) Decks which are either attached to a boathouse or are stand alone are permitted to be<br />
located at the water’s edge provided the total area <strong>of</strong> the deck and the boathouse does not<br />
exceed 70 square metres (753 square feet).<br />
c) Decks are permitted to encroach into the required interior side yard a distance <strong>of</strong> no more<br />
than 1.0 metre (3.2 feet) for one interior side yard only.<br />
5.8 DWELLING UNITS<br />
Unless otherwise specified by this By-law, no more than one dwelling unit is permitted on a<br />
lot.<br />
5.9 ENCROACHMENTS IN REQUIRED YARDS<br />
5.9.1 Architectural features and balconies<br />
Architectural features such as sills, belt courses, cornices, eaves or gutters, chimney breasts,<br />
pilasters, ro<strong>of</strong> overhangs, stairs and landings used to access a main building, cantilevered<br />
window bays, unenclosed porches and balconies may encroach into any required yard a<br />
distance <strong>of</strong> no more than 1.0 metre (3.2 feet).<br />
No porches or balconies are permitted to encroach in the setback area from the average high<br />
water mark <strong>of</strong> 15 metres (49.2 feet) from Bass Lake or 20 metres (65.5 feet) from Lake<br />
<strong>Simcoe</strong>.<br />
5.10 FRONTAGE ON A PUBLIC STREET<br />
Unless otherwise specified by this By-law, no person shall erect any building or structure and<br />
no person shall use any building or structure, lot or parcel unless the lot or parcel to be so<br />
used, or upon which the building is situated or erected or proposed to be erected, abuts or<br />
fronts on a street which is assumed by a public authority for maintenance purposes or is being<br />
constructed pursuant to a Subdivision Agreement with a public authority. For the purposes<br />
<strong>of</strong> this By-law, a lot separated from a public street by a reserve shall be deemed to abut such a<br />
public street.<br />
5.11 FRONTAGE ON A PRIVATE STREET<br />
Notwithstanding any other provision in this By-law, buildings and structures that existed on<br />
the effective date <strong>of</strong> this By-law can be used for a purpose permitted by this By-law if the lot<br />
on which the building or structure is situated fronts on a private street. In addition,<br />
alterations to such buildings and structures and the replacement <strong>of</strong> such buildings or<br />
structures are permitted provided the alteration or the replacement complies with the<br />
provisions <strong>of</strong> this By-law. The construction <strong>of</strong> a dwelling unit on a lot that is vacant on the<br />
effective date <strong>of</strong> this By-law is not permitted.<br />
