3.8 REPORTING AND ACCESS TO INFORMATION<br />
Council will report, on an annual basis or with such greater frequency as may be reasonable required, to<br />
<strong>the</strong> Membership on <strong>the</strong> <strong>First</strong> <strong>Nation</strong>’s financial statements and <strong>First</strong> <strong>Nation</strong> administered programs and<br />
services.<br />
Subject to <strong>the</strong>se polices, Council shall permit Members access, at all reasonable times, to <strong>the</strong> nonconfidential<br />
minutes <strong>of</strong> Council meetings; <strong>First</strong> <strong>Nation</strong> laws, by-laws and resolutions, <strong>the</strong> <strong>First</strong> <strong>Nation</strong><br />
annual budget, monthly financial statements, audit reports and <strong>First</strong> <strong>Nation</strong>’s administrative policies.<br />
Personal information about Members will not be disclosed to any Person except in accordance with <strong>the</strong><br />
<strong>First</strong> <strong>Nation</strong>’s privacy laws and policies and, in <strong>the</strong> absence <strong>the</strong>re<strong>of</strong>, generally accepted privacy<br />
principles.<br />
3.9 ACCOUNTABLITY<br />
Council is accountable to <strong>the</strong> <strong>First</strong> <strong>Nation</strong> and <strong>the</strong> Members in <strong>the</strong> performance <strong>of</strong> its duties and<br />
obligations.<br />
Chief and Councillors must carry out <strong>the</strong>ir duties in good faith and with diligence, care and skill.<br />
3.10 ENFORCEMENT<br />
Council has <strong>the</strong> authority to make and enforce its own rules and penalties for Chief and Councillors who<br />
are found negligent in carrying out (or failing to carry out) <strong>the</strong>ir duties or are o<strong>the</strong>rwise in contravention<br />
with <strong>the</strong>se policies.<br />
