ORDINANCE AMENDING CHAPTER 81 OF THE CODE OF THE<br />

<strong>TOWNSHIP</strong> OF <strong>GLOUCESTER</strong> ENTITLED, “VEHICLES AND TRAFFIC”<br />

PROHIBITING LEFT-TURN MOVEMENT FROM THE WAWA AT 800 N.<br />

BLACK HORSE PIKE ONTO NB RT. 168<br />

BE IT ORDAINED by the Township Council of Township of Gloucester, County of<br />

Camden, State of New Jersey that Chapter 81 of the Code of the Township of<br />

Gloucester Be and is hereby amended as follows:<br />

SECTION 1. That Section 81-25 entitled, “Turn Prohibitions” be and is hereby<br />

amended by adding the following:<br />

SECTION 3. Unless another penalty is expressly provided by New Jersey Statute,<br />

N.J.S.A. 39:4-<strong>12</strong>4, every person convicted of a violation of a provision of this<br />

Ordinance shall be liable to a fine of not more than Two Hundred Dollars $200.00)<br />

or imprisonment for a term not exceeding fifteen (15) days or both.<br />

SECTION 4. If any part or parts of this Ordinance are for any reason held to be<br />

invalid, such decision shall not take the validity of the remaining portions of this<br />

Ordinance.<br />

SECTION 5. All former traffic ordinance or part of ordinances of the Township of<br />

Gloucester in conflict with or inconsistent with the provisions of this Ordinance are<br />

hereby repealed, except that this repeal shall not affect or prevent the prosecution or


punishment of any person for any act done or committed in violation of any<br />

ordinance hereby repealed prior to the taking of this Ordinance.<br />

SECTION 6. This Ordinance shall take effect immediately after final passage and<br />

publication as required by law.<br />

WHEREAS, on June 22, <strong>2010</strong>, a tax sale certificate #10-00585 was sold in the<br />

amount of $2,149.59 with a premium of $600.00 on Block 13402, lot 4, for unpaid taxes to


Tower Lien LLC, and<br />

WHEREAS, this certificate was sold in error due to a bankruptcy that was filed,<br />

WHEREAS, the lien holder will be notified prior to the certificate being issued,<br />

unpaid taxes and sewer charges was paid by Norman Remick, and<br />

WHEREAS, this amount was already paid by the homeowner,<br />

WHEREAS, the sewer authorities were paid and refunding the Township,<br />

with securities covering this development, within the Township of Gloucester, and<br />

WHEREAS, the Engineer has inspected this project and has given his report to the<br />

Township Council of the Township of Gloucester, and<br />

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of<br />

Gloucester that the securities in the amount of $157,761.23 in the name of WaWa Inc. be released<br />

Public Portion:<br />

Mr. Bianchini opened the public portion.<br />

Ms. Garvey of 316 Byron Court of Terrestria spoke about the severe sewer problem in her<br />

neighborhood. She stated that some people have had numerous problems. She stated that she has<br />

made an attempt to find out who owns the lines. She stated that this is not acceptable as these<br />

people pay MUA fees as well as taxes.<br />

Joanne Carr asked when the next tax bill is coming out. Mr. Cardis explained that the bill will be<br />

coming out in a few days and that it will be for the August quarter only.<br />

Tanya Brown stated that her sewer problem has been exacerbated. She stated that this will<br />

eventually be a serious problem. She questioned why the Public Works Department has access to<br />

their development since the township is saying that they are a private development. Mr. Bianchini<br />

stated that Public Works and the Gloucester Township MUA are two different entities and the MUA<br />

handles the sewer system. He stated that the MUA has said that the Terrestria Homeowners<br />

Association owns the sewer lines. Mr. Bianchini stated that the township hired an engineer to<br />

telescope the lines, where they found many roots. The HOA did not want them to clean it out or go<br />

any further.<br />

Resident of 416 Senora Lane stated that she has not had an incident. She stated that she has lived in<br />

the development since 1976 and that the MUA used to service the units and stopped in 2003. It was<br />

stated that no can find evidence who is responsible for this problem.<br />

A resident of 406 Senora Lane stated that she felt that the GTMUA already set a precedent and now<br />

they won’t do anything because everything is old.<br />

Sarah Jones of Jaeger Court stated that she is an original owner from 1976 and she stated that the<br />

homes were advertised and sold with city water and sewer. She stated that she thinks the township<br />

is taking unfair advantage of the residents. She stated that she is open to see if Council was going<br />

to be of assistance.<br />

Don Estoy of Terrestria stated that he is sharing a degree of frustration with his neighbors and with<br />

Council. He stated that this problem is coming down to money. He stated that the residents should<br />

not have to litigate this. He stated that some of the sewer systems may collapse in the near future.<br />

The resident of 609 Jaeger Court stated that she had a problem with her home and she had<br />

$5,000.00 in damage from her backup.


Mr. Ray Polidoro of Erial stated that he does not live in Terrestria but he stated that he understands<br />

their problem. He also stated that people are unable to hear in the back of the room.<br />

Tanya Brown stated that the picture she handed out was making a point. She feels that she has been<br />

disrespected.<br />

Sarah Jones of 6<strong>12</strong> Jaegar Court stated that she has pictures of the actual damage and what the<br />

people are suffering<br />

Maureen McLaughlin of <strong>12</strong>5 Empire Avenue asked Mr. Bianchini why the Township has not got<br />

together with the GTMUA Mr. Bianchini stated that there have been meetings set up in the past.<br />

Mr. Bianchini stated that the township paid for an assessment to look at the lines. He stated that the<br />

GTMUA had the lines on camera. It was stated that the HOA did not want to take any<br />

responsibility. Mr. Bianchini stated that he has asked the MUA solicitor to reach out to the HOA<br />

and Mr. Long told him that he got no response from the HOA. Ms. Evans asked Council to suspend<br />

the peoples payment to the GTMUA. Mr. Bianchini stated that the GTMUA is a separate entity. Mr.<br />

Bianchini stated that it will be brought back to the boards. Ms. McLaughlin stated that there has to<br />

be some responsibility. She stated that the HOA is not representing the homeowners and that the<br />

HOA has not stepped up.<br />

A resident of 315 Byron Court stated that this is all about money, who owns it and who it belongs<br />

to. She asked who approved the system originally. She stated that if this road collapses it will be a<br />

major problem.<br />

Mr. Hutchison stated that he doesn’t have an answer but he is looking at the situation. He stated<br />

that all council members want this situation fixed. He stated that at this time there seems to be a<br />

dispute; he asked does the Council have the authority to spend the taxpayer’s money on something<br />

that may not be a problem of their doing He stated that the GTMUA started to map the pipes. He<br />

stated that we need to find out who the pipes belong to. Mr. Hutchison stated that the two groups<br />

need to come together and at least discuss the situation and repairs.<br />

Mr. Bianchini asked the Solicitor and the Clerk to sift through any old documents pertaining to this<br />

development. It was stated that it was built in the 1970’s.<br />

Theresa Garvey stated that she had put in an OPRA request and was told that there were no records.<br />

Mr. Bianchini also asked the solicitor to work with the MUA. Mr. Mercado asked what position the<br />

HOA takes on this problem. It was stated that the HOA said that to the best of their knowledge it<br />

was a public system and has historically been taken care of by the MUA.<br />

Mr. Hutchison stated that the council also needs to ask if the township should absorb this<br />

financially to address this situation. Mr. Hutchison stated that before the town does this, they may<br />

have to wait for a decision to come down.<br />

Mrs. Evans asked who is responsible for the pipes and she thinks that this needs a major<br />

investigation and the DEP, EPA and BPU should be called. She stated that she would rather see the<br />

MUA’s money go to a new sewer line as opposed to a new building.<br />

A resident stated that she feels this will eventually happen to all pipes in the development. She<br />

stated that if Terrestria is responsible, why are they paying sewer bills<br />

Mr. McLaughlin stated that the files should be kept forever. He stated that the Township should be<br />

looking at the Attorney’s office as well as the Engineer at the time. He also stated that the MUA<br />

should have the records.<br />

A resident stated that she hopes the township sleeps well, and another resident stated that she sold<br />

these houses at the time, and they had public sewer and public water.<br />

Kristin Jackson of 15 Fox Meadow asked what will be done to help Mrs. Evans stated that she<br />

would like to get to the bottom of this. She stated that someone should OPRA all of the GTMUA<br />

records.


Mr. Garbowski stated that the township does not know the whole situation. He stated that he has<br />

the same problem at his home because of roots in the pipes. He stated that the township does not<br />

know the whole situation and he stated he would like to see the records.<br />

Mr. Hutchison stated that Council has to collectively get together and make a decision. He stated<br />

that the Council would have to make the decision as a body to see if the town will be responsible<br />

for the entire system.<br />

Maureen McLaughlin of <strong>12</strong>5 Empire Avenue stated that by the next workshop, the solicitor should<br />

be able to speak about this. She also spoke about the Police Department now having a bike patrol.<br />

She asked how these were funded. Chief Earle stated that much of the new equipment for the<br />

Police Department has been taken care of either through grants or donations. He stated that the<br />

township has been holding Quality of Life Meetings where they discuss a neighborhood and make<br />

decisions whether to target some areas where there are problems. Ms. McLaughlin stated that this<br />

all should be put in the newsletter. She also questioned the problems at the Howard Johnson’s. She<br />

asked what Council could do about the lack of management at the hotel<br />

Polling of Directors:<br />

Chief Earle stated that the Township has just received a Drunk Driving Grant of approximately<br />

$4,400.00. He also stated that the Texas Road House will be giving a free steak dinner to one of the<br />

Police Dogs.<br />

Mr. Cardis stated that Res. R:10-06-191 that was passed on June 14, the amount on the resolution<br />

was $18,673,032 and should have read $31,340,064. He stated that the actual rate is correct. Mr.<br />

Cardis stated that this was reviewed by Mr. Carlamere and also the Division of Local Government<br />

Services which stated that the adjustment could be made.<br />

Mr. Carlamere stated that there was a time factor involved with this, and the township spoke with<br />

the Auditor concerning this. He stated that the rate is ok on the resolution.<br />

Polling of Council:<br />

Ms. Evans thanked the residents for coming to the meeting and bringing their concerns to council.<br />

She stated that Council is concerned. She stated that she has already told the public what she is<br />

going to do. She stated that they must find a way to resolve this. She thanked Mr. Schmitt of the<br />

Forrest Service who helped her fill out a grant application for trees.<br />

Mr. Hutchison stated that the Terrestria issue dominated the meeting and rightly so. He stated that<br />

he hopes the issues moves ahead. He has also asked the solicitor to give the council guidance. He<br />

stated that Council would address the problem and make a fiscally responsible decision.<br />

Mr. Garbowski thanked the residents for coming to the meeting and he hopes Council will be able<br />

to get to the bottom of the situation with Terrestria.<br />

Mr. Schmidt thanked the residents for coming to the meeting and staying.<br />

Mrs. Gentek thanked everyone for coming to the meeting. She stated that she agreed with Mr.<br />

Hutchison’s comments. Mrs. Gentek stated that Council takes the residents problems home with<br />

them and that Council does care about the residents. She stated that she wants a conclusion to the<br />

Terrestria problem.<br />

Mr. Mercado thanked the residents for coming to the meeting. He congratulated those people that<br />

were appointed. He stated that the Council is interested in fixing the problem with Terrestria. He<br />

stated that it is incumbent to get everyone on the same page. He stated that he has faith in Mr.<br />

Bianchini.<br />

Mr. Bianchini thanked everyone for attending. He thanked those appointed to the boards for their<br />

volunteerism. Mr. Bianchini stated that he will be working on this problem with the GTMUA and<br />

the HOA. He stated that he is concerned about the situation and will ask the GTMUA solicitor to<br />

reach back out to the HOA.<br />

Mrs. Gentek reminded everyone that Thursday night will be movie night at Veterans Park and there<br />

will also be a concert at The Shoppes at Cross Keys.<br />
