address the issue at hand. He favored Ms. Walsh’s suggestion to request direction from
the Planning Department or Legal Department regarding the rules and procedures for ex
parte contact. BOARD MEMBER WALSH agreed that worksessions are helpful, but she
felt a letter of instruction, memorandum or other written direction from Legal would be
useful as well.
BOARD MEMBER KREGER stated in the second matter reconsidered this evening he
felt that new information had been introduced, but in the first he felt the issue had been
aired and he felt the way it was handled the first time was thorough. He stated he
generally does not favor the reconsideration process because it generally does not allow
for the public hearing to be re-opened, which may not be appropriate to due process.
BOARD MEMBER WALSH responded that occasionally events occur that have left her
feeling uncomfortable, such as the Board setting conditions that were not appropriate.
CHAIR PHELPS understood that was the rationale behind a reconsideration. The process
provides an opportunity for making appropriate change. He differentiated between the
Board feeling a change is necessary and a request being made by an outside party.
