Timeframes Timeframes are a new part of the building approval process. They are prescribed in regulations and are business days (so exclude all public holidays). Common to all applications is the ability for permit authorities to request further information for incomplete applications, instead of refusing them. A permit authority may specify up to 21 calendar days for further information to be supplied. Once the information is supplied, the clock is restarted from the beginning. The permit authority has 25 business days (for uncertified applications) or 10 business days (for certified applications) to make a decision on the application. These timeframes start from the day after the day when the information was lodged. Maximum Timeframe for Permit Applications Applications Initial timeframe (business days) Further Information (calendar days) Timeframe after further information due (business days) Building Permit (uncertified) 25 up to 21 25 Demolition, Occupancy and 10 up to 21 10 Building Permit (certified) Levies and Fees Permit authorities will be responsible for the collection of the Building Services Levy and can charge fees for applications. A schedule of fees is available from the Building Commission website. The Building Services Levy only replaces the Builders Registration Board levy, not any other levies or fees. Table 2 Repayment of Fees If the permit authority has not made a decision to approve a permit within the prescribed timeframe, the permit fee must be repaid to the applicant. However, if the application is refused, then there is no obligation to refund the permit fee. Repayment of Levy If an application for a permit is refused by the Permit Authority, the Permit Authority must refund the Building Services Levy to the applicant included in the written notice of the decision to refuse the application (see Permits and Certificates section below) 10
