Break Open Tickets<br />

Definition<br />

“Break Open Tickets are instant win lottery tickets commonly<br />

known as pull tab, Nevada or Pocket Slots tickets”.<br />

1. For first time applicants the<br />

application for Eligibility is<br />

required.<br />

2. Obtain application package<br />

from the municipal <strong>of</strong>fice<br />

3. Complete application and<br />

return to the municipal <strong>of</strong>fice<br />

with the following documents:<br />

License fee (3% X prizes<br />

X No. <strong>of</strong> deals)<br />

A copy <strong>of</strong> the Break Open<br />

Ticket Seller registration, if<br />

applicable<br />

An agreement to lease/<br />

rent/maintain or purchase<br />

a Break Open Ticket dispenser,<br />

if applicable<br />

The system for keeping<br />

track <strong>of</strong> sales and inventory<br />

A list <strong>of</strong> the bona fide<br />

members assisting with the<br />

Break Open Ticket administration<br />

and sale<br />

Application Checklist<br />

Make sure all sections <strong>of</strong> application are complete<br />

paying special attention to the following:<br />

<br />

Enclose updated third party location registration<br />

(issued by the AGCO yearly) or application to<br />

renew<br />

Complete Section 6 a) ticket type (i.e. SP21) as<br />

well as “total number <strong>of</strong> deals” to be approved<br />

Fill in the start date/end date (Maximum length<br />

<strong>of</strong> license: 5 years) License deemed complete<br />

when all tickets sold.<br />

Application must be signed by two (2) principal<br />

<strong>of</strong>ficers from the organization<br />

“ B reak Open Ticket Licenses may be issued for<br />

a maximum <strong>of</strong> five years. After the expiry date<br />

partially sold deals <strong>of</strong> break open tickets may be<br />

carried over to a new license. Unopened deals<br />

cannot be carried over.

The following documents must be submitted<br />

by the charitable organization to<br />

the municipality each year:<br />

Current membership list<br />

Minutes from last general meeting<br />

Police clearances/criminal record<br />

checks for key <strong>of</strong>ficers if requested<br />

Letters Patent/Letters <strong>of</strong> Incorporation,<br />

by-laws and constitution<br />

Current year-end financial statement<br />

Reporting<br />

Requirements<br />

Organizations are required to submit the<br />

Break Open Ticket Report to the <strong>Municipality</strong><br />

within 30 calendar days from the<br />

completion <strong>of</strong> the license (when all tickets<br />

sold or expiry date on license) and must<br />

include the following documents:<br />

Copy <strong>of</strong> all deposit slips for boxes sold<br />

Copy <strong>of</strong> all invoices<br />

Copy <strong>of</strong> all receipts<br />

Copy <strong>of</strong> bank statements and cancelled<br />

cheques for the entire period <strong>of</strong> the<br />

license<br />

Interim Reports are required annually for<br />

licenses that are issued for more than one<br />

year to a maximum <strong>of</strong> five years.<br />

Please bring these documents to the<br />

Clerk’s Office following the organization’s<br />

Annual Meeting or at the time an<br />

application is submitted. Letters may be<br />

sent from the <strong>Municipality</strong> entitled<br />

“Annual Review”.<br />

Are you ready for a Break-Open Ticket Inspection?<br />

To ensure compliance with the AGCO Break Open Ticket License Terms and Conditions<br />

the Municipal By-law Inspector may perform a site inspection. Here’s a Check list to ensure<br />

compliance:<br />

Current Gaming Control Act Registration is posted (visible to the public)<br />

Current Municipal License issued to the licensee is posted (visible to the public)<br />

Ensure customers open tickets at time <strong>of</strong> purchase on the premises, and exchange all<br />

winning tickets for cash on the day <strong>of</strong> the sale<br />

Signage is posed stating all players must be 18 years <strong>of</strong> or older to play<br />

Signage is posted stating winning tickets must be cashed on the day <strong>of</strong> sale<br />

The container is able to accommodate at least one and one half boxes (1 1/2) <strong>of</strong> tickets<br />

The following information is printed on the ticket:<br />

License number (same as the posted lottery license number)<br />

Name or abbreviated name <strong>of</strong> Licensee<br />

Price <strong>of</strong> ticket<br />

Name <strong>of</strong> manufacturer<br />

Serial number <strong>of</strong> ticket<br />

Make sure customers do not remove tickets from the box themselves<br />

Ensure attendant defaces all winning tickets<br />

Ensure staff does not buy Break-Open tickets<br />

Ensure staff do not display number <strong>of</strong> unsold winning tickets remaining in the container<br />

Failure to abide by the Terms & Conditions<br />

By completing and signing a lottery license application, the Principal Officers <strong>of</strong> the<br />

organization are, on behalf <strong>of</strong> the organization agreeing that the Terms and Conditions<br />

under which a lottery license is issued will be followed. Failure to abide by the Terms<br />

and Conditions is cause for the denial <strong>of</strong> future applications, cancellation or suspension<br />

<strong>of</strong> licenses and may result in civil liability for the criminal prosecution <strong>of</strong> the Principal<br />

Officer, Designated Member in Charge and the organization by the Province.<br />

This guide briefly explains some <strong>of</strong> the rules relating to<br />

Break Open Tickets lottery licensing.<br />

Applicants should refer to the Terms and Conditions that<br />

govern each type <strong>of</strong> lottery license which is available at the<br />

Clerk’s Department or from the Alcohol and Gaming<br />

Commission <strong>of</strong> Ontario web site. (see below)<br />

procedures municipal and provincial<br />

<strong>of</strong>ficials must follow to<br />

issue charitable gaming licenses<br />

in Ontario. Each type <strong>of</strong> licensed<br />

lottery is governed by a<br />

specific set <strong>of</strong> rules known as<br />

terms and conditions.<br />

Sec. 206 makes it an indictable <strong>of</strong>fence to participate in a lottery scheme<br />

Sec. 207 (1) (a) provides an exemption to 206 to allow provincial governments to conduct<br />

and manage lottery schemes<br />

Sec. 207 (1) (b) exempts charitable and religious organizations to allow them to conduct and<br />

manage lottery schemes<br />

Sec. 207 (a) (b) allows delegation <strong>of</strong> licensing authority by Lieutenant Governor-in-Council<br />

Order-in-Council 2688/93 delegates licensing authority to the Registrar <strong>of</strong> the AGCO and<br />

municipal councils
