(3) It is a defence <strong>to</strong> <strong>the</strong> publication <strong>of</strong> defama<strong>to</strong>ry matter if <strong>the</strong> defendant proves that –<br />
(a)<br />
(b)<br />
(c)<br />
<strong>the</strong> matter was an expression <strong>of</strong> opinion <strong>of</strong> a person (<strong>the</strong> commenta<strong>to</strong>r),<br />
o<strong>the</strong>r than <strong>the</strong> defendant or an employee or agent <strong>of</strong> <strong>the</strong> defendant,<br />
ra<strong>the</strong>r than a statement <strong>of</strong> fact; and<br />
<strong>the</strong> opinion related <strong>to</strong> a matter <strong>of</strong> public interest; and<br />
<strong>the</strong> opinion is based on proper material.<br />
(4) A defence established under this section is defeated if, and only if, <strong>the</strong> plaintiff<br />
proves that –<br />
(a)<br />
(b)<br />
(c)<br />
in <strong>the</strong> case <strong>of</strong> a defence under subsection (1) – <strong>the</strong> opinion was not honestly<br />
held by <strong>the</strong> defendant at <strong>the</strong> time <strong>the</strong> defama<strong>to</strong>ry matter was published; or<br />
in <strong>the</strong> case <strong>of</strong> a defense under subsection (2) – <strong>the</strong> defendant did not believe<br />
that <strong>the</strong> opinion was honestly held by <strong>the</strong> employee or agent at <strong>the</strong> time <strong>the</strong><br />
defama<strong>to</strong>ry matter was published; or<br />
in <strong>the</strong> case <strong>of</strong> a defense under subsection (3) – <strong>the</strong> defendant had reasonable<br />
grounds <strong>to</strong> believe that <strong>the</strong> opinion was not honestly held by <strong>the</strong> commenta<strong>to</strong>r<br />
at <strong>the</strong> time <strong>the</strong> defama<strong>to</strong>ry matter was published.<br />
(5) For purposes <strong>of</strong> this section, an opinion is based on proper material if it is based<br />
on material that –<br />
(a)<br />
(b)<br />
(c)<br />
is substantially true; or<br />
was published on an occasion <strong>of</strong> absolute or qualified privilege<br />
(whe<strong>the</strong>r under this Act or at general law); or<br />
was published on an occasion that attracted <strong>the</strong> protection <strong>of</strong> a defence<br />
under this section or section 28 or 29.<br />
(6) An opinion does not cease <strong>to</strong> be based on proper material only because some<br />
<strong>of</strong> <strong>the</strong> material on which it is based is not proper material if <strong>the</strong> opinion might<br />
reasonably be based on such <strong>of</strong> <strong>the</strong> material as is proper material.<br />
This honest opinion defence is defeated only if <strong>the</strong> plaintiff proves <strong>the</strong> opinion was not<br />
honestly held by <strong>the</strong> defendant at <strong>the</strong> time <strong>of</strong> <strong>the</strong> publication.<br />
This is essentially <strong>the</strong> same defence as that <strong>of</strong> ‘fair comment’ under <strong>the</strong> common law.<br />
This common law defence is preserved by <strong>the</strong> Uniform Acts in circumstances where it<br />
would apply and <strong>the</strong> statu<strong>to</strong>ry <strong>of</strong>fence is unavailable. Fur<strong>the</strong>r, many <strong>of</strong> <strong>the</strong> common law<br />
authorities are still relevant <strong>to</strong> <strong>the</strong> statu<strong>to</strong>ry defence because it is premised on a number<br />
<strong>of</strong> common law concepts, in particular:<br />
(a) whe<strong>the</strong>r <strong>the</strong> material published was an expression <strong>of</strong> opinion as opposed<br />
<strong>to</strong> a statement <strong>of</strong> fact;<br />
(b) whe<strong>the</strong>r <strong>the</strong> opinion related <strong>to</strong> a matter <strong>of</strong> public interest;<br />
(c) whe<strong>the</strong>r <strong>the</strong> opinion is based on material that is substantially true<br />
(or on certain privileged material);<br />
