OF <strong>GLOUCESTER</strong>, ENTITLED “BUS STOPS”<br />

BE IT ORDAINED by the Township Council of the Township of Gloucester, County of<br />

Camden and State of New Jersey, as follows:<br />

SECTION 1.<br />

Chapter 81, Section 81-28 of the Code of the Township of Gloucester,<br />

entitled, “Bus Stops” be and is hereby amended by adding the following bus stops:<br />

ENTITLED, “ANTI-GRAFFITI”<br />

BE IT ORDAINED by the Township Council of the Township of Gloucester in the<br />

County of Camden, State of New Jersey, that Chapter 29, of the Code of the Township of<br />

Gloucester entitled, “Anti-Graffiti” be and is hereby amended as follows:


SECTION 1. PURPOSE. The Township Council of the Township of Gloucester has<br />

determined that the presence of Graffiti on buildings and structures within<br />

the Township of Gloucester may have an adverse effect on the community<br />

public health, safety and welfare, which adverse effects include, but not<br />

limited to depreciation of property values, deterioration of neighborhoods,<br />

increase in incidents of blight, litter and the interference with property<br />

owners’ enjoyment of their property.<br />

The Township of Gloucester has further determined that acts of Graffiti by<br />

youths are increasing within the Township of Gloucester and that such acts<br />

may be attributed to the lack of care, custody, control and supervision by<br />

the parent.<br />

The Township has further determined that parents should have some<br />

responsibility for the conduct of their children and there should be some<br />

deterrence by Ordinance to juvenile acts of vandalism by graffiti and to<br />

parental neglect of juvenile supervision.<br />

The Township of Gloucester therefore determines that it is desirable to<br />

establish a penalty by Ordinance and a recovery for the damages expended<br />

for acts of juvenile graffiti from the neglectful parent, guardian or other<br />

person having legal custody over the juvenile who caused such damage by<br />

graffiti.<br />

SECTION 2.<br />

That Section 29-7 be and is hereby amended as follows:<br />

Any person convicted of violation of Section 2 of this Ordinance shall pay<br />

a fine of not less than $500.00 nor more than $1,000.00 and or be<br />

imprisoned in the County jail for a period of not more than ninety (90)<br />

days.


The parent, guardian or other person having legal custody over a juvenile<br />

determined delinquent for having committed an act of Graffiti in violation<br />

of this Ordinance or who has admitted an act of graffiti shall be subject to<br />

a fine of not less than $500.00 nor more than $1,000.00 and shall be<br />

further subject to an order for restitution for the full amount of damages<br />

caused by the juvenile’s act of graffiti by a Court of Competent<br />

jurisdiction.<br />

Any person convicted of a violation of Section 4 of this Ordinance shall<br />

pay a fine of not less than $500.00 nor more than $1,000.00 per violation.<br />

Each violation of any provision of the Ordinance and each day the same is<br />

violated shall be deemed a separate offense.<br />

SECTION 3.<br />

Any ordinances and provisions thereof inconsistent with the provisions of<br />

this Ordinance shall be and are hereby repealed to the extent of such inconsistency.<br />

SECTION 4.<br />

If any section, subsection or part, clause or phrase of this Ordinance shall<br />

ORDINANCE AMENDING CHAPTER 67A OF THE CODE<br />

OF THE <strong>TOWNSHIP</strong> OF <strong>GLOUCESTER</strong> ENTITLED, “PROPERTY<br />

MAINTENANCE CODE”<br />

BE IT ORDAINED that the Township Council of the Township of Gloucester, County of<br />

Camden, State of New Jersey, that Chapter 67A entitled, “Property Maintenance Code” of the<br />

Township of Gloucester be amended as follows:


SECTION 1.<br />

That Article VII, Section 67A-15.A of Chapter 67A of the Code of the<br />

Township of Gloucester entitled, “General administrative provisions” be and is hereby amended<br />

to read as follows:<br />

“A.<br />

Whenever the Public Officer has received proof of a violation of 67A.9 (A&B)<br />

notice of said violation shall be served on the owner or operator of the premises, directing that<br />

the said violation shall be corrected within seven (7) days of the date of notice. In the event that<br />

the owner or operator shall refuse or fail to correct violation, the Public Officer shall have the<br />

authority to enter upon the premises for the purpose of correcting the violation. The cost of the<br />

correction of the violation shall be certified to the owner or operator of premises and shall be<br />

charged against the premises, and the amount so charged shall become a lien upon said lands and<br />

premises to be added to and become and form a part of the taxes next to be assessed and levied<br />

upon said lands and premises, to bear interest at the same rate as other taxes and municipal liens,<br />

and shall be collected and enforced by the same municipal officer in the same manner as other<br />

taxes and municipal liens.<br />

For the purpose of this sub-section “A” the following shall be the<br />

cost of correcting a violation:<br />

1. Actual cost charged to the Township of Gloucester by provider of services.<br />

2. Township Administrative cost in the amount of $150.00<br />

3. Any other fine or penalty imposed under Section 67A-29 below. ”<br />

SECTION 2.<br />

That Article VIII, Section 67A-29 entitled, Violations and Penalties, be<br />

and is hereby amended to read as follows:<br />

Ҥ 67A-29 Violations and penalties.


Any person, firm or corporation who shall violate any of the provisions of<br />

this Ordinance shall upon conviction, be punished by a fine of not to exceed Five<br />

Hundred ($500.00) Dollars or by imprisonment in the County jail for a period of<br />

not to exceed ninety (90) days, or by both such fine and imprisonment, and each<br />

violation of any of the provisions of this ordinance and each day the same is<br />

violated shall be deemed and taken to be a separate and distinct offense. A<br />

conviction of a second and subsequent offense of any of the provisions of this<br />

ordinance shall upon conviction, be punished by a fine of $1,000.00 or by<br />

imprisonment in the County Jail for a period of not to exceed ninety (90)days, or<br />

both.”<br />

SECTION 3.<br />

All ordinances and provisions thereof inconsistent with the provisions of<br />

this Ordinance shall be and are hereby repealed to the extent of such inconsistency.<br />

SECTION 4.<br />

WHEREAS, the developer of Howard Johnson Express Inn has supplied the Township<br />

of Gloucester with securities covering this development, within the Township of Gloucester, and<br />

WHEREAS, the Engineer has inspected this project and has given his report to the<br />

Township Council of the Township of Gloucester, and<br />

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township<br />

DELINQUENT TAXES, SEWER AND OTHER MUNICIPAL CHARGES AND SETTING<br />

THE GRACE PERIOD<br />

WHEREAS, N.J.S.A. 54:4-67 governs the interest rates to be charged on<br />

delinquent taxes and allows the governing body to set a grace period not to exceed the (10) days;<br />

and<br />

WHEREAS, interest on delinquent taxes may be fixed at a rate of 8% on the first<br />

$1,500.00 of delinquency, and at a rate of 18% on that portion of the delinquent tax balance which<br />

is in excess of $1,500.00; and<br />

WHEREAS, P.L. 1991 c.75,s.39 provides that a penalty of 6% may be charged to a<br />

taxpayer with a delinquency in excess of $10,000.00 who fails to pay the delinquency prior to the<br />

end of the fiscal year.<br />

THEREFORE, BE IT RESOLVED, by the Township Council of the Township of<br />

Gloucester, County of Camden, State of New Jersey, as follows:


1. That the Tax Collector is hereby authorized and directed to charge 8% per<br />

annum on the first $1,500.00 becoming delinquent after the due date and 18% per<br />

annum on any amount of delinquency in excess of $1,500.00 becoming delinquent<br />

after the due date for nonpayment of taxes, sewer and other municipal charges.<br />

2. That the Tax Collector is hereby authorized and directed to charge a 6% year end<br />

penalty to those properties who fail to pay delinquencies in excess of $10,000.00<br />

prior to the end of the fiscal year.<br />

3. That the Tax Collector is instructed that no interest shall be charged if the<br />

payment of a tax installment is received by the Tax Collector within the tenth (10)<br />

day following the date upon which the tax installment become payable.<br />

Avenue and Ridge Ave is causing a serious drainage situation, and<br />

WHEREAS, the Business Administrator was provided factual information from the<br />

Department of Public Works and the Township Drainage Engineer supporting the emergent<br />

situation and the need for immediate repairs.


NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township<br />

of Gloucester confirms declaration of an emergency situation for the above named intersection<br />

requiring immediate engineering and survey services.<br />

BE IT FURTHER RESOLVED that the Township Council confirm the directing of a<br />

contract to Consulting Engineering Services without a certificate of availability of funds in the<br />

Government Services may approve expenditures of monies by dedication by rider,<br />
