The <strong>Expiation</strong> <strong>of</strong> Offences Act 1996 and Australian Road Rules include provisions that allow an expiation notice to be<br />

withdrawn if certain circumstances exist or the <strong>of</strong>fence could be considered trifling (<strong>for</strong> the special meaning <strong>of</strong> trifling see<br />

Section 4(2) <strong>of</strong> the <strong>Expiation</strong> <strong>of</strong> Offences Act 1996).<br />

To assist the Council in determining whether to withdraw your expiation notice, please answer ‘YES’ or ‘NO’ to the following<br />

questions be<strong>for</strong>e completing a statement overleaf.<br />

Were you directed to park or stop in the detected location by an Officer <strong>of</strong> South Australia Police If<br />

yes, please provide documented evidence from the Police Officer.<br />

Was there a medical emergency which resulted in the vehicle being parked or stopped in the detected<br />

location If yes, please provide a copy <strong>of</strong> the documented evidence from the South Australian Ambulance<br />

Service or Registrar <strong>of</strong> the relevant Hospital Emergency Administration Department.<br />

Was there a mechanical failure to the vehicle which resulted in it being parked or stopped in the<br />

detected location and which prevented the vehicle from being moved to a legal parking space If yes,<br />

please provide documented evidence from Roadside Assistance or attending Mechanic or Towing Company<br />

confirming date/time <strong>of</strong> attendance at the location <strong>of</strong> your vehicle.<br />

Does the <strong>Expiation</strong> <strong>Notice</strong> which you received contain incorrect in<strong>for</strong>mation, such as incorrect date or<br />

location If yes, please detail in your written statement. Please note that photographs may have been taken<br />

at the time <strong>of</strong> the <strong>of</strong>fence and a new expiation notice may be issued with corrected in<strong>for</strong>mation.<br />

1. If you answered No to the questions listed above it is unlikely that the expiation notice will be withdrawn. However, you<br />

may wish to provide the Council with further in<strong>for</strong>mation as to why the <strong>Expiation</strong> <strong>Notice</strong> should be withdrawn by providing a<br />

statement overleaf.<br />

2. In certain circumstances Council may request a Statutory Declaration to support the in<strong>for</strong>mation detailed in the statement<br />

overleaf. To avoid further delays you may wish obtain a Statutory Declaration from Councils Offices or download from<br />

http://www.burnside.sa.gov.<strong>au</strong>/Live/Forms_Permits to submit with this review <strong>for</strong>m.<br />

3. Section 15(4) <strong>of</strong> the <strong>Expiation</strong> <strong>of</strong> Offences Act 1996 provides that payment <strong>of</strong> an expiation notice does not constitute an<br />

admission <strong>of</strong> guilt or civil liability.<br />

4. Payment <strong>of</strong> the expiation fee can be made by phoning the Council Offices (8366 4200) during business hours or online<br />

via our website www.burnside.sa.gov.<strong>au</strong> or in person at 401 Greenhill Rd Tusmore <strong>SA</strong> 5065.<br />

5. If you are having financial difficulties and unable to pay by the due date, an application can be made to the Fines<br />

En<strong>for</strong>cement and Recovery Unit to make payments by instalments, call 1800 659 538 or www.fines.sa.gov.<strong>au</strong>
