c) shall be set back a minimum distance <strong>of</strong> 12.0 metres (39.3 feet) from a lot line<br />

abutting lands that are in a Residential or Commercial Zone if the accessory outdoor<br />

storage is located in the Economic Development (ED) Zone; and,<br />

d) shall be set back a minimum distance equal to the required interior side yard and the<br />

rear yard for the main building from the interior side lot line and the rear lot line if<br />

the accessory outdoor storage is located in the Rural Industrial (IR) Zone.<br />

This provision shall not apply to permitted uses in the Private Recreation (PR) Zone.<br />

5.4 APARTMENT DWELLING UNITS ACCESSORY TO A SINGLE DETACHED<br />

DWELLING<br />

Notwithstanding any other provisions <strong>of</strong> this By-law, one apartment dwelling unit is permitted<br />

in a single detached dwelling in the Residential One (R1), Rural Residential (RUR1), Rural<br />

Residential (RUR2) and the Agricultural/Rural (A/RU) Zones provided:<br />

a) the single detached dwelling has a gross floor area greater than 110 square metres<br />

(1,184 square feet), exclusive <strong>of</strong> the apartment dwelling unit;<br />

b) the minimum floor area <strong>of</strong> the apartment dwelling unit is 50 square metres (538<br />

square feet);<br />

c) the maximum floor area <strong>of</strong> the apartment dwelling unit is 70 square metres (753.5<br />

square feet);<br />

d) the apartment dwelling unit has a means <strong>of</strong> egress to the outside that is separate from<br />

any means <strong>of</strong> egress for another dwelling unit; and,<br />

e) a window opening in the apartment dwelling unit having an area <strong>of</strong> 0.30 square metres<br />

(3.23 square feet) is located above grade.<br />

5.5 APARTMENT DWELLING UNITS ACCESSORY TO A COMMERCIAL USE<br />

Notwithstanding any other provisions <strong>of</strong> this By-law, apartment dwelling units that are in the<br />

same building as a permitted commercial use in the Local Commercial (LC) and General<br />

Commercial (GC) Zones are permitted provided:<br />

a) the floor area <strong>of</strong> the apartment dwelling units does not exceed 33% <strong>of</strong> the gross floor<br />

area <strong>of</strong> the principal use on the lot;<br />

b) the minimum floor area <strong>of</strong> the apartment dwelling unit is 50 square metres (538<br />

square feet);<br />

c) the maximum floor area <strong>of</strong> the apartment dwelling unit is 70 square metres (753.5<br />

square feet);<br />

d) the apartment dwelling unit has a means <strong>of</strong> egress to the outside that is separate from<br />

any means <strong>of</strong> egress for another dwelling unit or any commercial use; and,<br />

e) a window opening in the apartment dwelling unit having an area <strong>of</strong> 0.30 square metres
