2.6 Public administration<br />

Indicator: Number <strong>of</strong> appeals for implementation <strong>of</strong> Civil Service Law<br />

The EC 2008 Progress Report for Albania states that “Overall, public administration is continuing to stabilise,” but<br />

more should be done to “enhance the impartiality <strong>of</strong> public administration <strong>and</strong> to establish an independent, meritbased,<br />

pr<strong>of</strong>essional civil service”.<br />

One indicator <strong>of</strong> public administration stability is the number <strong>of</strong> appeals for implementation <strong>of</strong> the Law on Civil<br />

Service. In 2008, this number fell to 193 from 354 a year earlier. Of these appeals, 69 were decided in favour <strong>of</strong><br />

the complaining civil servant <strong>and</strong> 75 against. Figure 6 shows the change in types <strong>of</strong> complaint. It is clear that the<br />

predominant issue was disciplinary measures (83 appeals, or 42% <strong>of</strong> the total number <strong>of</strong> appeals), at a level similar<br />

to that in 2007. A decrease was noted in the number <strong>of</strong> appeals for restructuring reasons (43 appeals, or 22.3% <strong>of</strong> the<br />

total, compared to 132 appeals <strong>and</strong> 37.4% in 2007). According to the Civil Service Council, the majority <strong>of</strong> appeals<br />

were filed by employees <strong>of</strong> local <strong>and</strong> customs administrations.<br />

Further steps were made to strengthen the capacity <strong>of</strong> the public administration through training activities,<br />

particularly to enable it to meet the challenges <strong>of</strong> European integration. Against this background, mention must<br />

be made <strong>of</strong> the further enhancement <strong>of</strong> TIPA’s capacities with the establishment <strong>of</strong> a Fiscal Training Centre <strong>and</strong><br />

a Local Government Training Centre, to respond to the training needs <strong>of</strong> the tax <strong>and</strong> local administrations.<br />

Nevertheless, in order to further orient public administration policies implementation <strong>of</strong> the <strong>Strategy</strong> on Public<br />

Administration Reform needs to be promoted. This strategy was adopted in October 2009, after wide consultations<br />

with interest groups <strong>and</strong> donors in 2008. This strategy shall provide orientation for interventions in the Law on<br />

Civil Service Status, with the view <strong>of</strong> intensifying the civil service reform <strong>and</strong> exp<strong>and</strong>ing the scope <strong>of</strong> the civil<br />

service law.<br />
