General Description<br />
Clarifies the zoning code regulations for fences<br />
apply to walls and hedges.<br />
Restores non-mandatory design guidelines<br />
(removed on 11-2-09) to better address F.S.<br />
166.033 that requires a written notice for the<br />
denial <strong>of</strong> a site plan and to clarify the <strong>City</strong>’s intent<br />
for how an application can address the following<br />
site plan review standard. The guidelines<br />
illustrate how these criteria can be met. In<br />
response to concerns the guidelines are too<br />
controlling and could be used arbitrarily, two<br />
sentences were added about the “Role <strong>of</strong> these<br />
Guidelines” to further clarify the guidelines are<br />
advisory and voluntary.<br />

HISTORY:<br />
In 1987 the <strong>City</strong> established a<br />
downtown storefront program that<br />
included “design assistance” and<br />
“storefront guidelines” with an<br />
objective <strong>of</strong> promoting quality<br />
development. The program<br />
ended when the funding stopped.<br />
In 2002, this concept was<br />
continued with the adoption <strong>of</strong><br />
“Advisory Community Design<br />
Guidelines”, the Downtown Plan<br />
and Zone Districts.<br />

At the May 17, 20<strong>10</strong> public<br />
hearing one person<br />
questioned the need to<br />
regulate hedges. Staff<br />
clarified the only area<br />
regulated was RSM-9.<br />
DSA is not in favor <strong>of</strong> the<br />
Guidelines being restored.<br />
At the May 17, 20<strong>10</strong> public<br />
hearing several speakers<br />
were in support. One person<br />
spoke in opposition.<br />
