Regula<strong>to</strong>ry framework<br />

The construction <strong>of</strong> new and proposed UK build<strong>in</strong>gs has pr<strong>in</strong>cipally been<br />

controlled through a system <strong>of</strong> build<strong>in</strong>g regulations s<strong>in</strong>ce <strong>the</strong> great fire <strong>of</strong><br />

London <strong>in</strong> 1666. Poor health conditions <strong>of</strong> an <strong>in</strong>creas<strong>in</strong>g population dur<strong>in</strong>g <strong>the</strong><br />

<strong>in</strong>dustrial revolution led <strong>to</strong> <strong>the</strong> Public Health Act 1875, which was significantly<br />

revised <strong>in</strong> 1936 and 1961. The first set <strong>of</strong> national build<strong>in</strong>g standards appeared<br />

as The Build<strong>in</strong>g Regulations 1965 (<strong>the</strong>se have now been superseded <strong>by</strong> The<br />

Build<strong>in</strong>g Regulations 2000 (as amended) under The Build<strong>in</strong>g Act 1984). The<br />

regulations were developed<br />

his<strong>to</strong>rically <strong>to</strong> legislate for safer and healthier<br />

build<strong>in</strong>gs. The specific provisions for <strong>the</strong> conservation <strong>of</strong> fuel and power did not<br />

appear until 1979 (Powell-Smith and Bill<strong>in</strong>g<strong>to</strong>n, 1995), as <strong>the</strong> environmental<br />

impacts <strong>of</strong> energy use became more apparent.<br />

Global carbon emissions from energy generation <strong>by</strong> fossil fuel burn<strong>in</strong>g are ris<strong>in</strong>g<br />

(Figure 4) and <strong>the</strong> resultant climate change is believed <strong>to</strong> be near, or past, a<br />

tipp<strong>in</strong>g po<strong>in</strong>t, where effects, such as sea level rise and dangerously <strong>in</strong>creased<br />

global average temperatures, are irreversible (L<strong>in</strong>dsay and Zhang, 2005;<br />

Hansen, 2005; and Lovelock, 2006), as atmospheric carbon dioxide levels rise<br />

(Figure 5). This is driv<strong>in</strong>g and accelerat<strong>in</strong>g <strong>the</strong> regula<strong>to</strong>ry control <strong>of</strong> build<strong>in</strong>g<br />

energy use at local, national, European and global levels.<br />
