The Family Court of Australia – annual report 1997-98 the Executive of the Family Law Section of the Law Council of Australia, Vice-President of the Family Law Practitioners’ Association and Family Law Committee of the Law Society of Western Australia. Justice Paul Guest was appointed a judge of the Family Court of Australia on 1 May 1998 to sit in the Melbourne Registry. Admitted to practise in 1965, his Honour signed the role of counsel of the Victorian Bar some four years later and took silk in 1983. His Honour was a member of the Bar Ethics Committee from 1989 to 1997, chairman of the Family Law Bar Association from 1986 to 1998 and organised and participated in the family law component of the Bar Readers Course. His Honour also had the distinction of representing Australia in the 1960, 1964 and 1968 Olympics at rowing. Justice Guest replaces Justice Peter Hase who retired in early 1998. Justice Heather Carter was appointed a judge of the Family Court of Australia on 27 May 1998 to sit in the Melbourne Registry. Her Honour was admitted to practise as a barrister in 1971 in New South Wales and as a barrister and solicitor in Victoria in 1972 and signed the role of counsel in that State in 1978. Her Honour was an occasional lecturer in Family Law at the Leo Cussen Institute in Melbourne and was Secretary of the Victorian Family Law Bar Association. Her Honour moved to Western Australia in 1990, practised at the Bar and in 1995 was appointed a deputy registrar and stipendiary magistrate of the Family Court of Western Australia before returning to the Victorian Bar in 1996. Justice Carter replaces Justice Graham who retired in July 1998. Justice Peter Underhill retired in December 1997 after almost 20 years on the Bench, having been appointed in 1978. His Honour held many varied appointments to do with children including President UNICEF Committee (Queensland), National Vice-President UNICEF, Chairman, Handicapped Persons Committee and Chairman Queensland Government Committee for the International Year of the Child. His Honour was awarded the UN Peace Medal in 1977 and made an Officer of the Order of the British Empire in 1977. Justice Peter Hase retired in January 1998 having been appointed to the bench in 1979, thus serving almost 20 years. Justice Doreen Bulbeck of the Adelaide Registry retired in January 1998 after 16 years service. Justice John Gun, also of the Adelaide Registry, retired in February 1998 after 22 years on the Bench, having been appointed in 1976. Justice Rodney Purvis retired in March 1998 after 13 years on the bench having been appointed in 1985. He was Chairman of the Trade Practices Committee of the Law Council of Australia for 12 years from 1978 and was also a presidential member of the Administrative Appeals Tribunal from 1986. His Honour also served in a formidable variety of other capacities as a member, chairman or president of various committees and organisations. Previous Annual Reports have warned of the diminution of judicial strength due to the absence of judges on long service leave. With the passing of the Court’s 22nd anniversary, 7
The Family Court of Australia – annual report 1997-98 judges appointed in the period 1976-77 have now completed 20 years on the bench and will, in the near future, be retiring. The following judges have indicated that they will shortly retire: ■ The Deputy Chief Justice the Honourable Justice AJ Barblett – August 1998 ■ The Honourable Justice M ARenaud – September 1998 ■ The Honourable Justice J F Fogarty – October 1998 ■ The Honourable Justice E Baker – January 1999 Prior to retirement judges clear accrued leave which causes listing problems in registries. Also, judges cannot sit immediately prior to retirement. Ideally judges should be replaced prior to retirement or, if this is not possible, no later than the actual date of retirement. Not to do so would put further pressure on already overcrowded lists. Of the present 52 judges, 12 (or 23%) are women and of the eight judicial registrars, one is female. There will be a further female appointment in September 1998 with the replacement for Justice Gun in the Adelaide Registry.
