5. Office <strong>of</strong> <strong>the</strong> Public Advocate<br />

5.1 Summary<br />

This section considers <strong>the</strong> <strong>financial</strong> vulnerability <strong>of</strong> elderly persons, focusing on those<br />

who are subject <strong>to</strong> Enduring Powers <strong>of</strong> At<strong>to</strong>rney (Financial) or Administration Orders,<br />

and discusses <strong>the</strong> role <strong>of</strong> <strong>the</strong> Vic<strong>to</strong>rian Office <strong>of</strong> <strong>the</strong> Public Advocate in preventing and<br />

addressing <strong>financial</strong> <strong>abuse</strong> <strong>of</strong> <strong>the</strong>se members <strong>of</strong> <strong>the</strong> community. In particular, this<br />

section will look at <strong>the</strong> role <strong>of</strong> banks in identifying and reporting suspected instances<br />

<strong>of</strong> <strong>financial</strong> <strong>abuse</strong> <strong>of</strong> elderly clients, and at <strong>the</strong> ramifications for banks <strong>of</strong> reporting this<br />

suspected <strong>abuse</strong>. Whe<strong>the</strong>r or not banks are subject <strong>to</strong> obligations <strong>of</strong> confidentiality and<br />

whe<strong>the</strong>r <strong>the</strong>y are immune from any potential legal action stemming from <strong>the</strong>ir reporting<br />

will be addressed in part 6 below.<br />

The focus <strong>of</strong> this section is on <strong>the</strong> role and powers <strong>of</strong> <strong>the</strong> Vic<strong>to</strong>rian OPA. A table<br />

summarising equivalent bodies, legislative provisions and administrative powers in<br />

o<strong>the</strong>r States and Terri<strong>to</strong>ries is attached at Schedule 1.<br />

5.2 The OPA – roles, obligations and powers<br />

(a) The OPA ‘aims <strong>to</strong> promote and protect <strong>the</strong> rights and dignity <strong>of</strong> <strong>people</strong> with disabilities’<br />

in Vic<strong>to</strong>ria. 15 Although <strong>the</strong> OPA sits within <strong>the</strong> Department <strong>of</strong> Justice, it is<br />

independent <strong>of</strong> government and reports <strong>to</strong> <strong>the</strong> Vic<strong>to</strong>rian Parliament. The OPA has<br />

a statu<strong>to</strong>ry responsibility <strong>to</strong> protect <strong>the</strong> rights <strong>of</strong> <strong>people</strong> with a disability, as well<br />

as legal powers <strong>to</strong> make enquiries on behalf <strong>of</strong> <strong>people</strong> with disabilities in response<br />

<strong>to</strong> concerns about <strong>the</strong>ir safety or interests. These powers and responsibilities are<br />

conferred on <strong>the</strong> OPA by <strong>the</strong> Guardianship Act and <strong>the</strong> Instruments Act.<br />

(b) Under section 16 <strong>of</strong> <strong>the</strong> Guardianship Act <strong>the</strong> powers and duties <strong>of</strong> <strong>the</strong> OPA include,<br />

amongst o<strong>the</strong>r things:<br />

(i)<br />

making applications <strong>to</strong> VCAT for <strong>the</strong> appointment <strong>of</strong> a guardian or<br />

administra<strong>to</strong>r or <strong>the</strong> rehearing or reassessment <strong>of</strong> a guardianship order<br />

or an administration order;<br />

submitting reports <strong>to</strong> VCAT on any matter referred <strong>to</strong> <strong>the</strong> OPA for a report<br />

by VCAT; and<br />

(iii) investigating any complaints or allegations that a person is under inappropriate<br />

guardianship or is being exploited or <strong>abuse</strong>d or in need <strong>of</strong> guardianship. 16<br />

(c) Under schedule 1, clause 35 <strong>of</strong> <strong>the</strong> VCAT Act, VCAT may refer any matter relating<br />

<strong>to</strong> a proceeding under <strong>the</strong> Guardianship Act or part XIA <strong>of</strong> <strong>the</strong> Instruments Act<br />

<strong>to</strong> <strong>the</strong> OPA for investigation and report. The OPA is <strong>the</strong>n obliged <strong>to</strong> investigate and<br />

report <strong>to</strong> VCAT on that matter, and VCAT is not permitted <strong>to</strong> determine a question<br />

referred <strong>to</strong> <strong>the</strong> OPA under this clause before receiving and considering <strong>the</strong><br />

OPA’s report.<br />
