenue only tells part <strong>of</strong> the story. When we examine per capita sales tax; the<br />

picture is bleak. As demonstrated in the charts attached to the accompanying report; per<br />

capita sales tax have decreased from $95.55 to $58.37 from 1999 to 2009 (3rd quarter<br />

perspective). During this period our population has increased from 7,577 to 14,064,<br />

nearly double (refer to chart graph).<br />

Even more alarming our sales tax from retail sales has decreased from $9.98 to $4.82<br />

per capita during this period. While never a significant amount, <strong>Kerman</strong>'s retail sales<br />

only make up approximately 8.35% <strong>of</strong> our total sales tax revenue. This anemic figure<br />

should be between 25 to 30% to be comparable to communities along the 99 corridor<br />

(refer to Chart: Sales Tax Per Capita <strong>City</strong> Comparison).<br />

While most cities have experienced lower sales tax revenues in 2009 the more telling<br />

story for the <strong>City</strong> <strong>of</strong> <strong>Kerman</strong> is our very poor per capital figures and even more bleak<br />

retail sales tax figures; especially when compared to neighboring cities. While our total,<br />

per capita sales tax is very low; <strong>Kerman</strong>’s retail sales tax, with the exception <strong>of</strong> Drug<br />

Stores, is almost non-existent. This will improve somewhat with the new CVS Pharmacy<br />

and the relocated Rite Aide but not enough to realize the gains the <strong>City</strong> needs in the long<br />

run (Police & Recreation/Sr. Citizen operations are predominately funded from property<br />

& sales tax. With the State <strong>of</strong> California continuing to operate in an irresponsible and<br />

irrational manner cities only have future sales tax revenues to hopefully stay in the black.<br />

These and other figures, especially when compared to the per capita figures, indicates<br />

that there is substantial commercial/retail capacity and significant unmet consumer<br />

needs in <strong>Kerman</strong>. Therefore, sales tax leakage and drive-by leakage to<br />

Fresno/Clovis/Madera is significant and greater than many communities our size.<br />

While the recession <strong>of</strong> 2008/2009 slowed anticipated commercial/retail development<br />

throughout the nation as well as <strong>Kerman</strong>; there remains major opportunities for<br />

economic growth in our community. These figures and the potential future growth <strong>of</strong><br />

<strong>Kerman</strong> and surrounding area explains why there is currently such strong interest in<br />

retail/commercial development in <strong>Kerman</strong>. Experts with national retailers such as Rite<br />

Aide, CVS and Walmart have discovered our community and understand the unfulfilled<br />

and untapped potential.<br />

Recommendation: Council review materials ask questions and accept report<br />

7.C Annual Police Crime and Activities Report [WWN]<br />

Crime in the <strong>City</strong> <strong>of</strong> <strong>Kerman</strong> is up over 2008. There are quite a number <strong>of</strong> factors at play<br />

here, which are addressed in detail in the report. Most areas are up by only 2 to 3%.<br />

Property crimes are another issue, they are up significantly, burglaries in particular.<br />

Your Police Department is working very hard at thwarting these crimes and we have<br />

made quite a number <strong>of</strong> arrests. However, those arrested have been released back into<br />

our community in less than 24 hours. Exacerbating all this is the recent California<br />

Department <strong>of</strong> Corrections decision to release many felons back into our community<br />

without parole supervision.<br />

Chief Newton has prepared a detailed report with graphs and charts which demonstrate<br />

trends and population growth compared to number <strong>of</strong> crimes, etc. As the graph charts<br />

indicate while the <strong>City</strong> continues to enjoy a low per capita crime rate, theft and<br />

burglaries have substantial increased over the last two years. Also included in this report<br />

is an update on implementation <strong>of</strong> our False Alarm Ordinance and the various crime<br />

prevention and enforcement activities <strong>of</strong> the Police Department.<br />

General Retail Per Capita<br />

<strong>Kerman</strong> has a lower per capita sales tax than several cities in our area. Even<br />

more alarming is that <strong>Kerman</strong>’s per capita retail sales are far lower than those<br />

<strong>of</strong> surrounding communities; even those with lower overall per capita sales tax<br />

revenue (Dollar and % figures may change from year to year).<br />

General Retail<br />

From 1999 to 2009 <strong>Kerman</strong> nearly doubled in population. During the 11-year period,<br />

our per capita sales tax decreased from $9.98 in 1999 to $4.82 in 2009. This translates<br />

into the fact that commercial/retail growth has not kept pace with residential growth.<br />

However, the old adage that “commercial follows ro<strong>of</strong> tops” appears to be taking place<br />

in <strong>Kerman</strong>. A new expanded Rite Aid and new CVS pharmacy are testimonies to the<br />

built up, unmet retail needs in <strong>Kerman</strong>. These and other figures, especially when<br />

compared to the per capita figures from nearby communities, indicates that there is<br />

substantial commercial/retail capacity and significant unmet consumer needs in<br />

<strong>Kerman</strong>.<br />

The above breaks down the general retail sales tax per business type in the <strong>City</strong><br />

<strong>of</strong> <strong>Kerman</strong>. In the <strong>City</strong> <strong>of</strong> <strong>Kerman</strong> general retail sales tax represents only 8.3%<br />

<strong>of</strong> the total sales tax (compared to approximately 27% in Madera, 33% in Sanger & CA avg. <strong>of</strong><br />

29%). The general retail sales tax per capita is $4.82 while the total sales tax per<br />

capita is $58.00. While our total, per capita sales tax is very low; <strong>Kerman</strong>’s<br />

retail sales tax, with the exception <strong>of</strong> Drug Stores, is almost non-existent.<br />
