List <strong>of</strong> Indictable Offences<br />
Definition: Indictable Offense-Generally, a more serious criminal charge as distinguished from a<br />
summery <strong>of</strong>fence. However, in Canada, <strong>the</strong> distinction between indictable <strong>of</strong>fenses and summery<br />
<strong>of</strong>fenses is somewhat blurred. In some instances, according to <strong>the</strong> provision <strong>of</strong> <strong>the</strong> Criminal Code, <strong>the</strong><br />
crown may determine whe<strong>the</strong>r an <strong>of</strong>fence is none<strong>the</strong>less indictable because, if <strong>the</strong> prosecution chose, it<br />
could proceed in respect <strong>of</strong> it summarily. Originally, indictable <strong>of</strong>fenses were tried only by <strong>the</strong> higher<br />
courts. This is still <strong>the</strong> case with reference to <strong>of</strong>fenses such as murder and treason under s.469 <strong>of</strong> <strong>the</strong><br />
criminal code, R.S.C. 1985, c. C-46. However o<strong>the</strong>r indictable <strong>of</strong>fenses can only be tried by magistrate or<br />
provincial court judge, while still o<strong>the</strong>rs may, at <strong>the</strong> option <strong>of</strong> <strong>the</strong> accused, be tried by a magistrate or<br />
county court judge, ei<strong>the</strong>r alone or with a jury.<br />
