As already reported above, on 20 July 2012 Agens, with the help of Federtrasporto and the Filt-Cgil, Fit-Cisl, Uiltrasporti,<br />

Ugl Trasporti and Fast <strong>Ferrovie</strong> trade union organis<strong>at</strong>ions, signed the n<strong>at</strong>ional collective labour agreement (CCNL,<br />

Contr<strong>at</strong>to Collettivo Nazionale di Lavoro) for workers in the Mobility sector/Railway Activities contract area; on 30 October<br />

2012 the agreement was also signed by Or.S.A. <strong>Ferrovie</strong>. Also on 20 July 2012, <strong>at</strong> the same time as the n<strong>at</strong>ional collective<br />

labour agreement, the FS Group and the trade union organis<strong>at</strong>ions also signed the FS Group Company Agreement, which<br />

was also subsequently signed by Or.S.A. <strong>Ferrovie</strong> on 30 October 2012.<br />

The two previous agreements had expired on <strong>31</strong> December 2008.<br />

The new CCNL agreement, which will expire on <strong>31</strong> December 2014, is the first n<strong>at</strong>ionwide labour agreement th<strong>at</strong><br />

contributes to the gradual construction of the CCNL agreement on Mobility for the new unified rail transport and local<br />

public transport sector, in accordance with the recommend<strong>at</strong>ions of the Memorandum on the CCNL agreement on Mobility<br />

signed in the presence of the Minister for Infrastructures and Transport on 14 May 2009, and the subsequent<br />

Understanding signed on 30 September 2010, again <strong>at</strong> the above Ministry.<br />

For the FS <strong>Italiane</strong> Group companies th<strong>at</strong> apply the two agreements (FS, RFI, Trenitalia, Italferr, Ferservizi, FS Sistemi<br />

Urbani and Italcertifer), the new regul<strong>at</strong>ions came into force on 1 September 2012.<br />

The arrangements th<strong>at</strong> were agreed, compared with the preceding system, allow gre<strong>at</strong>er flexibility in industrial rel<strong>at</strong>ions,<br />

working hours, rules on the utilis<strong>at</strong>ion of personnel and pay, thus resulting in a substantial increase in productivity. As<br />

regards working hours in particular, the changes from the previous arrangements are:<br />

- all employees work 38 hours a week instead of 36, shunting personnel 38 hours instead of 34;<br />

- relax<strong>at</strong>ion of the restrictions on working hours per day and on the arrangements for mobile personnel, which vary<br />

according to the lines of business (high-speed, medium- and long-distance, regional transport, cargo transport);<br />

- the possibility of negoti<strong>at</strong>ing further flexibility in working hours to meet specific production requirements <strong>at</strong> production<br />

unit level.<br />

As regards pay, the <strong>financial</strong> terms regarded both cover for the previous period, 2009 to 2011, and increases to cover the<br />

three-year period 2012-2014 in accordance with the provisions of the Joint Trade union agreement of 15 April 2009<br />

regarding the implement<strong>at</strong>ion of the master agreement on the reform of contract structures of 22 January 2009.<br />

Starting from 1 January 2013, the Group’s Company Agreement also introduced, for the first time, supplementary medical<br />

assistance schemes for all employees.<br />

Within the context of the European social dialogue, <strong>at</strong> CER level the FS <strong>Italiane</strong> Group applied the procedure for the<br />

prepar<strong>at</strong>ion of the 4 th Railway Package, specifically with reference to the review of Regul<strong>at</strong>ion 1370/2007 on local public<br />

transport. At the same time, the Group continued to particip<strong>at</strong>e in the restricted working group named “Social aspects<br />

and the protection of staff in case of change of railway oper<strong>at</strong>or” for checking the st<strong>at</strong>us of implement<strong>at</strong>ion of Regul<strong>at</strong>ion<br />

no. 1370/2007.<br />

Personnel management and development policies<br />

As in previous years, measures continued to be adopted to increase efficiency and productivity. A contribution to this was<br />

the sign<strong>at</strong>ure of the new Collective Labour Agreement, the favourable effects of which were seen in the last four months<br />

of the year.<br />
