THE CONTRACT IS FOR THE SUPPLY, APPLICATION AND COMPACTION OF HL4<br />

ASPHALT.<br />

*Please note that items 1, 2 and 3 will be prepared by the Municipality. The<br />

successful contractor must notify the Municipality two (2) full working days prior<br />

to commencement of work.<br />

Hot Mix <strong>Asphalt</strong>:<br />

Prior to commencing construction, the contactor shall submit to the Municipality a mix<br />

design containing test results <strong>for</strong> Gradation, Marshall Stability, Marshall Flow, % Voids,<br />

and % VMA, all con<strong>for</strong>ming to OPSS 1150.<br />

The asphalt cement used shall be PG 58-28.<br />

HL4 will contain 5.3% A.C. minimum.<br />

Up to 25% recycled hot-mix will be allowed.<br />

All traffic control shall be the responsibility of the contractor.<br />

The contractor shall take four (4) samples total of HL4 at a time and location as<br />

determined by the Roads Foreman. The Municipality will deliver these samples to<br />

Naylor Engineering Ltd., of Kitchener, <strong>for</strong> extraction testing. This provision will be paid<br />

<strong>for</strong> by the Municipality of North Perth.<br />

Pulverization:<br />

The contractor shall schedule his operations such that placement of asphalt will take<br />

place no later than ten (10) business days following pulverization. Failure to do so shall<br />

result in a deduction of Five Hundred Dollars ($500.00) per business day from the total<br />

contract value payable to the contractor.<br />

Where existing asphalt thicknesses are greater than 150mm, an adjustment to the unit<br />

price may be negotiated. Measurement <strong>for</strong> payment will be by the square metre.<br />

Full Depth Removal<br />

The work under this section shall include the full depth removal of existing asphalt in<br />

section 5 and 10 in Scope of Work to a maximum depth of 70mm. Disposal of material<br />

at an off-site location arranged and paid <strong>for</strong> by the contractor.<br />

Measurement <strong>for</strong> payment will be by the square metre.<br />

Placement Method:<br />

Paving shall be done in a continuous manner as much as possible. The Contractor<br />

shall provide the Municipality with the method of surface asphalt handling to minimize<br />

asphalt segregation and cold longitudinal joints. No end dumping from trucks to the<br />

spreader will be allowed. A material transfer vehicle shall be used to transfer surface<br />

asphalt from the trucks to the spreader.<br />

Payment Adjustment <strong>for</strong> changes in the MTO AC Price Index:<br />

North Perth will adjust the payment to the Contractor based on changes to the Ministry<br />

of Transportation’s per<strong>for</strong>mance graded asphalt cement price index unless the<br />

Contractor opts out by notifying in writing within five business days of the award of the<br />

contract. Once the contractor has opted out of payment adjustments based on the<br />

index, the Contractor will not be permitted to opt back in. The price index will be<br />

published monthly in the MTO Contract Bulletin and displayed on the OHMPA<br />

(www.ohmpa.org) and MTO website (www.raqs.mto.gov.on.ca). The price index will be<br />

used to calculate the amount of the payment adjustment per tonne of asphalt cement<br />

accepted into the Work.<br />

The price index will be based on the price, excluding taxes, FOB the depots in the<br />

Toronto area, of asphalt cement grade PG 58-28 or equivalent. One index will be used<br />

to establish and calculate the payment adjustment <strong>for</strong> all grades. As of July 2006 the<br />

price index <strong>for</strong> each month will reflect the average of the same month’s prices and be<br />

published on the last day of the month and be retroactively applied to HMA laid in the<br />

same month.<br />

A payment adjustment per tonne of asphalt cement will be established <strong>for</strong> each month<br />

in which paving occurs when the price index <strong>for</strong> the month differs by more than<br />

$15.00/tonne from the AC price index <strong>for</strong> the month prior to quotation opening. When<br />

the price index differential is less than $15.00/tonne, there will be no payment<br />

adjustment <strong>for</strong> that month. Payment adjustments due to changes in the price index are<br />

independent of any other payment adjustments made to hot mix quotation items.<br />

Provincial sales tax adjustment should be applied to the adjustment (either way).<br />

The payment adjustment per tonne will apply to the quantity of asphalt cement in the<br />

hot mix accepted into the Work during the month <strong>for</strong> which it is established. The<br />

payment adjustment <strong>for</strong> the month will be calculated by the following means:<br />

1 When AC Prices are Rising by more than a $15.00/tonne: the payment<br />

adjustment to be paid to the Contractor is the result of subtracting the price index <strong>for</strong> the<br />

month prior to when opening from the price index in effect when paving takes place,<br />

minus the $15.00 float, multiplied by the number of tonnes of PGAC incorporated in the<br />

mix(s) as determined by the job mix <strong>for</strong>mula. HST on the adjustment will be included.<br />

2 When AC Prices are Falling by more than $15.00/tonne: the payment<br />

adjustment made in favour of the Owner is the result of subtracting the price index in<br />

effect when paving takes place, plus the $15.00 float from the price index <strong>for</strong> the month<br />

prior to the quotation opening, multiplied by the number of tonnes of PGAC incorporated<br />

in the mix(s) as determined by the job mix <strong>for</strong>mula. HST on the adjustment will be<br />

included.<br />

The quantity of new asphalt cement includes all grades of asphalt cement supplied<br />

by the Contractor with and without polymer modifiers. For each month in which a<br />

payment adjustment has been established, the quantity of the escalation/deescalation<br />

will be calculated using the hot mix quantity accepted into the Work and its<br />

corresponding asphalt cement content as required by the job mix <strong>for</strong>mula.<br />

For mixes which contain reclaimed asphalt pavement, the increase due the contractor<br />

or the rebate due the owner will be calculated as if virgin hot mix asphalt has been<br />

supplied. This fairly reflects the increasing value of the Contractor’s RAP pile when AC<br />

prices are increasing and the opposite when they are declining.<br />

Notes:<br />

1. Contractors should bid the hot mix asphalt item using the MTO PGAC pricing<br />

available at the time of quotation closing. The AC Price Index is only a tool <strong>for</strong><br />

qualifying hot mix prices and is not intended as a standard AC price to be<br />

incorporated into the contract bid.<br />

2. The payment adjustment calculated using this <strong>for</strong>mula is full compensation <strong>for</strong><br />

any and all PGAC grades specified. If the AC index has not changed more than<br />

$15.00 per tonne up or down, no adjustment is required. Only the amount of the<br />

change that is greater than $15.00 is used to calculate payment adjustments.<br />

3. Beginning with the AC Index <strong>for</strong> July 2006 MTO will amend their past practice of<br />

establishing the monthly index amount on the 1stday of the month from the<br />

average of the four weekly AC prices received in the previous month to a<br />

calculation that takes in the average of the four weeks of the current month and<br />

is subsequently published on the last day of that month.<br />

4. As the result of the implementation of Note #4 and the subsequent issue of MTO<br />

SP 103S20 the AC Price index <strong>for</strong> the month prior to quotation opening will be<br />

used as the AC bid price to calculate AC adjustments.<br />

CERTIFICATE OF INSURANCE REQUEST<br />

The Municipality of North Perth will require a Certificate of Liability Insurance from you<br />

with this quotation. It must be issued by your insurer or on a standard CSIO <strong>for</strong>m and<br />

signed by an Authorized Representative.<br />

In this certificate, the Municipality will require the following:<br />

1. Your full name and address with contact name & phone number<br />

2. Description of your Business Operation<br />

3. Commercial General Liability with a limit no less than $2,000,000.00<br />

4. Tenants Legal Liability, Cross Liability, Notice of Cancellation (30 Days)<br />

5. The Municipality is to be added and shown as an Additional Insured under<br />

Liability.<br />

6. If a licensed motorized vehicle is being used, we require Confirmation of<br />

Automobile Liability Insurance or Commercial Automobile Liability with a limit no<br />

less than $2,000,000.00.<br />

Workplace Safety Insurance Board Coverage<br />

The Municipality of North Perth will require a current WSIB Clearance Certificate with<br />

this quotation.<br />

Accessibility <strong>for</strong> Ontarians with Disabilities Requirements:<br />

Prior to the commencement of any work under this contract, the successful bidder will<br />

also be required to provide Accessible Customer Service Training to all staff working on<br />

behalf of the Municipality of North Perth in compliance with the requirements of the<br />

Accessibility <strong>for</strong> Customer Service Regulation 429/07, Section 6. The Municipality of<br />

North Perth will offer assistance with appropriate training resources if required.<br />

Health and Safety:<br />

The Municipality will expect the successful bidder to abide by all provincial regulations<br />

regarding health and safety, as well as licensing and certification.<br />

The Municipality of North Perth has a Contractor Health and Safety Package that will<br />

need to be completed by the successful bidder, prior to the start of work, which includes<br />

the submission of the contractors Health and Safety Policy or the agreement to abide by<br />

the Municipality of North Perth’s policies.<br />

GENERAL CONDITIONS<br />

Regulations<br />

The Contractor shall abide by all Acts, By-laws and Regulations relative to the<br />

per<strong>for</strong>mance of the work.<br />

Completion<br />

October 18, <strong>2013</strong>.<br />

Work Limitations<br />

Please note that no work will be permitted at any time where the 24 hour weather<br />

<strong>for</strong>ecast by Environment Canada predicts temperatures of less than 4 degrees Celsius.<br />

Warranty<br />

The contractor shall warranty the work <strong>for</strong> 24 months. All repairs due to deficiencies in<br />

product or workmanship shall be at no cost to the Municipality of North Perth.<br />
