PRESIDENT’S REPORT<br />

Crackdown on Backyarders Welcomed<br />

For too long our industry has<br />

been undermined by<br />

unqualified or unscrupulous<br />

operators, more commonly<br />

known as “backyarders”.<br />

These individuals, and<br />

sometimes groups, seek to<br />

operate in the shadows of the<br />

industry and rip off the<br />

unsuspecting car buyer or those<br />

seeking to have their vehicle<br />

repaired.<br />

The <strong>MTA</strong> maintains an<br />

ongoing fight against the<br />

infiltration of backyarders and<br />

we are encouraged by the<br />

ongoing technological<br />

development of vehicles which<br />

makes it harder and harder for<br />

those without the skills or<br />

proper equipment to work on<br />

these vehicles.<br />

Simply, these “backyarders” are<br />

a danger to the public. They sell<br />

unsafe vehicles which ever way<br />

they can. They repair accident<br />

damaged vehicles in ways which<br />

do not meet manufacturers<br />

specifications and this puts lives<br />

at risk.<br />

While we continue to lobby<br />

Government for vehicle<br />

inspections at change of<br />

ownership, we are pleased to see<br />

that the State Government<br />

through the new Commissioner<br />

for Consumer Affairs, David<br />

Green, is having a fair dinkum<br />

crack at the problem of backyard<br />

car dealers and those who don’t<br />

do the right thing.<br />

His strident move to<br />

enforcement of the current laws<br />

is to be commended.<br />

We are seeing a much more<br />

pro-active approach to those<br />

who seek to undermine public<br />

confidence in our industry.<br />

In the past four months, the<br />

Office of Consumer and<br />

Business Affairs (OCBA) has:<br />

• Reported individuals for<br />

interfering with the<br />

odometers of second hand<br />

vehicles;<br />

• Reported a licensed second<br />

hand dealer who has been<br />

posing as a “private” seller,<br />

therefore avoiding their<br />

obligations under the Second<br />

Hand Vehicle Dealers Act<br />

1995. He has also been<br />

reported for alleged breaches<br />

of the Fair Trading Act 1987.<br />

• Issued warnings to licensed<br />

dealers about failing to ensure<br />

required particulars are<br />

contained in their advertising<br />

of second hand vehicles<br />

• Issued written warnings to<br />

people about carrying on<br />

business as a second hand<br />

vehicle dealer whilst<br />

unlicensed.<br />

This activity reinforces the<br />

<strong>MTA</strong>’s position during<br />

negotiations on changes to the<br />

Second Hand Vehicle Dealers<br />

Act to allow some resources<br />

from the Second Hand Vehicle<br />

Dealers Compensation Fund to<br />

be used by OCBA in the future,<br />

for compliance purposes.<br />

We must do everything we can<br />

as members and as an<br />

Association to ensure that the<br />

buying public recognise that it is<br />

not in their interests to deal with<br />

“shonks”.<br />

<strong>MTA</strong>A and AADA<br />

Members need to be aware<br />

that the Australian Automobile<br />

Dealers Association (AADA)<br />

and the Motor Trades<br />

Association of Australia<br />

(<strong>MTA</strong>A) continue to represent<br />

our industry at a Federal<br />

Political level.<br />

Activity on franchising has<br />

been at the forefront of AADA<br />

and <strong>MTA</strong>A’s activities.<br />

Members may wish to reflect<br />

that the tax concession on new<br />

equipment introduced by the<br />

Federal Government last year did<br />

not include vehicles by accident.<br />

Our national organisation<br />

provides input to the Federal<br />

Government on many issues and<br />

this was but one. Then there was<br />

OzCar which was instrumental<br />

in freeing up the credit system for<br />

new car dealers.<br />

AADA has also been working<br />

with the Federal Treasury<br />

Department on the point of sale<br />

exemption (which many dealers<br />

will be able take advantage of )<br />

under the new National<br />

Consumer Credit Protection<br />

Act. AADA has been a member<br />

of the Attorney General’s<br />

Consultative Group, which is<br />

working on the introduction of<br />

the new Personal Property<br />

Security Reform which will see<br />

the introduction of a new<br />

national security register<br />

replacing all of the current state<br />

and territory registers. Motor<br />

vehicles will be a significant part<br />

of that new register. Both of<br />

those issues are very important<br />

to dealers and the day-to-day<br />

operations of their businesses<br />

and the National Secretariat has<br />

endeavoured to ensure that the<br />

compliance burden for dealers is<br />

kept to a minimum.<br />

AADA has also successfully<br />

argued against the introduction<br />

of lemon laws – both at a state<br />

level (when the issue was first<br />

raised by Victoria) and more<br />

recently during the review in<br />

2009 of statutory warranty<br />

arrangements.<br />

The Association also worked<br />

closely with the Australian<br />

Competition and Consumer<br />

Commission (ACCC) in<br />

relation to the changes to the<br />

laws on price advertising, which<br />

came into effect in late May last<br />

year. It was important to all<br />

dealers that the ACCC clearly<br />

understood the structure of<br />

vehicle and accessory pricing<br />

and how the new arrangements<br />

would impact on dealers. The<br />

National Secretariat also<br />

succeeded in having the ACCC<br />

remove offending cartoons from<br />

the Motor Vehicle Advertising<br />

Guidelines publication.<br />

Franchising matters have<br />

always been a focus of the<br />

national association and the<br />

National Secretariat continues,<br />

on behalf of motor vehicle<br />

dealers, to argue for a<br />

strengthening of the Code.<br />

So rest assured your<br />

Association and, through it, the<br />

national AADA are continuing<br />

to work on issues affecting our<br />

industry.<br />

There has been some<br />

commentary of new groups<br />

setting up to represent the<br />

industry but we have seen<br />

nothing more than words.<br />

That said, we remain in<br />

contact with other State<br />

Associations which are not<br />

members of AADA nationally<br />

or <strong>MTA</strong>A as member issues<br />

must override individual State<br />

boundaries.<br />

EXECUTIVE DIRECTOR’S REPORT<br />

The Great WorkCover Spin<br />

Well the new WorkCover<br />

rates have been released<br />

and there is good news and bad<br />

news for employers.<br />

Earlier this year, the<br />

WorkCover Board announced<br />

that it had reduced the average<br />

levy rate from 3 to 2.75 per cent.<br />

This reduction was too little<br />

and way overdue from the<br />

legislative changes which<br />

were put in place in 2008.<br />

These changes followed an<br />

independent review known as<br />

the Clayton Walsh review.<br />

At the time 1 the Government<br />

said the review was directed<br />

in part to an objective of “an<br />

average employer levy rate<br />

reduced to a range of 2.25 to<br />

2.75 per cent by <strong>July</strong> 1 2009”.<br />

Some in the business<br />

community think the latest<br />

reduction is a good result. I<br />

remind members and others that<br />

the current levy rate in Victoria<br />

is 1.387 per cent or just over<br />

half of our current average levy<br />

of 2.75 per cent. In New South<br />

Wales, their WorkCover levy<br />

has just been cut for the sixth<br />

successive time with a target rate<br />

of 1.66 per cent.<br />

Depending on what<br />

automotive industry sector you<br />

are in, your rate has hopefully<br />

gone down.<br />

But for some employers who<br />

manage their operations well<br />

and take their occupational<br />

health and safety responsibilities<br />

seriously, they are facing an<br />

increase in costs because of the<br />

removal of the Bonus/Penalty<br />

Scheme effective from<br />

<strong>July</strong> 1 2010.<br />

This ham-fisted decision<br />

typifies the mismanagement of<br />

the state’s workers compensation<br />

scheme – which is paid for by<br />

employers – which has been<br />

going on for too long.<br />

The decision to remove the<br />

Bonus/Penalty Scheme was made<br />

in mid 2008 but WorkCover<br />

did not communicate to every<br />

employer what it was going to do<br />

to replace it.<br />

After persistent lobbying<br />

by the <strong>MTA</strong> last year, a<br />

“consultation” process was<br />

put in place to develop an<br />

alternative to the Bonus/Penalty<br />

Scheme.<br />

But that alternative was never<br />

going to include a system which<br />

rewarded good employers and<br />

penalised not-so-good<br />

employers.<br />

Why? Because WorkCover<br />

had already committed to a new<br />

computer system which did not<br />

have the capacity for a bonus/<br />

penalty.<br />

Guess what – the outcome<br />

of the consultation process<br />

was a recommendation that a<br />

“consultant” should be hired<br />

to work with stakeholders to<br />

devise a new system.<br />

Is the WorkCover<br />

organisation so bereft of talent<br />

that it needs to bring in a high<br />

priced outsider to fix something<br />

that should be core business to<br />

the organisation?<br />

All this prevarication delayed<br />

any decision on the WorkCover<br />

rates for 2010/11.<br />

Businesses trying to plan a<br />

budget for 2010/11 would have<br />

found it virtually impossible<br />

to plan for the cost of workers<br />

compensation insurance.<br />

WorkCover seem to think it<br />

acceptable that we get the rates<br />

in the second week of June, just<br />

a few weeks before the start of<br />

the new financial year.<br />

That shows a fundamental<br />

disconnect with business and<br />

business planning.<br />

WorkCover’s latest letter<br />

to employers (something we<br />

said should have been issued<br />

months ago) tries to justify that<br />

removing the Bonus/Penalty<br />

Scheme is good for employers.<br />

Well it might be for the<br />

employers who have not<br />

managed their OH & S well –<br />

they won’t face a penalty.<br />

The letter in part states “This<br />

improved industry-based<br />

system without bonuses or<br />

penalties will be better for all<br />

stakeholders and will encourage<br />

industries to collaborate to find<br />

employment opportunities for<br />

workers with disabilities leading<br />

to further reductions in the<br />

total cost of workplace injuries.”<br />

What a load of cobblers! This<br />

is the sort of information we<br />

have come to expect from an<br />

organisation which is more<br />

intent on spin than the<br />

substance of properly managing<br />

claims.<br />

All sides of politics grimace<br />

when you mention the issue of<br />

WorkCover. Simply WorkCover<br />

doesn’t work well at all and<br />

hasn’t for many years.<br />

WorkCover has appointed<br />

a new Chief Executive, Rob<br />

Thomson, whose challenge is<br />

to rebuild confidence with the<br />

employer community. We look<br />

forward to any improvement.<br />

We will continue to hold<br />

WorkCover and the State<br />

Government to account on an<br />

organisation which is funded<br />

by employers who do not get an<br />

adequate say in its management.<br />

Kelly takes top honour By James Murphy<br />

Beginning by repairing his<br />

Leyland Mini Panelvan at<br />

15, Matthew Kelly was always<br />

destined to forge a career in the<br />

mechanical industry.<br />

The Lobethal resident, who<br />

is in the fourth of year of<br />

his apprenticeship, recently<br />

claimed the prestigious <strong>MTA</strong><br />

Apprentice of the Year.<br />

Commencing his apprenticeship<br />

only weeks after successfully<br />

completing Year 12, Matthew<br />

began his mechanical journey<br />

at Morris Mania, only to later<br />

move on to his current place of<br />

employment at Adelaide Exclusive<br />

Mechanical (AEM).<br />

“Initially I was hosted at<br />

Morris Mania which gave<br />

me a sound grounding in<br />

my apprenticeship where I<br />

completed many competencies<br />

in my Training Record Book<br />

and was close to completing<br />

others,” Kelly said.<br />

“The nature and age of the cars<br />

that Morris Mania focused on<br />

allowed me to learn the basics<br />

of mechanical fault diagnosis,<br />

repairs and principles.”<br />

The apprentice, who has been<br />

a member of the <strong>MTA</strong>-GTS<br />

Motorsport Repair Team since<br />

2007 and has worked at three<br />

Clipsal 500 events, said the<br />

<strong>MTA</strong>-GTS experience was of<br />

the highest quality.<br />

“The lecturing staff are<br />

dedicated and knowledgeable<br />

tradesman who devote<br />

themselves fully to the<br />

apprentices who they teach.<br />

“The training modules are<br />

relevant, thorough and well<br />

complemented by the training<br />

aids and the lecturers own<br />

experiences which they can also<br />

use in the curriculum where<br />

possible.”<br />

For the past two-and-a-halfyears<br />

Matthew has worked<br />

under the supervision of<br />

Sergio Della-Verde at Adelaide<br />

Exclusive Mechanical and the<br />

former Saint Ignatius student<br />

believes this experience has<br />

taken him to the next level.<br />

“My time at AEM has been<br />

excellent. I feel privileged to be<br />

hosted there. The vehicles that<br />

we deal with are on the cusp<br />

of technology so this ensures<br />

the cars are forever changing,<br />

which means I am consistently<br />

learning.<br />

“At the start of my<br />

apprenticeship I never expected<br />

to be fixing makes like BMW,<br />

Porsche, Ferrari, VW, Audi and<br />

Mercedes Benz and that is what<br />

I am doing at AEM.”<br />

Matthew has been recognised<br />

with a number of awards over<br />

his four years as an apprentice.<br />

He was recognised as a<br />

finalist at the 2010 Group<br />

Training Australia (SA) Branch<br />

Apprentice of the Year awards<br />

– where he was presented to the<br />

Governor of South Australia<br />

His Excellency Rear Admiral<br />

Kevin Scarce AC CSC RANR.<br />

Matthew has also been awarded<br />

as the GTA SA Apprentice of<br />

the Year Finalist 2009, Most<br />

Outstanding Achievement<br />

Award for Third Year Apprentice<br />

2008 and the <strong>MTA</strong>-GTS<br />

Occupational Health and Safety<br />

Award 2007 for trade school<br />

intake.<br />

Having been a part of<br />

Australia’s largest Motor Sport<br />

festival for the past three years<br />

has provided Matthew with<br />

some excellent experiences<br />

and allowed him to build some<br />

valuable contacts.<br />

“In 2008, I was offered a<br />

position in the <strong>MTA</strong>-GTS<br />

Motorsport Repair Team and<br />

was lucky enough to be invited<br />

to work in the pits for Ford<br />

Performance Racing (FPR) at<br />

the Clipsal 500.<br />

“Getting so close to the<br />

action, the adrenaline fuelled<br />

pit stops, helping with<br />

pre-race preparation and<br />

also experiencing the team<br />

dynamic, enthusiasm and<br />

excitement of the event gave<br />

me a rare insight into this side<br />

of the industry.”<br />

It is the fast pace of pit lane<br />

that Matthew would eventually<br />

like to see himself, but for the<br />

moment he is happy continuing<br />

to develop his trade with<br />

Adelaide Exclusive Mechanical.<br />

“Although my goals for the<br />

immediate future are firmly<br />

based at AEM, I would like to<br />

be more involved in motorsport.<br />

Hopefully with a V8 Supercar<br />

team such as Garry Rogers<br />

Motorsport.<br />

“I also find the prospect of<br />

perhaps joining the lecturing<br />

staff at the <strong>MTA</strong>-GTS later<br />

in my career quite appealing. I<br />

would like to give back to the<br />

industry and help apprentices in<br />

a similar way that I received.”<br />

One hundred and seventy<br />

four apprentices and<br />

trainees were honoured at<br />

the Group Training Scheme’s<br />

annual Graduation and Awards<br />

Ceremony in May.<br />

At the culmination of a<br />

memorable night - which was<br />

attended by Steven Richards and<br />

Mark Winterbottom of Ford<br />

Performance Racing - Matthew<br />

Kelly was named as Apprentice<br />

of the Year (see story on page 6.)<br />

“Since Matthew started his<br />

apprenticeship his commitment<br />

and enthusiasm for his chosen<br />

trade is nothing short of<br />

admirable,” <strong>MTA</strong> Executive<br />

Director, John Chapman said.<br />

“The graduation marks the end<br />

of an era for us as our young (we<br />

don’t have many mature aged<br />

apprentices) apprentices and<br />

trainees collect their certificates.<br />

“But it is just the start of the<br />

next stage in their career in the<br />

automotive industry.”<br />

The ceremony was also<br />

attended by the Honourable<br />

Jack Snelling MP, Minister<br />

for Employment, Training and<br />

Further Education.<br />

The Minister said the <strong>MTA</strong>-<br />

GTS would play a pivotal role<br />

in this state as it continued to<br />

deliver qualified people to the<br />

automotive industry.<br />

“The <strong>MTA</strong> Group Training<br />

Scheme is South Australia’s peak<br />

apprentice and training body<br />

for the motor industry. And it’s<br />

the State’s largest group training<br />

organisation, employing around<br />

15 per cent of the apprentices<br />

and trainees who are under a<br />

group training arrangement,”<br />

Minister Snelling said.<br />

“The Training and Skills<br />

Commission, in its Skills for<br />

Jobs plan, identified that group<br />

training organisations were<br />

crucial to retaining apprentices<br />

and ensuring they complete<br />

their qualifications. And it’s<br />

organisations like the <strong>MTA</strong> that<br />

will lead the way in training<br />

apprentices and providing<br />

qualified people for the<br />

automotive industry.”<br />

Training Scheme Chairman,<br />

spoke about the history of the<br />

Scheme and the initiatives now<br />

underway that are essential to<br />

the future of the industry.<br />

“It is amazing to think that<br />

28 years ago in 1982 the Group<br />

Training Scheme started<br />

business with only 10 apprentice<br />

motor mechanics,” he said.<br />

“At that time our <strong>MTA</strong> Board<br />

and others had a vision that<br />

one of the most important<br />

challenges for the motor<br />

industry was to ensure we had a<br />

training organisation that would<br />

provide the motor industry<br />

with highly skilled technical<br />

specialists.<br />

“Today that vision is a reality.<br />

We currently employ over<br />

500 apprentices and trainees<br />

throughout South Australia in<br />

the Automotive Industry and<br />

host them out to employers for a<br />

minimum of three months or for<br />

the full term of their Contract of<br />

Training.”<br />

Mr Clark said over 2,000<br />

apprentices and trainees have<br />

now graduated.<br />

“Over the last 12 months we<br />

expanded our program of Post<br />

Trade Courses to deliver courses<br />

that cover LP Gas Installation,<br />

LP Gas Service & Repair, SRS<br />

Air Bags, Air Conditioning,<br />

Body Management, Drive<br />

Management and Wheel<br />

Alignment.”<br />

Looking to the future, he said<br />

plans to develop the Royal Park<br />

training facility were now a<br />

reality.<br />

“We now have a state-of-theart<br />

training workshop which will<br />

help meet the skill demands for<br />

the motor trade industry and<br />

will allow the GTS to conduct<br />

stage two in diesel mechanics at<br />

Royal Park whereas previously<br />

apprentices were sent to TAFE<br />

at O’Halloran Hill. Our first<br />

group of 12 diesel mechanics<br />

to use the new workshop<br />

Luxury Car Tax on the agenda<br />

The <strong>MTA</strong>’s continued<br />

lobbying for changes to the<br />

Luxury Car Tax were on top of<br />

the agenda in a recent meeting<br />

with Shadow Opposition<br />

Treasurer Joe Hockey.<br />

<strong>MTA</strong> Executive Director,<br />

John Chapman told Mr<br />

Hockey that the Luxury Car<br />

Tax was discriminatory given<br />

that no other tax applied to<br />

luxury goods such as boats and<br />

jewellery.<br />

“We need to keep reinforcing<br />

the point that this tax is<br />

unfair – particularly as we head<br />

towards an election this year,”<br />

Mr Chapman said.<br />

Mr Hockey noted the <strong>MTA</strong>’s<br />

concerns and that in any event<br />

the current Luxury Car Tax<br />

threshold should be lifted from<br />

its current level of $57,180.<br />

Tax of 33 per cent is payable<br />

on the amount above the<br />

threshold subject to a few minor<br />

exemptions.<br />

The <strong>MTA</strong>’s position on the<br />

Luxury Car Tax was reinforced<br />

later in the day when <strong>MTA</strong><br />

Motorsport demands matched by the rewards<br />

Motorsport is a difficult<br />

niche to break into and a<br />

“very tough sport” but it is well<br />

worth the effort.<br />

That was one of the messages<br />

that Steven Richards and<br />

Mark Winterbottom of Ford<br />

Performance Vehicles delivered<br />

to <strong>MTA</strong>-GTS apprentices and<br />

trainees at their graduation.<br />

Richards said the skills the<br />

graduates had learned would<br />

stand them in good stead.<br />

He stressed that if they were<br />

committed to a career in<br />

motorsport, “eventually someone<br />

will give you a go”.<br />

Winterbottom said the rewards<br />

were worthwhile and that<br />

“making a career out of your<br />

hobby is a pretty cool thing”. Yet<br />

he reminded them that staying<br />

at the top was extremely difficult<br />

and an incredible amount of<br />

dedication and commitment was<br />

demanded from each member<br />

of the team.<br />

Starting in Karts at age 15,<br />

Richards went on to become<br />

the Australian Formula Ford<br />

Champion in 1994 and drove<br />

Auscar in 1995. In 1996 he also<br />

started his V8 Supercar career in<br />

Group Training Schemes<br />

including the <strong>MTA</strong>-<br />

GTS will gain a 10 per cent<br />

plus increase in one area of<br />

Further Education and<br />

Training, Hon. Jack Snelling<br />

MP announced the increase<br />

when he attended a meeting<br />

of Group Training Australia’s<br />

South Australian branch at the<br />

<strong>MTA</strong> recently.<br />

Group Training Schemes that<br />

the real threat for our future<br />

prosperity would be skills<br />

shortages.<br />

roles, with the days of four or<br />

five employees per team now just<br />

a memory, with teams of over 50<br />

supporting drivers.<br />

“The team is an industry<br />

within an industry,” he said.<br />

He stressed that passion was<br />

vital. Team members would be<br />

called on to work throughout<br />

the night to get cars ready for<br />

the next day’s racing and the<br />

measure of success was very<br />

clear.<br />

“Our bottom line at the end<br />

of the day is measured by a<br />

stopwatch,” he said.<br />

“We need to up-skill our<br />

workforce,” he said<br />

“Even more critical to our<br />

economy than improving<br />

infrastructure, are skills and<br />

group training organisations<br />

such as yours are critical in<br />

this.”<br />

The Minister announced that<br />

the State Government would<br />

issue a “green” paper on the<br />

future direction on training<br />

later in the year and would<br />

be seeking detailed feedback<br />

from all sectors involved in<br />

Voctational Education Training<br />

(VET).<br />

celebrated 40 years in business.<br />

The celebrations, which<br />

took place at its Regency Park<br />

workshop was attended by<br />

over 300 people and Managing<br />

Director, Rocc Giglio said the<br />

event just kept growing.<br />

“In our planning the<br />

celebration started out relatively<br />

small and just grew and grew.<br />

“The evening was a fantastic<br />

celebration and an opportunity<br />

to say thanks to all of our staff,<br />

our customers and to all those<br />

in the industry, both past and<br />

present, who have helped make<br />

us what we are today,” Rocc said.<br />

Rocc’s interest in the<br />

mechanical industry came about<br />

by accident. At the age of 13,<br />

Rocc was travelling with his<br />

siblings in the back of their<br />

father’s utility when it became<br />

involved in a chain collision.<br />

As his father’s interpreter, Rocc<br />

came to know the crash repairer<br />

and asked him for a job during<br />

the Christmas holidays. Rocc<br />

had intended to return to school<br />

but he enjoyed working and<br />

decided to stay on and the rest as<br />

they say is history.<br />

In 1965 Carisbrook Crash<br />

Repairers started as a car repairer<br />

in Salisbury and it wasn’t until<br />

the 1970s that Rocc and his<br />

team started repairing trucks.<br />

As their reputations grew,<br />

plans were made for a specialised<br />

heavy transport repairer. In 1982<br />

The NMVTRC held their<br />

annual StratPlan series<br />

forum on June 8 in Adelaide.<br />

These forums provide the<br />

stakeholders in theft reduction<br />

a chance to listen to the current<br />

progress and activities of<br />

the council. Representatives<br />

attending this year’s forum<br />

included the insurance industry,<br />

SA Police, government<br />

departments and industry<br />

representatives including the<br />

<strong>MTA</strong>.<br />

National APRAA Chairman<br />

George Papillo and Divisional<br />

Manager and South Australian<br />

theft committee member Peter<br />

McMahon were invited along<br />

with John Chapman in his dual<br />

role as NMVTRC member<br />

for <strong>MTA</strong>A and also <strong>MTA</strong><br />

Executive Director.<br />

During the course of 2009<br />

there has been an overall<br />

reduction of 13 per cent in<br />

thefts across Australia, while<br />

South Australia achieved a<br />

very impressive reduction of<br />

18 per cent in stolen vehicles<br />

contributing one-fifth of the<br />

total reduction across the<br />

country.<br />

Profit motivated theft has<br />

reduced by 27 per cent over a<br />

five-year period. As readers may<br />

be aware in 2007/08 there was a<br />

massive jump in the price paid<br />

for scrap reaching in some cases<br />

$400 a tonne. This correlated<br />

with a spike in stolen and not<br />

recovered vehicles, which has<br />

returned to pre 07/08 figures<br />

since the global financial crisis<br />

of 08/09.<br />

The topic of a ban in NSW<br />

of all repairable write-offs was<br />

discussed and thoughts given<br />

as to what will happen if any<br />

legislation tabled in NSW<br />

was successful and its possible<br />

outcomes in other states.<br />

The recently released report<br />

by the NMVTRC into<br />

damage assessment criteria was<br />

discussed, this is one of three<br />

reports being produced by the<br />

council and others will include<br />

best practices for vehicle identity<br />

and safety inspections into<br />

written-off vehicles and the<br />

“end of life” process.<br />

The <strong>MTA</strong> and our committees<br />

representing both recyclers<br />

and collision repairers have<br />

commented on the first report<br />

released. Recycling members will<br />

also be meeting with consultants<br />

for the council in regards to “end<br />

of life” of vehicles.<br />

One interesting point<br />

throughout the day was the<br />

statistic that vehicles 11 years<br />

and older are most subject to<br />

theft, as later model vehicles<br />

have increased security systems<br />

and are usually subject to theft<br />

only when the keys are stolen.<br />

Darran vander Woude<br />

admits that running a<br />

small business is not easy.<br />

But despite this Darran<br />

and Naiomi have as much<br />

passion for River Murray Auto<br />

Wreckers, a business created by<br />

Chris and Eve vander Woude,<br />

that they are willing to take on<br />

the challenge to not only keep<br />

the local business going, but to<br />

make in grow.<br />

“Chris and Eve are gradually<br />

passing over more and more<br />

responsibility for running the<br />

business. The challenge for us<br />

is to build on their great work<br />

and to keep building up the<br />

business, only changing our<br />

business practices to keep up<br />

with the times. We find this<br />

really interesting,” Mr vander<br />

Woude said.<br />

With experience gained by<br />

working in all areas of the<br />

business, Darran makes sure to<br />

continue his parents’ practice,<br />

which makes customer service a<br />

high priority – giving the right<br />

advice and service which suits<br />

them best.<br />

While there are no plans<br />

to start at another location<br />

or make drastic changes,<br />

Darran said maintaining <strong>MTA</strong><br />

membership was another<br />

important factor for a the<br />

business.<br />

“It helps to know that<br />

the support of the <strong>MTA</strong> is<br />

behind us, and the fact that<br />

they (<strong>MTA</strong>) does a lot of<br />

background work for us means<br />

we can concentrate on the dayto-day<br />

running of our business,”<br />

after their grandfather<br />

Mick Rosenthal opened a bike<br />

shop in Renmark, Jim and<br />

Phil Rosenthal have unveiled<br />

a stunning new dealership in<br />

Berri.<br />

“It is with great pride Jim and<br />

I and our families stand here<br />

tonight,” Phil said.<br />

“What would our grandfather<br />

be thinking?” he mused.<br />

travelled to the United States<br />

to undertake a concentrated<br />

hybrid training program.<br />

Richardson, who left<br />

Adelaide on June 24,<br />

undertook two three-day<br />

training courses and said on<br />

his departure that he would<br />

be trying to glean as much<br />

information as possible.<br />

“I am really excited about the<br />

opportunity to be able to travel<br />

over there. I will be trying to<br />

grab as much information as<br />

possible to bring back to <strong>MTA</strong><br />

members and apprentices,” Mr<br />

Richardson said.<br />

“It is a great opportunity for<br />

me as well as the <strong>MTA</strong> moving<br />

into a new generation of<br />

mechanical training.”<br />

The first of the training<br />

components will be focussed<br />

on an introduction to hybrid<br />

mechanics, the theories behind<br />

the vehicle and basic servicing.<br />

The second training module<br />

will go a little more in-depth<br />

and explore such elements as<br />

diagnosing, fault finding and<br />

principle of operation.<br />

<strong>MTA</strong> Executive Director,<br />

John Chapman said the<br />

investment in the trip and<br />

in Richardson’s training was<br />

an important one as the<br />

world continues to become<br />

increasingly environmentally<br />

conscious.<br />

“For us to be able to send<br />

one of our trainers to the<br />

United States to undertake<br />

such a training course means<br />

that we will be able to offer<br />

the most up-to-date training<br />

to our members and our<br />

apprentices,” Mr Chapman<br />

said.<br />

On his return Mr Richardson<br />

will provide a comprehensive<br />

report on the major elements<br />

that he learned. This report<br />

will appear in the next issue of<br />

Motor Trade.<br />

The Collision Repair Division<br />

Committee met on June 1<br />

2010 in North Adelaide.<br />

The committee spent<br />

considerable time on current<br />

business costs versus allowance;<br />

as we all know these have gone<br />

backwards in real terms.<br />

The committee as part of their<br />

strategic planning in the early<br />

part of the year are developing a<br />

program specific to the collision<br />

industry focusing on the front of<br />

the business which is the most<br />

undervalued piece of real estate<br />

in a crash shop - more news on<br />

that soon.<br />

On the agenda for discussion<br />

was also the current situation<br />

of the review of the Code<br />

of Conduct, the possible<br />

name change to the Quality<br />

Approved Member program,<br />

the national meeting in Perth<br />

in <strong>July</strong>, the new severity rating<br />

being implemented by Allianz<br />

Insurance without any industry<br />

consultation and current business<br />

costs versus allowances.<br />

The current negotiations of<br />

the external review of the Code<br />

of Conduct are proceeding well<br />

between the insurance and repair<br />

industry delegates.<br />

While not yet near completion,<br />

what is evident is the need to<br />

better promote and encourage<br />

better use of the Code by both<br />

sides.<br />

Network (AARN) on June 2 at<br />

The meeting covered a broad<br />

range of issues and the future<br />

direction of the group both in its<br />

marketing strategies and also its<br />

membership.<br />

The AARN group have nine<br />

members in South Australia and<br />

Frank Zulian has been appointed<br />

to the five member board.<br />

when they held their Annual<br />

General Meeting at Royal Park.<br />

The state-of-art $2.7 million<br />

workshop includes underground<br />

rainwater storage as well as<br />

green electricity generated by<br />

a large bank of solar panels<br />

feeding power to the workshop<br />

Southern country zone on May<br />

6 this year. Members enjoyed all<br />

the refinements of the Victory<br />

Hotel at Sellicks Beach as their<br />

chosen venue to hold the AGM.<br />

Good dining set the mood for<br />

good times allowing members<br />

to network and catch up with<br />

fellow industry business owners.<br />

On the business front,<br />

members were informed with<br />

presentations by <strong>MTA</strong> staff<br />

Tim Buckley and Paul Eblen.<br />

Paul spoke of the Fair Work<br />

Act and Award Modernisation<br />

changes and Tim previewed<br />

the <strong>MTA</strong> business plan for<br />

2010/11.<br />

Society and Steven Berry of<br />

SGIC Business Insurance were<br />

also able to mix with members<br />

Upper Spencer Gulf zone<br />

meeting<br />

The Upper Spencer Gulf zone<br />

dinner meeting was held<br />

at the Spencer Hotel, Whyalla<br />

on May 10 2010 and was well<br />

attended with members travelling<br />

from Port <strong>August</strong>a to attend.<br />

<strong>MTA</strong> staff member Anna<br />

Rau gave a presentation on the<br />

Fair Work Act highlighting the<br />

importance of changes such as<br />

the parental, personal, carers,<br />

compassionate leave, flexible<br />

working arrangements and the<br />

importance of employment<br />

documentation.<br />

Roger Ballantine presented<br />

the <strong>MTA</strong> 2010/2011 business<br />

plan outlining the key points<br />

of the GTS expansion with the<br />

completion of the $2.7m Heavy<br />

Vehicle Training Facility. He<br />

also outlined the extra courses<br />

on offer, the increased apprentice<br />

intake, environment auditing<br />

programs, member forums,<br />

increasing <strong>MTA</strong> membership<br />

and the importance of our<br />

business partners.<br />

The division also made a<br />

decision to continue with the<br />

“Alan Melville Apprentice<br />

Award” in combination with<br />

the local Whyalla Economic<br />

Development Award nights.<br />

Lower South East country zone<br />

The Lower South East<br />

zone dinner meeting was<br />

held at the Commodore on the<br />

Park Motel on April 19 2010<br />

with a good representation<br />

from member businesses in<br />

attendance.<br />

Chairman, Peter Roberts gave<br />

an overview on the role of the<br />

<strong>MTA</strong>, Board and Executive and<br />

advised members to remember<br />

to use <strong>MTA</strong> for problem issues.<br />

One area where assistance was<br />

requested was the growth in the<br />

district of roadside car selling<br />

and options to address this.<br />

Three Simple Rules for Smarter Super<br />

Search for lost super, consolidate your funds, and make the most<br />

of government co-contributions.<br />

Rule 1: What’s missing? Search for lost super<br />

Rule 3: Take advantage of co-contributions<br />

Super is your money. Don’t ignore it. One in two working<br />

Australians has an unclaimed super balance, and there is<br />

currently more than $12.9 billion in lost or forgotten super,<br />

according to AUSfund, one of Australia’s largest unclaimed<br />

super funds. How does it happen? If you’ve had more than<br />

one job, chances are there is more than one super fund<br />

account with your name on it. If you’ve moved house,<br />

changed names or employers, your old fund may have lost<br />

touch with you. Why not claim what’s yours and roll it<br />

into your <strong>MTA</strong>A Super account? It’s easy to arrange.<br />

Action plan: Visit the AUSfund unclaimed super website,<br />

www.unclaimedsuper.com.au or call AUSfund on<br />

1300 361 798; visit the Australian Taxation Office (ATO) website,<br />

www.ato.gov.au or call the ATO on 13 28 65.<br />

Rule 2: Get it together! Consolidate your funds<br />

Now that you’ve searched for and found any ‘missing’<br />

money, check your files at home to see if you have any<br />

other super fund statements. If you have several accounts<br />

you could be losing money by paying multiple fees or even<br />

multiple insurance premiums. It may be better value for<br />

you to consolidate all of your super into your <strong>MTA</strong>A Super<br />

account, with one set of low fees and one lot of affordable<br />

insurance cover. It’s important to consider any exit fees<br />

you might have to pay or any loss of benefits from other<br />

funds, for example insurance.<br />

If you plan to roll over your super into <strong>MTA</strong>A Super, it’s<br />

essential that you receive written notification from <strong>MTA</strong>A<br />

Super that your insurance arrangements have been<br />

accepted before you cancel your existing insurance cover<br />

with your other fund. Before deciding whether<br />

consolidating is right for you, we recommend that you seek<br />

personal financial advice from a licensed financial planner.<br />

Action plan: If you decide to rollover your super into <strong>MTA</strong>A<br />

Super, fill in a rollover form for each account you want to<br />

consolidate. The form is downloadable from our website,<br />

www.mtaasuper.com.au, or call us on 1300 362 415.<br />

Send your completed forms to <strong>MTA</strong>A Super and we will forward<br />

them to your other funds.<br />

This may sound too good to be true, but you can receive up to<br />

$1,000 from the government by simply making contributions to<br />

your super.<br />

How does it work? The government ‘co-contributes’ $1 for every<br />

eligible $1 you contribute from your after-tax income. This goes<br />

up to a maximum of $1,000 if your total income (including<br />

certain fringe benefits and salary-sacrifice contributions) is less<br />

than $31,920 in this financial year and you are under 71 years<br />

old. If you earn more than $31,920 you are still eligible for some<br />

co-contribution, up to a total income (including certain fringe<br />

benefits and salary- sacrifice contributions) of $61,920.<br />

Action plan: This couldn’t be easier. Make additional after- tax<br />

contributions to super, and the government co-contribution will<br />

be taken care of by the ATO as long as you submit a tax return<br />

and we have your tax file number. If you have any questions call<br />

our Customer Service Centre or visit the ATO website,<br />

www.ato.gov.au.<br />

A Little More Now Equals a Lot More Later<br />

These three simple rules will get you started, but there are many<br />

other smart ways to increase your retirement savings. Remember<br />

that the more you contribute now, the more time your money<br />

has to grow and earn compound interest (interest on interest)<br />

over the long term.<br />

Business Seminar proves invaluable in the Riverland<br />

With the Riverland region<br />

facing some tough<br />

times, the <strong>MTA</strong> hosted a small<br />

business seminar focussing on<br />

key survival tips in an economic<br />

downturn.<br />

Michael Corner from Wicked<br />

Consulting presented the oneand-a-half-hour<br />

session as part<br />

of the Riverland zone’s Annual<br />

General Meeting.<br />

The seminar was sponsored<br />

by the SA Government in<br />

conjunction with the <strong>MTA</strong>.<br />

One of the key messages<br />

was that “cash is king” and<br />

businesses need to be focusing<br />

on proper and timely invoicing,<br />

placing credit limits on slow<br />

paying customers and keeping<br />

on top of outstanding customer<br />

payments.<br />

“Don’t feel guilty about asking<br />

for money, it’s not personal,” Mr<br />

Corner said.<br />

Mr Corner also urged<br />

businesses to not cut their<br />

marketing budgets as to do so<br />

would risk losing presence in the<br />

marketplace.<br />

Another key message was the<br />

need to have a business plan<br />

which set out attainable and<br />

measureable goals and that key<br />

performance indicators should<br />

be developed.<br />

“Businesses need to also look at<br />

their internal reporting systems,”<br />

Mr Corner said.<br />

“It is no use producing reams<br />

of reports if you can’t understand<br />

them.<br />

“We need to look at cashflow,<br />

sales, risk and profitability to<br />

name just a few.”<br />

Mr Corner also urged business<br />

owners to critically review their<br />

operations and consolidate into<br />

areas where it was profitable.<br />

At the end of the session,<br />

Rosenthal reflected on his<br />

recent multi-million dollar<br />

investment in consolidating his<br />

dealership business with his<br />

brother Phil.<br />

“It is a tough time to be doing<br />

it and taking a lot of debt,” Mr<br />

Rosenthal said.<br />

“However we have looked back<br />

over history and the Riverland<br />

goes through this cycle almost<br />

exactly every 20 years.<br />

“It will come good – it always<br />

does.”<br />

Changes ahead from the Budget<br />

Not surprisingly in<br />

an election year, the<br />

Government’s third Federal<br />

Budget, together with the<br />

Government’s initial response to<br />

the Henry Tax Report, contains<br />

practically no bad news for<br />

individuals, small businesses and<br />

private companies.<br />

In fact the two sets of fiscal<br />

measures contain mainly good<br />

news for these groups, although<br />

much of the good news will not<br />

be delivered until some time in<br />

the future. For individuals, and<br />

small and private businesses,<br />

there are no new taxes, no<br />

increases in existing taxes<br />

and no new limitations on<br />

tax deductions, including<br />

deductions for superannuation<br />

contributions. There is only<br />

a minor adjustment to tax<br />

offsets (ie tax credits) and there<br />

is no additional taxation of<br />

superannuation contributions,<br />

earnings or benefits<br />

Individuals<br />

There are two main changes for<br />

individual tax payers.<br />

Tax discount on interest<br />

From <strong>July</strong> 1 2011 a discount of<br />

50 per cent of tax will apply on<br />

up to $1,000 of interest income<br />

earned by individuals. The<br />

discount will apply to interest<br />

income earned from a variety of<br />

sources such as bank deposits<br />

and bonds, both directly and<br />

indirectly (eg through a trust).<br />

There is no suggestion that the<br />

amount of interest income to<br />

which this measure will apply<br />

is to be a net amount; that is,<br />

after offset of interest expenses<br />

incurred. This measure will<br />

provide a tax incentive to earn at<br />

least a certain amount of interest<br />

income from approved sources.<br />

If such interest is earned in a<br />

family trust it should be possible<br />

to ensure that a number of<br />

family members benefit from the<br />

50 per cent tax discount.<br />

Standard tax deduction<br />

From <strong>July</strong> 1 2012 individuals<br />

will be able to elect to claim a<br />

standard tax deduction of $500<br />

(increasing to $1,000 from<br />

<strong>July</strong> 1 2013) for work related<br />

expenses and costs of managing<br />

their tax affairs. If this election<br />

is made there will be no need<br />

to substantiate the deduction.<br />

However, if one’s actual<br />

deductions are greater than the<br />

standard amount, the greater<br />

amount can be claimed instead.<br />

This will greatly simplify tax<br />

return preparation for many<br />

individuals and leads the way<br />

towards a system where it may<br />

not be necessary to lodge very<br />

simple tax returns. Although the<br />

Government is not suggesting<br />

that this will be the case yet. The<br />

budget also confirmed: personal<br />

income tax rates previously<br />

legislated for 2010 – 2011 will<br />

not be changed; from <strong>July</strong> 1 2010<br />

the low income tax offset is<br />

increased to $1,500, effectively<br />

increasing the personal tax free<br />

threshold to $16,000; and from<br />

<strong>July</strong> 1 2010 the medical<br />

expenses rebate threshold will<br />

increase to $2,000.<br />

Small businesses<br />

The main changes for small<br />

business include:<br />

Company tax rate reduction<br />

It appears that the reduction<br />

in the company tax rate from<br />

30 per cent to 28 per cent from<br />

<strong>July</strong> 1 2012 will apply to small<br />

businesses as currently defined;<br />

that is, companies with an<br />

annual turnover (including the<br />

turnover of associates) of less<br />

than $2m. For other companies,<br />

the tax rate reduction will be<br />

phased in from <strong>July</strong> 1 2013<br />

to <strong>July</strong> 1 2014. As there is no<br />

suggestion that the maximum<br />

personal rate will be reduced, it<br />

will result in further planning<br />

for privately owned businesses<br />

to limit the effective tax rate<br />

on business income to the 28<br />

per cent rate. In the coming<br />

financial year (2010 – 2011) it<br />

will also result in such businesses<br />

considering ways to optimise the<br />

use of franking account balances<br />

and means by which income can<br />

be legitimately deferred to the<br />

following year.<br />

Asset write-offs<br />

From <strong>July</strong> 1 2012 the proposed<br />

simplification and acceleration<br />

“Broadly, the proposal is to treat all<br />

consideration on sale of a business,<br />

including earn-outs, as attributable to<br />

the business itself. ”<br />

of capital expenditure write-offs<br />

for small businesses will provide<br />

administrative and tax benefits.<br />

Small businesses will be able<br />

to immediately write off assets<br />

valued under $5,000 and will be<br />

able to write off all other assets<br />

(except buildings) in a single<br />

depreciation pool at a 30 per<br />

cent rate. This will do away with<br />

the need for them to maintain<br />

detailed depreciation schedules,<br />

at least for tax purposes.<br />

CGT on earn-outs<br />

Clarification of the CGT<br />

treatment of earn-out payments<br />

on business sales is welcome as<br />

it removes doubt surrounding<br />

this area of tax law in a manner<br />

favourable to business owners.<br />

It means that business owners<br />

can structure the sale of their<br />

business in a commercially<br />

realistic way without adverse<br />

CGT consequences. Broadly,<br />

the proposal is to treat all<br />

consideration on sale of a<br />

business, including earn-outs,<br />

as attributable to the business<br />

itself. This means that all of<br />

the consideration, including<br />

earnouts, may qualify for the<br />

CGT 50 per cent discount and<br />

also the small business CGT<br />

Collision Industry I-CAR Information Evening<br />

The <strong>MTA</strong> with the support<br />

of Stillwell Ford and<br />

Sikkens Automotive Refinish<br />

presented an information<br />

evening for the collision<br />

repairers, featuring keynote<br />

speaker Richard Pratt CEO of<br />

I-CAR Australia.<br />

Over 30 members attended<br />

the evening that also featured<br />

speakers from Sikkens Auto<br />

Refinish and 3M Australia.<br />

Stephen Read from Sikkens<br />

Automotive Refinish gave<br />

members an up-to-date picture<br />

of the refinishing market<br />

world-wide and new products<br />

being released by Sikkens.<br />

These products already meet the<br />

tough environmental standards<br />

required in Europe and many<br />

other markets around the world.<br />

These environmental<br />

requirements will of course be<br />

introduced into Australia over<br />

the next 1-2 years. With that<br />

in mind Sikkens have chosen<br />

to introduce their water-based<br />

products into the Australian<br />

market now.<br />

Ian Hodson from 3M Australia<br />

provided members with a<br />

rundown of sanding materials,<br />

including their composition and<br />

details of their different grades<br />

and abilities, while also advising<br />

on the best way to achieve the<br />

best finish.<br />

Members then broke for food<br />

and refreshments with a fantastic<br />

spread put on by the great guys<br />

at Stillwell Ford. After the break<br />

keynote speaker Richard Pratt<br />

presented members with an<br />

incite into the industry current<br />

and future.<br />

Richard Pratt’s address was<br />

outstanding giving members a<br />

look into what will be a massive<br />

learning curve for the industry.<br />

The presentation featured the<br />

change from mild strength steel<br />

to ultra high strength steels from<br />

the late 90s to current day.<br />

Mr Pratt presented a dilemma<br />

for repairers, with the question<br />

being asked ‘what car has what<br />

steel and where?’. As featured<br />

on the night the current Corolla<br />

and Camry are constructed<br />

completely differently and the<br />

use of different strength steels<br />

in different areas of the vehicle,<br />

which surprised many attending<br />

the evening.<br />
