2. Glossary<br />
In this report:<br />
• ‘Abuse’ means:<br />
(a) <strong>the</strong> direct or indirect use <strong>of</strong> <strong>the</strong> funds, assets, accounts or facilities;<br />
(b) by a third party;<br />
(c) <strong>of</strong> an <strong>older</strong> person;<br />
(d) who is vulnerable because <strong>of</strong> incapacity, or dependence on or trust in a third party<br />
(which, <strong>to</strong>ge<strong>the</strong>r with detriment would make <strong>the</strong> conduct improper); or<br />
(e) which is illegal conduct (e.g. forgery or fraud); and<br />
(f) which is <strong>to</strong> <strong>the</strong> detriment on potential detriment <strong>of</strong> <strong>the</strong> <strong>older</strong> person<br />
and <strong>to</strong> <strong>the</strong> gain <strong>of</strong> ano<strong>the</strong>r person. 9<br />
• ‘ASIC Act’ means <strong>the</strong> Australian Securities and Investments Commission Act 2001 Cth).<br />
• ‘BFSO’ means <strong>the</strong> Banking and Financial Services Ombudsman.<br />
• ‘Code’ means <strong>the</strong> Code <strong>of</strong> Banking Practice.<br />
• ‘EPAF’ means Enduring Power <strong>of</strong> At<strong>to</strong>rney (Financial).<br />
• ‘Guardianship Act’ means <strong>the</strong> Guardianship and Administration Act 1986 (Vic).<br />
• ‘Instruments Act’ means <strong>the</strong> Instruments Act 1958 (Vic).<br />
• ‘NPP’ means <strong>the</strong> National Privacy Principles set out in <strong>the</strong> Privacy Act 1988 (Cth).<br />
• ‘OPA’ means <strong>the</strong> Vic<strong>to</strong>rian Office <strong>of</strong> <strong>the</strong> Public Advocate.<br />
• ‘Privacy Act’ means <strong>the</strong> Privacy Act 1988 (Cth).<br />
• ‘VCAT’ means <strong>the</strong> Vic<strong>to</strong>rian Civil and Administrative Tribunal.<br />
• ‘VCAT Act’ means <strong>the</strong> Vic<strong>to</strong>rian Civil and Administrative Tribunal Act 1998 (Vic).<br />
