FOREWORD<br />

The Australian Safety <strong>and</strong> Compensati<strong>on</strong> Council (ASCC) leads <strong>and</strong> coord<strong>in</strong>ates nati<strong>on</strong>al efforts to prevent<br />

workplace death, <strong>in</strong>jury <strong>and</strong> disease <strong>in</strong> Australia <strong>and</strong> to improve occupati<strong>on</strong>al health <strong>and</strong> safety (OHS),<br />

workers’ compensati<strong>on</strong> arrangements <strong>and</strong> return to work of <strong>in</strong>jured employees.<br />

The Nati<strong>on</strong>al OHS Strategy 2002-2012 (Nati<strong>on</strong>al Strategy), which was endorsed by the Workplace<br />

Relati<strong>on</strong>s M<strong>in</strong>isters’ Council <strong>on</strong> 24 May 2002, records a commitment by all Australian, state <strong>and</strong> territory<br />

governments, the Australian Chamber of Commerce <strong>and</strong> Industry (ACCI) <strong>and</strong> the Australian Council of<br />

Trade Uni<strong>on</strong>s (ACTU) to share the resp<strong>on</strong>sibility of ensur<strong>in</strong>g that Australia’s performance <strong>in</strong> work-related<br />

health <strong>and</strong> safety is c<strong>on</strong>t<strong>in</strong>uously improved.<br />

The Nati<strong>on</strong>al Strategy sets out five nati<strong>on</strong>al priorities to achieve short-term <strong>and</strong> l<strong>on</strong>g-term improvements.<br />

The priorities are to:<br />

1. Reduce high <strong>in</strong>cidence/severity risks<br />

2. Improve the capacity of bus<strong>in</strong>ess operators <strong>and</strong> workers to manage OHS effectively<br />

3. Prevent occupati<strong>on</strong>al disease more effectively<br />

4. Elim<strong>in</strong>ate hazards at the design stage, <strong>and</strong><br />

5. Strengthen the capacity of government to <strong>in</strong>fluence OHS outcomes.<br />

<str<strong>on</strong>g>Guidance</str<strong>on</strong>g> <strong>on</strong> OHS <strong>in</strong> Government Procurement has been developed to support Priority 5 of the Nati<strong>on</strong>al<br />

Strategy which focuses <strong>on</strong> strengthen<strong>in</strong>g the capacity of government to <strong>in</strong>fluence OHS outcomes. As<br />

governments are major purchasers of goods <strong>and</strong> services, <strong>and</strong> as such can <strong>in</strong>fluence safety outcomes<br />

through their procurement arrangements, they have the potential to decrease the number of workplace<br />

<strong>in</strong>juries <strong>and</strong> fatalities.<br />

The model, tools <strong>and</strong> <strong>in</strong>formati<strong>on</strong> offered <strong>in</strong> this guide aim to encourage governments <strong>and</strong> suppliers to<br />

<strong>in</strong>corporate OHS <strong>and</strong> safe design c<strong>on</strong>siderati<strong>on</strong>s <strong>in</strong>to their procurement policies <strong>and</strong> practices. They were<br />

developed <strong>in</strong> c<strong>on</strong>sultati<strong>on</strong> with Comcare <strong>and</strong> the Department of F<strong>in</strong>ance <strong>and</strong> Adm<strong>in</strong>istrati<strong>on</strong>.<br />

The pr<strong>in</strong>ciples of elim<strong>in</strong>at<strong>in</strong>g hazards at the design stage (safe design) are an important c<strong>on</strong>siderati<strong>on</strong><br />

where design is part of a procurement. For the period 1 July 2000 to 30 June 2002 a m<strong>in</strong>imum of <strong>on</strong>e <strong>in</strong><br />

four workplace fatalities were related to poor design . Priority 4 of the Nati<strong>on</strong>al Strategy aims to promote<br />

health <strong>and</strong> safety at the source by elim<strong>in</strong>at<strong>in</strong>g hazards at the design stage, which <strong>in</strong>volves designers,<br />

manufacturers, c<strong>on</strong>structors <strong>and</strong> suppliers. Procurement decisi<strong>on</strong>s need to c<strong>on</strong>sider the safe design<br />

of products, systems <strong>and</strong> build<strong>in</strong>gs so that potential hazards can be elim<strong>in</strong>ated before they enter the<br />

workplace.<br />

If governments, at all levels, <strong>in</strong>tegrate OHS requirements <strong>in</strong>to all stages of the procurement process,<br />

suppliers will need to dem<strong>on</strong>strate their ability to meet these requirements.<br />

Build<strong>in</strong>g <strong>and</strong> C<strong>on</strong>structi<strong>on</strong><br />

As a major procurer of build<strong>in</strong>g <strong>and</strong> c<strong>on</strong>structi<strong>on</strong> services, the Australian Government is committed to<br />

work<strong>in</strong>g with the build<strong>in</strong>g <strong>and</strong> c<strong>on</strong>structi<strong>on</strong> <strong>in</strong>dustry to improve its OHS performance.<br />

In procur<strong>in</strong>g build<strong>in</strong>g <strong>and</strong> c<strong>on</strong>structi<strong>on</strong> services, agencies are subject to the specific requirements of the<br />

Federal Safety Commissi<strong>on</strong>er (FSC), as def<strong>in</strong>ed <strong>in</strong> the Build<strong>in</strong>g <strong>and</strong> C<strong>on</strong>structi<strong>on</strong> Industry Improvement<br />

Act 2005. This <strong>in</strong>cludes meet<strong>in</strong>g obligati<strong>on</strong>s under the Australian Government Build<strong>in</strong>g <strong>and</strong> C<strong>on</strong>structi<strong>on</strong><br />

OHS Accreditati<strong>on</strong> Scheme.<br />

The FSC is also <strong>in</strong>volved <strong>in</strong> a number of <strong>in</strong>itiatives <strong>in</strong> the build<strong>in</strong>g <strong>and</strong> c<strong>on</strong>structi<strong>on</strong> <strong>in</strong>dustry. For more<br />

WHY IS OHS IN PROCUREMENT IMPORTANT?<br />

Governments are major employers, policy makers, regulators <strong>and</strong> purchasers of equipment <strong>and</strong> services.<br />

They have a leadership role <strong>in</strong> prevent<strong>in</strong>g work-related death, <strong>in</strong>jury <strong>and</strong> disease <strong>in</strong> Australia through<br />

promot<strong>in</strong>g, legislat<strong>in</strong>g <strong>and</strong> enforc<strong>in</strong>g OHS requirements through a wide range of mechanisms.<br />

An emphasis <strong>on</strong> OHS obligati<strong>on</strong>s encourages suppliers to take resp<strong>on</strong>sibility for underst<strong>and</strong><strong>in</strong>g the<br />

requirements of a client <strong>and</strong> for ensur<strong>in</strong>g that what they provide is safe for users. Therefore, effective<br />

government procurement practice will go some way towards achiev<strong>in</strong>g improvements <strong>in</strong> workplace <strong>in</strong>juries<br />

<strong>and</strong> fatalities.<br />

This document presents three aspects of the c<strong>on</strong>siderati<strong>on</strong>s needed to <strong>in</strong>tegrate OHS <strong>in</strong>to procurement:<br />

Pr<strong>in</strong>ciples – the reas<strong>on</strong>s for c<strong>on</strong>sider<strong>in</strong>g OHS <strong>in</strong> procurement<br />

Processes – the steps to take <strong>in</strong> order to c<strong>on</strong>sider OHS when procur<strong>in</strong>g (better practice model), <strong>and</strong><br />

Applicati<strong>on</strong>s – specific tools that could be used as part of the process (Appendices).<br />

PRINCIPLES<br />

Pr<strong>in</strong>ciple 1: C<strong>on</strong>siderati<strong>on</strong> of OHS is <strong>in</strong>herent <strong>in</strong> the Comm<strong>on</strong>wealth Procurement Guidel<strong>in</strong>es (January<br />

2005) – seek<strong>in</strong>g value for m<strong>on</strong>ey<br />

The Comm<strong>on</strong>wealth Procurement Guidel<strong>in</strong>es describe procurement as encompass<strong>in</strong>g,<br />

“…the whole process of acquir<strong>in</strong>g property <strong>and</strong> services. It beg<strong>in</strong>s when an agency has identified a<br />

need <strong>and</strong> decided <strong>on</strong> its procurement requirement. Procurement c<strong>on</strong>t<strong>in</strong>ues through the processes of<br />

risk assessment, seek<strong>in</strong>g <strong>and</strong> evaluat<strong>in</strong>g alternative soluti<strong>on</strong>s, c<strong>on</strong>tract award, delivery of <strong>and</strong> payment<br />

for property or services <strong>and</strong>, where relevant, the <strong>on</strong>go<strong>in</strong>g management of a c<strong>on</strong>tract <strong>and</strong> c<strong>on</strong>siderati<strong>on</strong><br />

of opti<strong>on</strong>s related to the c<strong>on</strong>tract. An <strong>in</strong>tegral part of the procurement cycle is the <strong>on</strong>go<strong>in</strong>g m<strong>on</strong>itor<strong>in</strong>g<br />

<strong>and</strong> assessment of the procurement, <strong>in</strong>clud<strong>in</strong>g the property or services procured <strong>and</strong> the tasks related to<br />

procurement”.<br />

The core pr<strong>in</strong>ciple underly<strong>in</strong>g the Comm<strong>on</strong>wealth Procurement Guidel<strong>in</strong>es is value for m<strong>on</strong>ey. Value<br />

for m<strong>on</strong>ey does not mean that cheapest is best. In a procurement process this pr<strong>in</strong>ciple requires a<br />

comparative analysis of all relevant costs <strong>and</strong> benefits of each proposal throughout the whole procurement<br />

cycle (whole-of-life cost<strong>in</strong>g) <strong>in</strong>clud<strong>in</strong>g those associated with OHS.<br />

The forward-look<strong>in</strong>g approach of the Comm<strong>on</strong>wealth Procurement Guidel<strong>in</strong>es supports the safe design<br />

c<strong>on</strong>cept <strong>in</strong>herent <strong>in</strong> this publicati<strong>on</strong>. Safe design requires ‘look<strong>in</strong>g forward’ <strong>in</strong> order to c<strong>on</strong>sider hazards<br />

through the life of the item, as well as ‘look<strong>in</strong>g back’ to reveal past experiences that might <strong>in</strong>form current<br />

decisi<strong>on</strong> mak<strong>in</strong>g.<br />

This document is to be read <strong>in</strong> c<strong>on</strong>juncti<strong>on</strong> with the Comm<strong>on</strong>wealth Procurement Guidel<strong>in</strong>es, agencyspecific<br />

<strong>in</strong>structi<strong>on</strong>s <strong>and</strong> relevant OHS legislati<strong>on</strong>, regulati<strong>on</strong>s <strong>and</strong> codes of practice. In some agencies,<br />

the primary reference for those undertak<strong>in</strong>g procurement is the chief executive <strong>in</strong>structi<strong>on</strong>s, which<br />

should have been <strong>in</strong>formed by, <strong>and</strong> give effect to, the Comm<strong>on</strong>wealth Procurement Guidel<strong>in</strong>es <strong>and</strong> this<br />

document.<br />

Pr<strong>in</strong>ciple 2: Governments are required to provide leadership <strong>in</strong> OHS because of their commitment to the<br />

Nati<strong>on</strong>al Strategy (<strong>in</strong> particular Priority 5)<br />

The aim of this pr<strong>in</strong>ciple is that governments should secure better OHS outcomes <strong>and</strong> be exemplars of<br />

good practice through a range of approaches <strong>in</strong>clud<strong>in</strong>g:<br />

c<strong>on</strong>t<strong>in</strong>ual improvement <strong>in</strong> governments’ OHS performance as employers<br />

whole-of-government approaches that ensure OHS implicati<strong>on</strong>s are c<strong>on</strong>sidered <strong>and</strong> accounted for <strong>in</strong><br />

the work of government<br />

government <strong>in</strong>fluence of better practice OHS requirements made of the supply cha<strong>in</strong><br />

practical guidance <strong>on</strong> measur<strong>in</strong>g <strong>and</strong> report<strong>in</strong>g OHS outcomes for public sector agencies, <strong>and</strong><br />

c<strong>on</strong>t<strong>in</strong>ual improvement <strong>in</strong> governments’ performance as OHS policy makers <strong>and</strong> regulators.<br />

The term property is used throughout the Comm<strong>on</strong>wealth Procurement Guidel<strong>in</strong>es to refer to “every type of right, <strong>in</strong>terest or th<strong>in</strong>g which<br />

is legally capable of be<strong>in</strong>g owned. This <strong>in</strong>cludes, but is not restricted to, physical goods <strong>and</strong> real property as well as <strong>in</strong>tangibles such as<br />

<strong>in</strong>tellectual property, c<strong>on</strong>tract opti<strong>on</strong>s <strong>and</strong> goodwill”.<br />

Pr<strong>in</strong>ciple 3: As employers, governments are required to provide a safe work envir<strong>on</strong>ment <strong>and</strong> therefore must<br />

be diligent <strong>in</strong> c<strong>on</strong>sider<strong>in</strong>g employee safety when undertak<strong>in</strong>g a procurement<br />

Under OHS legislati<strong>on</strong> employers have a duty of care to protect the health <strong>and</strong> safety of their employees at<br />

work. Specific rights <strong>and</strong> duties flow from the duty of care. These could <strong>in</strong>clude:<br />

provid<strong>in</strong>g <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g safe plant <strong>and</strong> systems of work<br />

safe systems of work <strong>in</strong> c<strong>on</strong>necti<strong>on</strong> with plant <strong>and</strong> substances<br />

a safe work<strong>in</strong>g envir<strong>on</strong>ment <strong>and</strong> adequate welfare facilities (such as first aid rooms)<br />

<strong>in</strong>form<strong>in</strong>g <strong>and</strong> <strong>in</strong>struct<strong>in</strong>g <strong>on</strong> workplace hazards <strong>and</strong> supervis<strong>in</strong>g employees <strong>in</strong> safe work<br />

m<strong>on</strong>itor<strong>in</strong>g the health of employees <strong>and</strong> related record keep<strong>in</strong>g<br />

employ<strong>in</strong>g qualified pers<strong>on</strong>s to provide health <strong>and</strong> safety advice<br />

nom<strong>in</strong>at<strong>in</strong>g a senior employer representative, <strong>and</strong><br />

m<strong>on</strong>itor<strong>in</strong>g c<strong>on</strong>diti<strong>on</strong>s at any workplace under their c<strong>on</strong>trol <strong>and</strong> management.<br />

It is important when procur<strong>in</strong>g goods <strong>and</strong> services that government agencies exercise due diligence <strong>in</strong><br />

attempt<strong>in</strong>g to meet their health <strong>and</strong> safety obligati<strong>on</strong>s.<br />

PROCESSES<br />

The Office of the Australian Safety <strong>and</strong> Compensati<strong>on</strong> Council (Office of the ASCC) has developed this<br />

model of better practice OHS <strong>in</strong> procurement after c<strong>on</strong>siderati<strong>on</strong> <strong>and</strong> analysis of nati<strong>on</strong>al <strong>and</strong> <strong>in</strong>ternati<strong>on</strong>al<br />

literature <strong>and</strong> discussi<strong>on</strong> regard<strong>in</strong>g procurement practices with a number of organisati<strong>on</strong>s. It outl<strong>in</strong>es the<br />

comm<strong>on</strong>ly accepted stages of procurement <strong>and</strong>, with<strong>in</strong> each stage, a number of OHS issues that need<br />

to be c<strong>on</strong>sidered. Tools have been identified that will assist those <strong>in</strong>volved <strong>in</strong> procurement to deal with<br />

the OHS issues identified. These tools are listed <strong>in</strong> the OHS <strong>in</strong> procurement model <strong>and</strong> are <strong>in</strong>cluded as<br />

appendices with<strong>in</strong> this publicati<strong>on</strong>.<br />

STEP 1: Plann<strong>in</strong>g<br />

Plann<strong>in</strong>g can improve the effectiveness <strong>and</strong> efficiency of procurement. It requires agencies to be<br />

discipl<strong>in</strong>ed, as well as plan <strong>and</strong> properly manage the procurement of products <strong>and</strong> services. The effort<br />

expended <strong>in</strong> the plann<strong>in</strong>g stage will ensure the best possible outcomes <strong>and</strong> should be c<strong>on</strong>sistent with the<br />

Risk management<br />

Procurement should not <strong>in</strong>troduce any risks to the health <strong>and</strong> safety of employees <strong>and</strong> third parties.<br />

Effective risk management lets agencies proactively identify <strong>and</strong> manage risks, opportunities <strong>and</strong> issues<br />

aris<strong>in</strong>g out of procurement.<br />

The risk management strategies adopted to support procurement decisi<strong>on</strong>s should <strong>in</strong>corporate the<br />

assessment <strong>and</strong> management of identified OHS <strong>and</strong> safe design risks. Identify<strong>in</strong>g potential OHS risks<br />

early <strong>and</strong> select<strong>in</strong>g the best opti<strong>on</strong> for manag<strong>in</strong>g those risks assists <strong>in</strong> achiev<strong>in</strong>g more favourable <strong>and</strong><br />

reliable outcomes. It is important to note that each procurement requires its own risk assessment that is<br />

aligned with its own c<strong>on</strong>text. A guide <strong>on</strong> OHS risk management is provided at Appendix 2.<br />

The outcomes of any risk assessment <strong>and</strong> recommended risk treatment opti<strong>on</strong>s should be documented<br />

<strong>and</strong> adequate measures address<strong>in</strong>g identified issues need to be <strong>in</strong>corporated <strong>in</strong>to the tender documents.<br />

Safe design<br />

The design stage is critical to reduc<strong>in</strong>g OHS risk for procurement with specific design requirements. Such<br />

procurement should <strong>in</strong>volve identify<strong>in</strong>g <strong>and</strong> remov<strong>in</strong>g potential safety problems at this po<strong>in</strong>t to prevent<br />

<strong>in</strong>troduc<strong>in</strong>g them <strong>in</strong>to the workplace. The safe design process can elim<strong>in</strong>ate OHS hazards, or reduce<br />

potential OHS risk, by <strong>in</strong>volv<strong>in</strong>g decisi<strong>on</strong> makers <strong>and</strong> c<strong>on</strong>sider<strong>in</strong>g risks throughout the life of the designed<br />

product.<br />

Safe design is a process def<strong>in</strong>ed as:<br />

“the <strong>in</strong>tegrati<strong>on</strong> of hazard identificati<strong>on</strong> <strong>and</strong> risk assessment methods early <strong>in</strong> the design process<br />

to elim<strong>in</strong>ate or m<strong>in</strong>imise the risks of <strong>in</strong>jury throughout the life of the product be<strong>in</strong>g designed. It<br />

encompasses all design <strong>in</strong>clud<strong>in</strong>g facilities, hardware, systems, equipment, products, tool<strong>in</strong>g,<br />

materials, energy c<strong>on</strong>trols, layout, <strong>and</strong> c<strong>on</strong>figurati<strong>on</strong> ”.<br />

Costs associated with unsafe design can be significant (examples <strong>in</strong>clude retrofitt<strong>in</strong>g, workers’<br />

compensati<strong>on</strong> premiums, envir<strong>on</strong>mental clean up costs, public liability). Key factors to c<strong>on</strong>sider <strong>in</strong> relati<strong>on</strong><br />

to design <strong>and</strong> procurement are:<br />

recognis<strong>in</strong>g LIFE CYCLE costs dur<strong>in</strong>g the procurement of products <strong>and</strong> services. Good practice<br />

clients will use best value throughout the life of the product or service, <strong>in</strong> preference to lower <strong>in</strong>itial<br />

cost. This means ensur<strong>in</strong>g that health <strong>and</strong> safety is <strong>in</strong>tegrated <strong>in</strong>to the design phase, as well as <strong>in</strong>to<br />

manufactur<strong>in</strong>g/c<strong>on</strong>structi<strong>on</strong>, <strong>in</strong>stallati<strong>on</strong>, operati<strong>on</strong>, ma<strong>in</strong>tenance <strong>and</strong> disposal<br />

pre-tender<strong>in</strong>g CONSULTATION <strong>and</strong> brief<strong>in</strong>gs<br />

design process. If it is not possible to elim<strong>in</strong>ate the hazard, the designer should reduce the risk to the<br />

lowest level possible <strong>and</strong> provide <strong>in</strong>formati<strong>on</strong> to the client or purchaser <strong>on</strong> the rema<strong>in</strong><strong>in</strong>g or residual<br />

risk <strong>and</strong> the measures required to c<strong>on</strong>trol this risk<br />

ensur<strong>in</strong>g an effective OHS MANAGEMENT SYSTEM is <strong>in</strong> place, which has direct expectati<strong>on</strong>s <strong>and</strong><br />

implicati<strong>on</strong>s for suppliers <strong>and</strong> customers<br />

<strong>in</strong>corporat<strong>in</strong>g safe design requirements <strong>in</strong> SPECIFICATIONS for c<strong>on</strong>tracts <strong>and</strong> tender<strong>in</strong>g/procurement<br />

documents. Tenderers should be required to dem<strong>on</strong>strate that an effective risk management<br />

approach has been used to identify <strong>and</strong> elim<strong>in</strong>ate/c<strong>on</strong>trol OHS risk dur<strong>in</strong>g the design process<br />

reference to appropriate AUSTRALIAN STANDARDS <strong>and</strong> design rules<br />

Establish<strong>in</strong>g a multi-discipl<strong>in</strong>ary team<br />

Depend<strong>in</strong>g <strong>on</strong> the complexity <strong>and</strong> level of risk of the procurement, c<strong>on</strong>sider establish<strong>in</strong>g a multi-discipl<strong>in</strong>ary<br />

team compris<strong>in</strong>g subject matter experts (such as technical, procurement or OHS experts). For high risk<br />

<strong>and</strong> complex procurements, establish<strong>in</strong>g a multi-discipl<strong>in</strong>ary team at the plann<strong>in</strong>g stage, <strong>and</strong> <strong>in</strong>volv<strong>in</strong>g<br />

them <strong>in</strong> the other stages of the procurement process, will assist <strong>in</strong> facilitat<strong>in</strong>g a favourable outcome.<br />

STEP 2: Prepar<strong>in</strong>g to approach the market<br />

Each procurement is unique <strong>and</strong> no s<strong>in</strong>gle method suits all situati<strong>on</strong>s. Government procurement policies<br />

require the method chosen to be assessed <strong>on</strong> its merits <strong>and</strong> represent value for m<strong>on</strong>ey. The method<br />

chosen should also provide an equal opportunity to all suppliers who want to tender for government<br />

bus<strong>in</strong>ess.<br />

Select a procurement method<br />

The selecti<strong>on</strong> of the procurement method is generally based <strong>on</strong> the complexity <strong>and</strong> value of the purchase.<br />

Procurement can be described as:<br />

Simple – <strong>in</strong>cludes most purchases aga<strong>in</strong>st st<strong>and</strong><strong>in</strong>g offers <strong>and</strong> low value, off-the-shelf items.<br />

Purchas<strong>in</strong>g <strong>in</strong> this category is essentially rout<strong>in</strong>e <strong>and</strong> requires <strong>on</strong>ly basic decisi<strong>on</strong>s <strong>on</strong> simple<br />

processes<br />

Involved – <strong>in</strong>cludes many services <strong>and</strong> higher value purchases. Purchases <strong>in</strong> this category require<br />

a more comprehensive underst<strong>and</strong><strong>in</strong>g of the c<strong>on</strong>cept of open <strong>and</strong> effective competiti<strong>on</strong> <strong>and</strong> more<br />

formal procurement processes, <strong>and</strong><br />

Complex – <strong>in</strong>cludes large c<strong>on</strong>sultancies, some capital equipment <strong>and</strong> establish<strong>in</strong>g st<strong>and</strong><strong>in</strong>g offers. At<br />

this level open <strong>and</strong> effective competiti<strong>on</strong> is expected to be applied.<br />

Under the Comm<strong>on</strong>wealth Procurement Guidel<strong>in</strong>es, the tender processes available for covered<br />

procurements (valued at $80,000 or more) are limited to:<br />

Regardless of the procurement method used, OHS <strong>and</strong> safe design c<strong>on</strong>siderati<strong>on</strong>s should be part of the<br />

selecti<strong>on</strong> process. The extent of such c<strong>on</strong>siderati<strong>on</strong>s would depend <strong>on</strong> the level of risk identified as a<br />

result of a risk assessment (provided at Appendix 2). Some OHS issues that may be c<strong>on</strong>sidered <strong>in</strong>clude:<br />

brief<strong>in</strong>g, <strong>and</strong><br />

determ<strong>in</strong><strong>in</strong>g the need to undertake site visits <strong>and</strong> obta<strong>in</strong> OHS references.<br />

When undertak<strong>in</strong>g simple procurement <strong>in</strong>volv<strong>in</strong>g an off-the-shelf product, an OHS risk assessment<br />

should be undertaken to ensure that the procurement does not <strong>in</strong>troduce hazards <strong>in</strong>to the workplace. A<br />

procurement checklist for use for medium/high risk off-the-shelf procurement is provided at Appendix 3.<br />

Prepare tender <strong>and</strong> c<strong>on</strong>tract documents<br />

Agencies undertak<strong>in</strong>g procurement through a tender process need to be satisfied that OHS risks identified<br />

dur<strong>in</strong>g steps 1 <strong>and</strong> 2 above are appropriately managed dur<strong>in</strong>g the procurement process. This will ensure<br />

that the potential supplier of the product or service clearly underst<strong>and</strong>s the technical requirements as well<br />

as the OHS <strong>and</strong> safe design issues associated with those requirements. It will also ensure that the most<br />

suitable supplier is selected <strong>and</strong> that the product or service be<strong>in</strong>g procured will not <strong>on</strong>ly be delivered <strong>in</strong> a<br />

complete <strong>and</strong> technically competent way but also that it will not create or <strong>in</strong>crease risks to the health <strong>and</strong><br />

safety of employees or others.<br />

Agencies should be prepared to give suppliers, particularly small bus<strong>in</strong>ess operators, the necessary help,<br />

coach<strong>in</strong>g <strong>and</strong> support required to raise their level of underst<strong>and</strong><strong>in</strong>g of OHS management. Where it is<br />

<strong>in</strong>tended that support will be provided, details should be <strong>in</strong>cluded <strong>in</strong> the request documentati<strong>on</strong>.<br />

Def<strong>in</strong>e tender <strong>and</strong> c<strong>on</strong>tract specificati<strong>on</strong><br />

OHS requirements <strong>and</strong> details of hazards identified dur<strong>in</strong>g the risk assessment process should be<br />

<strong>in</strong>cluded <strong>in</strong> tender documents. OHS requirements should also be <strong>in</strong>cluded as c<strong>on</strong>diti<strong>on</strong>s of the c<strong>on</strong>tract.<br />

These need to cater to the purpose, the k<strong>in</strong>d of risks <strong>in</strong>volved <strong>and</strong> the characteristics of the supplier.<br />

Government suppliers may range from large <strong>in</strong>ternati<strong>on</strong>al organisati<strong>on</strong>s to sole traders. C<strong>on</strong>tract <strong>in</strong>clusi<strong>on</strong>s<br />

may cover <strong>on</strong>e or more of the follow<strong>in</strong>g c<strong>on</strong>diti<strong>on</strong>s:<br />

procedures.<br />

When collect<strong>in</strong>g <strong>in</strong>formati<strong>on</strong>, the agency must adhere to the Informati<strong>on</strong> Privacy Pr<strong>in</strong>ciples under the<br />

Privacy Act 1988.<br />

High risk c<strong>on</strong>tracts – m<strong>in</strong>imum requirements<br />

For high risk c<strong>on</strong>tracts, established at Step 1 of the OHS <strong>in</strong> procurement model, the tender <strong>and</strong> c<strong>on</strong>tract<br />

should require the supplier to provide evidence of their OHS management system. An example of a<br />

questi<strong>on</strong>naire list<strong>in</strong>g the <strong>in</strong>formati<strong>on</strong> to be provided by tenderers is at Appendix 5.<br />

The supplier should also be required to develop a health <strong>and</strong> safety plan before work commences. The<br />

health <strong>and</strong> safety plan should outl<strong>in</strong>e how the c<strong>on</strong>tractor will manage occupati<strong>on</strong>al health <strong>and</strong> safety<br />

for the term of the c<strong>on</strong>tract. The health <strong>and</strong> safety plan must cover specific OHS issues relevant to the<br />

c<strong>on</strong>tracted work <strong>and</strong> document the systems <strong>and</strong> methods that will be used to effectively manage OHS<br />

risks. Further <strong>in</strong>formati<strong>on</strong> <strong>on</strong> health <strong>and</strong> safety plans is at Appendix 6.<br />

The health <strong>and</strong> safety plan should <strong>in</strong>clude a risk assessment <strong>and</strong> safe work procedures. A risk<br />

Medium risk c<strong>on</strong>tract – m<strong>in</strong>imum requirements<br />

For medium risk c<strong>on</strong>tracts, established at Step 1, the tender <strong>and</strong> c<strong>on</strong>tract should require the supplier to<br />

develop a health <strong>and</strong> safety plan before commenc<strong>in</strong>g the work. The health <strong>and</strong> safety plan should <strong>in</strong>clude<br />

a risk assessment <strong>and</strong> safe work procedures.<br />

Low risk c<strong>on</strong>tracts – m<strong>in</strong>imum requirements<br />

For low risk c<strong>on</strong>tracts, the supplier should be required, as a m<strong>in</strong>imum, to undertake a risk assessment<br />

<strong>and</strong> develop a safe work procedure before commenc<strong>in</strong>g work.<br />

For small, short-term, low-risk c<strong>on</strong>tracts, compliance with OHS legislati<strong>on</strong> <strong>and</strong> the client’s OHS policy <strong>and</strong><br />

procedures may be the <strong>on</strong>ly requirement specified <strong>in</strong> the tender specificati<strong>on</strong>s <strong>and</strong> c<strong>on</strong>tract.<br />

The follow<strong>in</strong>g diagram provides guidance <strong>on</strong> the requirements that may be sought from potential<br />

suppliers for procurements where the level of risk has been identified as high, medium <strong>and</strong> low.<br />

The tender request documents would normally <strong>in</strong>clude c<strong>on</strong>diti<strong>on</strong>s for participati<strong>on</strong>. C<strong>on</strong>diti<strong>on</strong>s for<br />

participati<strong>on</strong> are basic requirements aga<strong>in</strong>st which potential suppliers must be able to dem<strong>on</strong>strate<br />

compliance <strong>in</strong> order to participate <strong>in</strong> a tender. OHS <strong>and</strong> safe design c<strong>on</strong>siderati<strong>on</strong>s that were identified<br />

dur<strong>in</strong>g the risk management process (refer to page 15) should form part of the c<strong>on</strong>diti<strong>on</strong>s for<br />

participati<strong>on</strong>, that must be satisfied for the submissi<strong>on</strong> to receive further c<strong>on</strong>siderati<strong>on</strong>. If a c<strong>on</strong>diti<strong>on</strong><br />

for participati<strong>on</strong> is not satisfied, the tenderer’s submissi<strong>on</strong> can receive no further c<strong>on</strong>siderati<strong>on</strong>. Where<br />

compliance will be assessed aga<strong>in</strong>st requirements, they may be better suited to evaluati<strong>on</strong> criteria <strong>in</strong><br />

lieu of c<strong>on</strong>diti<strong>on</strong>s for participati<strong>on</strong>. Informati<strong>on</strong> <strong>on</strong> apply<strong>in</strong>g weight<strong>in</strong>gs to tender evaluati<strong>on</strong> criteria is at<br />

Appendix 9.<br />

Where the tender process provides for a tender brief<strong>in</strong>g, OHS issues identified as part of the risk<br />

management process should be highlighted.<br />

STEP 3: Evaluat<strong>in</strong>g submissi<strong>on</strong>s<br />

The tender evaluati<strong>on</strong> process requires agencies to assess tenderers’ submissi<strong>on</strong>s aga<strong>in</strong>st the request<br />

documentati<strong>on</strong> requirements. Pay particular attenti<strong>on</strong> to evaluat<strong>in</strong>g the tenderer’s capacity to comply<br />

with specific OHS <strong>and</strong> safe design requirements identified dur<strong>in</strong>g the plann<strong>in</strong>g <strong>and</strong> associated risk<br />

management stage. This must have been expressed as either c<strong>on</strong>diti<strong>on</strong>s for participati<strong>on</strong> or evaluati<strong>on</strong><br />

criteria.<br />

As part of the evaluati<strong>on</strong> process, agencies should:<br />

exam<strong>in</strong>e the tenderer’s OHS management system – policies, procedures, programs, safe work<br />

procedures, tra<strong>in</strong><strong>in</strong>g/competency records, procedures for management of sub-c<strong>on</strong>tractor<br />

verify the operati<strong>on</strong> of the tenderer’s OHS management system. This may <strong>in</strong>clude evidence of third<br />

party certificati<strong>on</strong> <strong>and</strong> exam<strong>in</strong>ati<strong>on</strong> of the tenderer’s records with regard to audits, <strong>in</strong>specti<strong>on</strong>s, plant<br />

records or accidents<br />

notices, <strong>and</strong><br />

c<strong>on</strong>duct pre-award meet<strong>in</strong>gs where a tenderer is required to produce further evidence <strong>and</strong>/or to<br />

c<strong>on</strong>firm their underst<strong>and</strong><strong>in</strong>g of c<strong>on</strong>tract OHS requirements, specific OHS issues related to the<br />

c<strong>on</strong>tract <strong>and</strong> their ability to resp<strong>on</strong>d accord<strong>in</strong>gly.<br />

Agencies should c<strong>on</strong>sider the need to give advice <strong>and</strong> assistance to tenderers <strong>on</strong> how to document their<br />

OHS management system <strong>and</strong> present it <strong>in</strong> the tender.<br />

STEP 4: C<strong>on</strong>tract negotiati<strong>on</strong> <strong>and</strong> award<br />

The OHS c<strong>on</strong>siderati<strong>on</strong>s when award<strong>in</strong>g a c<strong>on</strong>tract depend significantly <strong>on</strong> the type of c<strong>on</strong>tract. For<br />

<strong>in</strong>stance very different measures would be needed for a c<strong>on</strong>tract for labour sourced from a labour hire<br />

organisati<strong>on</strong>, a c<strong>on</strong>tract for the supply of motor vehicles or ma<strong>in</strong>tenance <strong>and</strong> clean<strong>in</strong>g c<strong>on</strong>tract. Some<br />

examples of the acti<strong>on</strong>s that might be appropriate for some c<strong>on</strong>tracts of service might be to:<br />

develop a shared underst<strong>and</strong><strong>in</strong>g about the safety issues associated with the project<br />

provide to the supplier, where the supplier will work with an agency, <strong>in</strong>formati<strong>on</strong> about the hazards to<br />

which the supplier might be exposed <strong>and</strong> jo<strong>in</strong>tly review the hazards<br />

jo<strong>in</strong>tly review selected supplier’s safe work procedures (for low risk c<strong>on</strong>tracts) <strong>and</strong> project specific<br />

health <strong>and</strong> safety plan (for medium/high risk c<strong>on</strong>tracts)<br />

jo<strong>in</strong>tly identify how the supplier will work together with the agency <strong>on</strong> OHS issues. This might <strong>in</strong>volve<br />

align<strong>in</strong>g methods for <strong>in</strong>cident report<strong>in</strong>g, jo<strong>in</strong>t audit<strong>in</strong>g/hazard identificati<strong>on</strong> or arrang<strong>in</strong>g jo<strong>in</strong>t safety<br />

committee meet<strong>in</strong>gs, <strong>and</strong><br />

provide tools to suppliers such as risk assessment worksheets, safe work procedure templates <strong>and</strong><br />

pro-forma for report<strong>in</strong>g <strong>and</strong> record<strong>in</strong>g activities.<br />

STEP 5: C<strong>on</strong>tract management<br />

The purpose of c<strong>on</strong>tract management is to ensure that the supplier is adher<strong>in</strong>g to the terms of the<br />

c<strong>on</strong>tract <strong>and</strong> provid<strong>in</strong>g the requested services/products that meet the needs of the project. Agencies must<br />

also m<strong>on</strong>itor the supplier’s OHS performance to ensure that OHS duties <strong>and</strong> resp<strong>on</strong>sibilities are met for<br />

the durati<strong>on</strong> of the c<strong>on</strong>tract.<br />

C<strong>on</strong>tract m<strong>on</strong>itor<strong>in</strong>g <strong>and</strong> supervisi<strong>on</strong><br />

M<strong>on</strong>itor<strong>in</strong>g <strong>and</strong> supervis<strong>in</strong>g the c<strong>on</strong>tract will ensure that the supplier’s operati<strong>on</strong>s are c<strong>on</strong>ducted <strong>in</strong><br />

accordance with:<br />

health <strong>and</strong> safety legislati<strong>on</strong>, st<strong>and</strong>ards <strong>and</strong> codes of practice<br />

health <strong>and</strong> safety requirements outl<strong>in</strong>ed <strong>in</strong> c<strong>on</strong>tract documents, <strong>and</strong><br />

c<strong>on</strong>tract-specific health <strong>and</strong> safety requirements as detailed <strong>in</strong> the risk assessment, health <strong>and</strong> safety<br />

plan <strong>and</strong> safe work procedure prepared by the supplier.<br />

In order to do this, the supplier must have:<br />

to the c<strong>on</strong>tract, <strong>and</strong><br />

access to relevant documents such as risk assessments, the health <strong>and</strong> safety plan, <strong>and</strong> additi<strong>on</strong>al<br />

OHS resources <strong>and</strong> expertise with<strong>in</strong> or external to the agency as required.<br />

The extent to which an agency should m<strong>on</strong>itor <strong>and</strong> supervise suppliers will be <strong>in</strong>fluenced by several<br />

factors, such as the:<br />

type of hazards <strong>and</strong> the level of risk<br />

nature <strong>and</strong> complexity of the work to be carried out<br />

level of c<strong>on</strong>trol that all parties have<br />

size <strong>and</strong> management systems of the organisati<strong>on</strong><br />

number of workplaces at which the c<strong>on</strong>tract will be performed<br />

number of subc<strong>on</strong>tractors <strong>in</strong>volved, <strong>and</strong><br />

c<strong>on</strong>sultative <strong>and</strong> report<strong>in</strong>g mechanisms that are <strong>in</strong> place.<br />

Supervisi<strong>on</strong> may need to be higher <strong>in</strong> special circumstances, such as if target<strong>in</strong>g specific key events<br />

dur<strong>in</strong>g a c<strong>on</strong>tract. For example:<br />

ensur<strong>in</strong>g that suitable systems <strong>and</strong> procedures are <strong>in</strong> place <strong>and</strong> the workplace is appropriately<br />

established at c<strong>on</strong>tract start-up<br />

m<strong>on</strong>itor<strong>in</strong>g c<strong>on</strong>formance with safe work procedures <strong>and</strong> risk assessment c<strong>on</strong>trol measures with high<br />

risk or complex activities<br />

review<strong>in</strong>g coord<strong>in</strong>ati<strong>on</strong> <strong>and</strong> notificati<strong>on</strong> systems operat<strong>in</strong>g at the workplace where there is a high level<br />

of <strong>in</strong>teracti<strong>on</strong> with other parties, <strong>and</strong><br />

undertak<strong>in</strong>g separate risk assessment <strong>and</strong> m<strong>on</strong>itor<strong>in</strong>g c<strong>on</strong>trol procedures may be required when<br />

<strong>in</strong>troduc<strong>in</strong>g new plant, equipment or systems of work.<br />

M<strong>on</strong>itor<strong>in</strong>g activities for complex <strong>and</strong> medium/high risk c<strong>on</strong>tracts<br />

Effective m<strong>on</strong>itor<strong>in</strong>g activities, particularly for complex <strong>and</strong> medium/high risk c<strong>on</strong>tracts, may <strong>in</strong>clude:<br />

<strong>in</strong>ducti<strong>on</strong> <strong>and</strong> tra<strong>in</strong><strong>in</strong>g of suppliers <strong>and</strong> their employees <strong>on</strong> commencement, with refreshers for l<strong>on</strong>gterm<br />

c<strong>on</strong>tracts <strong>and</strong> project or site-specific tra<strong>in</strong><strong>in</strong>g, if required. As a guide, an <strong>in</strong>ducti<strong>on</strong> checklist is<br />

<strong>in</strong>spect<strong>in</strong>g licences <strong>and</strong> permits that are required for the type of work to be carried out<br />

<strong>in</strong>spect<strong>in</strong>g plant <strong>and</strong> equipment associated with the licences<br />

regular <strong>in</strong>ternal <strong>and</strong>/or external audits of the supplier’s OHS management system dur<strong>in</strong>g the life of<br />

the c<strong>on</strong>tract (provid<strong>in</strong>g proof of implementati<strong>on</strong>, <strong>in</strong>clud<strong>in</strong>g site <strong>in</strong>specti<strong>on</strong>s to m<strong>on</strong>itor the supplier’s<br />

compliance with health <strong>and</strong> safety procedures, their health <strong>and</strong> safety plan <strong>and</strong> legislati<strong>on</strong>)<br />

agenda item) <strong>and</strong> at supplier meet<strong>in</strong>gs (to improve project OHS coord<strong>in</strong>ati<strong>on</strong> <strong>and</strong> problem solv<strong>in</strong>g)<br />

review<strong>in</strong>g the supplier’s OHS performance, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong>cident <strong>and</strong> accident records <strong>and</strong> regular<br />

reports (such as m<strong>on</strong>thly reports) from suppliers <strong>on</strong> safety performance. An example of a m<strong>on</strong>thly<br />

OHS performance report template is provided at Appendix 11<br />

provid<strong>in</strong>g feedback to suppliers <strong>on</strong> their OHS performance<br />

enforc<strong>in</strong>g n<strong>on</strong>-compliance <strong>and</strong> n<strong>on</strong>-c<strong>on</strong>formance. For example, withhold<strong>in</strong>g payment until the<br />

required acti<strong>on</strong> is taken<br />

periodic review <strong>and</strong> updat<strong>in</strong>g of the supplier’s OHS plan <strong>and</strong> targets, <strong>and</strong><br />

provid<strong>in</strong>g regular reports to senior management <strong>on</strong> OHS performance of suppliers as well as their<br />

employees.<br />

STEP 6: Term<strong>in</strong>ati<strong>on</strong>/transiti<strong>on</strong><br />

Term<strong>in</strong>ati<strong>on</strong><br />

At term<strong>in</strong>ati<strong>on</strong> of the c<strong>on</strong>tract the agency should ensure that:<br />

all OHS issues have been dealt with <strong>and</strong> there are no outst<strong>and</strong><strong>in</strong>g corrective acti<strong>on</strong>s or n<strong>on</strong>c<strong>on</strong>formances<br />

all commissi<strong>on</strong><strong>in</strong>g requirements have been implemented<br />

OHS issues that may arise after h<strong>and</strong>over have been c<strong>on</strong>sidered, <strong>and</strong><br />

employees who may require tra<strong>in</strong><strong>in</strong>g have been identified <strong>and</strong>, where required by the c<strong>on</strong>tract,<br />

given this tra<strong>in</strong><strong>in</strong>g.<br />

Transiti<strong>on</strong><br />

The transiti<strong>on</strong> stage of a c<strong>on</strong>tract may <strong>in</strong>volve matters such as asset transfer, <strong>on</strong>go<strong>in</strong>g ma<strong>in</strong>tenance<br />

<strong>and</strong> service commitments by the outgo<strong>in</strong>g supplier <strong>and</strong> the possible <strong>in</strong>troducti<strong>on</strong> of a new supplier. For<br />

<strong>in</strong>stance, <strong>in</strong> the case of a build<strong>in</strong>g, it is important to pass <strong>on</strong> ma<strong>in</strong>tenance manuals, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong>formati<strong>on</strong><br />

about lift ma<strong>in</strong>tenance, build<strong>in</strong>g ma<strong>in</strong>tenance units, hazards identified <strong>and</strong> resolved or safe work<br />

procedures which have been developed or modified. In some cases the transiti<strong>on</strong> stage may entail a<br />

period of parallel operati<strong>on</strong>s of old <strong>and</strong> new systems or suppliers. Carefully c<strong>on</strong>sider matters that may be<br />

<strong>in</strong>volved dur<strong>in</strong>g this stage with particular emphasis <strong>on</strong> identify<strong>in</strong>g <strong>and</strong> assess<strong>in</strong>g OHS risks <strong>and</strong> how these<br />

will be managed.<br />

It may be appropriate to develop a transiti<strong>on</strong> plan dur<strong>in</strong>g the plann<strong>in</strong>g stage of the procurement process.<br />

A transiti<strong>on</strong> plan would c<strong>on</strong>sider OHS issues <strong>and</strong> how these will be managed dur<strong>in</strong>g transiti<strong>on</strong> operati<strong>on</strong>s<br />

from an exist<strong>in</strong>g system (if any) to a new system <strong>in</strong> a manner that does not create a health <strong>and</strong> safety risk.<br />

Where applicable, the plan should outl<strong>in</strong>e OHS requirements that apply when a supplier will be expected<br />

to transiti<strong>on</strong> to a new supplier. The plan should emphasise the need to keep proper records <strong>and</strong> reta<strong>in</strong><br />

this material.<br />

Disposal<br />

Disposal may not always form part of the procurement process. However, it is very important to c<strong>on</strong>sider it<br />

because procurement extends to the ultimate disposal of property at the end of its useful life. Prior to any<br />

disposal acti<strong>on</strong>, undertake an OHS risk assessment (provided at Appendix 2) <strong>and</strong> develop a disposal plan<br />

for medium/high risk disposals. A typical plan should provide <strong>in</strong>formati<strong>on</strong> <strong>on</strong> how identified OHS issues<br />

will be managed.<br />

STEP 7: C<strong>on</strong>tract evaluati<strong>on</strong><br />

It is good practice to evaluate the procurement process <strong>on</strong>ce a c<strong>on</strong>tract has been completed to identify<br />

weaknesses <strong>and</strong> strengths <strong>in</strong> the procurement process <strong>and</strong> less<strong>on</strong>s that can be applied to other<br />

procurement activities. A review of the safety performance <strong>on</strong> completi<strong>on</strong> of the work, or periodically <strong>in</strong><br />

the case of <strong>on</strong>go<strong>in</strong>g c<strong>on</strong>tracts, may <strong>in</strong>clude:<br />

the level of effectiveness of the c<strong>on</strong>sultati<strong>on</strong> processes<br />

feedback from workers/users/other people as relevant<br />

whether OHS issues were readily resolved<br />

what OHS <strong>and</strong> safe design less<strong>on</strong>s were learned <strong>and</strong> documented, <strong>and</strong><br />

how the plan can be improved.<br />

OHS risk management<br />

An OHS risk assessment that the agency undertakes dur<strong>in</strong>g the plann<strong>in</strong>g stage of the procurement<br />

process will help identify OHS risks early <strong>and</strong> select the best opti<strong>on</strong> for manag<strong>in</strong>g those risks. Each<br />

procurement will require its own risk assessment that is with<strong>in</strong> its own c<strong>on</strong>text.<br />

Hazard identificati<strong>on</strong> (What can go wr<strong>on</strong>g?)<br />

The essence of identify<strong>in</strong>g hazards is to f<strong>in</strong>d potential problems. Hazards can be identified <strong>in</strong> a number of<br />

ways, <strong>in</strong>clud<strong>in</strong>g:<br />

similar activities c<strong>on</strong>ducted by others?<br />

Categoris<strong>in</strong>g <strong>and</strong> rank<strong>in</strong>g – sometimes risks can be categorised <strong>and</strong> ranked. This is sometimes d<strong>on</strong>e<br />

by estimat<strong>in</strong>g the likelihood <strong>and</strong> harmful c<strong>on</strong>sequence of a possible event.<br />

Risk c<strong>on</strong>trol (How can the risk of someth<strong>in</strong>g go<strong>in</strong>g wr<strong>on</strong>g be m<strong>in</strong>imised or elim<strong>in</strong>ated?)<br />

Risk c<strong>on</strong>trol should be achieved us<strong>in</strong>g the most effective practicable soluti<strong>on</strong>. Sources of practicable<br />

Hierarchy of c<strong>on</strong>trol – An important model for th<strong>in</strong>k<strong>in</strong>g of soluti<strong>on</strong>s is the hierarchy of c<strong>on</strong>trol. This<br />

model is often present <strong>in</strong> OHS regulati<strong>on</strong>s throughout Australia. The hierarchy of c<strong>on</strong>trol is a creative<br />

th<strong>in</strong>k<strong>in</strong>g tool. It relies <strong>on</strong> good hazard identificati<strong>on</strong>. In apply<strong>in</strong>g the hierarchy, the first step is to<br />

ask how the hazard could be elim<strong>in</strong>ated. If it is not possible to elim<strong>in</strong>ate the hazard then a similar<br />

questi<strong>on</strong> is asked for each succeed<strong>in</strong>g item down the hierarchy list. The term<strong>in</strong>ology of the hierarchy<br />

A practical step is to c<strong>on</strong>sider the life cycle <strong>and</strong> employ the hierarchy of c<strong>on</strong>trol.<br />

The photographs below show air c<strong>on</strong>diti<strong>on</strong><strong>in</strong>g <strong>in</strong>stallati<strong>on</strong>s <strong>in</strong> two public build<strong>in</strong>gs. To avoid extra lengths<br />

of refrigerant pip<strong>in</strong>g it may be c<strong>on</strong>venient to place equipment at height. Th<strong>in</strong>k<strong>in</strong>g about the life span of<br />

a procurement should identify the need for ma<strong>in</strong>tenance. The <strong>in</strong>stallati<strong>on</strong> <strong>on</strong> the left will require access,<br />

probably with a ladder, hence creat<strong>in</strong>g the risk of a fall <strong>and</strong> very awkward manual h<strong>and</strong>l<strong>in</strong>g at heights <strong>in</strong><br />

both <strong>in</strong>itial <strong>in</strong>stallati<strong>on</strong> <strong>and</strong> subsequent ma<strong>in</strong>tenance.<br />

Elim<strong>in</strong>at<strong>in</strong>g the hazard is the first stage <strong>in</strong> the hierarchy of c<strong>on</strong>trol <strong>and</strong> the preferred choice. In the case of<br />

a fall, the hazard is the requirement for the ma<strong>in</strong>tenance pers<strong>on</strong> to work above the ground. This hazard<br />

can be elim<strong>in</strong>ated <strong>in</strong> some cases, as shown <strong>in</strong> the photo <strong>on</strong> the right.<br />

The manual h<strong>and</strong>l<strong>in</strong>g that might be <strong>in</strong>volved <strong>in</strong> the ma<strong>in</strong>tenance is not elim<strong>in</strong>ated by the adaptati<strong>on</strong> <strong>on</strong><br />

the right. However, it is m<strong>in</strong>imised by avoid<strong>in</strong>g the need to work at height, for example by plac<strong>in</strong>g the units<br />

<strong>in</strong> a place where they can be accessed from the ground or design<strong>in</strong>g a system that can be accessed with<br />

APPENDIX 4<br />

OHS c<strong>on</strong>tract clauses for c<strong>on</strong>tracts for services <br />

Safe Design – Model c<strong>on</strong>tract clause<br />

It is important to <strong>in</strong>corporate an appropriate clause <strong>in</strong> the tender <strong>and</strong> c<strong>on</strong>tract which requires risk<br />

management, <strong>and</strong> more specifically, to cover whole of life OHS risks at the design stage. An example of a<br />

model clause enabl<strong>in</strong>g flexible modificati<strong>on</strong>s, depend<strong>in</strong>g <strong>on</strong> the nature of the service or supply, is:<br />

“The [tenderer] shall detail <strong>in</strong> the design documentati<strong>on</strong> the identificati<strong>on</strong> <strong>and</strong> assessment<br />

of whole of life occupati<strong>on</strong>al health <strong>and</strong> safety (OHS) risks (such as those related to<br />

the c<strong>on</strong>structi<strong>on</strong>/manufacture, <strong>in</strong>stallati<strong>on</strong>, commissi<strong>on</strong><strong>in</strong>g, operati<strong>on</strong>, ma<strong>in</strong>tenance,<br />

decommissi<strong>on</strong><strong>in</strong>g <strong>and</strong> demoliti<strong>on</strong>/removal) <strong>and</strong> the methods used to elim<strong>in</strong>ate <strong>and</strong>/or<br />

OHS specificati<strong>on</strong> <strong>and</strong> tender document requirements – Model c<strong>on</strong>tract clauses <br />

The follow<strong>in</strong>g secti<strong>on</strong> outl<strong>in</strong>es model clauses relat<strong>in</strong>g to OHS requirements which tenderers to be<br />

<strong>in</strong>corporated <strong>in</strong>to specificati<strong>on</strong> <strong>and</strong> tender documents. The requirements should then be specifically<br />

<strong>in</strong>corporated <strong>in</strong>to the c<strong>on</strong>tract. This can be easily achieved by a suitable clause <strong>in</strong> the c<strong>on</strong>tract that<br />

references the OHS specificati<strong>on</strong> requirements.<br />

General OHS requirements<br />

The agency is obligated to provide <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong>, where practicable, a work<strong>in</strong>g envir<strong>on</strong>ment for its<br />

employees <strong>and</strong> members of the public, that is safe <strong>and</strong> without risk to health. As a c<strong>on</strong>diti<strong>on</strong> of this<br />

c<strong>on</strong>tract, the agency requires that any c<strong>on</strong>tractors or subc<strong>on</strong>tractors that may be engaged to perform<br />

a service <strong>on</strong> its behalf will at all times identify <strong>and</strong> exercise all necessary precauti<strong>on</strong>s for the health <strong>and</strong><br />

safety of all pers<strong>on</strong>s <strong>in</strong>clud<strong>in</strong>g c<strong>on</strong>tracted employees, the agency’s employees <strong>and</strong> members of the public<br />

who may be affected by the services. The c<strong>on</strong>tractor will <strong>in</strong>form itself of all occupati<strong>on</strong>al health <strong>and</strong> safety<br />

policies, procedures or measures implemented or adopted by the agency <strong>and</strong>/or the occupiers of any<br />

premises at or with<strong>in</strong> which the c<strong>on</strong>tractor will perform works under this c<strong>on</strong>tract. The c<strong>on</strong>tractor will<br />

comply with all such policies, procedures or measures <strong>and</strong> <strong>in</strong> the event of any <strong>in</strong>c<strong>on</strong>sistency, will comply<br />

with such procedures or measures as they produce the highest level of health <strong>and</strong> safety.<br />

Legislative compliance<br />

The c<strong>on</strong>tractor must comply with <strong>and</strong> ensure that its employees, subc<strong>on</strong>tractors <strong>and</strong> agents comply with<br />

any acts, regulati<strong>on</strong>s, local laws <strong>and</strong> by-laws, codes of practice, Australian St<strong>and</strong>ards <strong>and</strong> the agency’s<br />

OHS policy <strong>and</strong> procedures which are <strong>in</strong> any way applicable to this c<strong>on</strong>tract or the performance of the<br />

services under this c<strong>on</strong>tract.<br />

Note: this provisi<strong>on</strong> simply recites obligati<strong>on</strong>s that are <strong>in</strong>dependently imposed up<strong>on</strong> the party by force of<br />

law, particularly the operati<strong>on</strong> of the relevant general duties provisi<strong>on</strong>s of the govern<strong>in</strong>g OHS statute.<br />

While this secti<strong>on</strong> provides model clauses, they are examples <strong>on</strong>ly <strong>and</strong> will require legal scrut<strong>in</strong>y <strong>in</strong> the c<strong>on</strong>text of specific c<strong>on</strong>tracts.<br />

Risk Assessment<br />

The c<strong>on</strong>tractor shall prepare <strong>and</strong> submit a risk assessment prior to commenc<strong>in</strong>g the works under the<br />

c<strong>on</strong>tract. The risk assessment form shall be used to record the risk assessment <strong>and</strong> risk c<strong>on</strong>trol methods<br />

to be employed by the C<strong>on</strong>tractor. The completed risk assessment shall be submitted to the agency for<br />

review <strong>and</strong> approval prior to commencement of works under the c<strong>on</strong>tract.<br />

Health <strong>and</strong> safety plan<br />

Prior to commenc<strong>in</strong>g the works under the c<strong>on</strong>tract the c<strong>on</strong>tractor shall submit to the agency a health <strong>and</strong><br />

safety plan (provided at Appendix 6) specific to the c<strong>on</strong>tract <strong>and</strong> works. The c<strong>on</strong>tractor shall complete the<br />

health <strong>and</strong> safety plan <strong>in</strong> c<strong>on</strong>formance with requirements set out <strong>in</strong> the agency’s guidel<strong>in</strong>es for prepar<strong>in</strong>g<br />

health <strong>and</strong> safety plans. The health <strong>and</strong> safety plan shall c<strong>on</strong>sider <strong>and</strong> resp<strong>on</strong>d to the specific OHS<br />

hazards <strong>and</strong> issues relevant to the c<strong>on</strong>tract works <strong>and</strong> shall document the systems <strong>and</strong> methods to be<br />

implemented for the term of the c<strong>on</strong>tract. The agency shall review the health <strong>and</strong> safety plan <strong>and</strong> formal<br />

approval to commence the c<strong>on</strong>tract shall be provided subject to acceptance of the health <strong>and</strong> safety plan.<br />

OHS performance report<strong>in</strong>g<br />

The c<strong>on</strong>tractor must, when requested by the agency, provide evidence of <strong>on</strong>go<strong>in</strong>g performance of the<br />

c<strong>on</strong>tractor’s OHS management system. Without limit<strong>in</strong>g the requirements of this obligati<strong>on</strong>, the c<strong>on</strong>tractor<br />

shall provide the follow<strong>in</strong>g <strong>in</strong>formati<strong>on</strong> <strong>on</strong> a m<strong>on</strong>thly basis <strong>in</strong> the form of a c<strong>on</strong>tractor OHS performance<br />

report:<br />

work<strong>in</strong>g days lost due to <strong>in</strong>jury<br />

status of the implementati<strong>on</strong> <strong>and</strong> outcomes of corrective acti<strong>on</strong>s undertaken as a result of OHS<br />

status of OHS management system audits undertaken.<br />

The OHS performance report shall be submitted by the c<strong>on</strong>tactor us<strong>in</strong>g the c<strong>on</strong>tractor m<strong>on</strong>thly OHS<br />

Performance report form (provided at Appendix 11). The c<strong>on</strong>tractor shall, when requested by the agency,<br />

provide reports <strong>on</strong> OHS <strong>in</strong>specti<strong>on</strong>s, audits or assessments undertaken dur<strong>in</strong>g the course of the c<strong>on</strong>tract.<br />

Incident notificati<strong>on</strong><br />

The c<strong>on</strong>tractor must notify the agency with<strong>in</strong> 24 hours of any accident, <strong>in</strong>jury, property or envir<strong>on</strong>mental<br />

damage that occurs dur<strong>in</strong>g the durati<strong>on</strong> of the c<strong>on</strong>tract. All lost time <strong>in</strong>cidents shall be immediately<br />

notified to the agency. The c<strong>on</strong>tractor must provide a report of any such <strong>in</strong>cident with<strong>in</strong> three days,<br />

giv<strong>in</strong>g complete details of the <strong>in</strong>cident, <strong>in</strong>clud<strong>in</strong>g results of <strong>in</strong>vestigati<strong>on</strong>s <strong>in</strong>to its cause, <strong>and</strong> any<br />

recommendati<strong>on</strong>s or strategies for preventi<strong>on</strong> <strong>in</strong> the future. This requirement is <strong>in</strong> additi<strong>on</strong> to, <strong>and</strong><br />

<strong>in</strong>dependent of, any <strong>in</strong>cident notificati<strong>on</strong> duty required by law.<br />

N<strong>on</strong> compliance<br />

If, dur<strong>in</strong>g the performance of works under the c<strong>on</strong>tract, the agency <strong>in</strong>forms the c<strong>on</strong>tractor that it is the<br />

op<strong>in</strong>i<strong>on</strong> of the agency that the c<strong>on</strong>tractor is:<br />

not c<strong>on</strong>duct<strong>in</strong>g the work <strong>in</strong> compliance with the c<strong>on</strong>tractor’s health <strong>and</strong> safety plan, health <strong>and</strong> safety<br />

management system procedures, relevant legislati<strong>on</strong> or health <strong>and</strong> safety procedures provided by the<br />

agency from time to time, or<br />

c<strong>on</strong>duct<strong>in</strong>g the work <strong>in</strong> such a way as to endanger the health <strong>and</strong> safety of c<strong>on</strong>tractors’ employees<br />

or the agency’s or its c<strong>on</strong>tractors’ <strong>and</strong> subc<strong>on</strong>tractors’ employees, plant, equipment or materials, the<br />

c<strong>on</strong>tractor shall remedy that breach of health <strong>and</strong> safety promptly.<br />

The agency may direct the c<strong>on</strong>tractor to suspend the work until such time as the c<strong>on</strong>tractor satisfies the<br />

agency that the work will be resumed <strong>in</strong> c<strong>on</strong>formity with applicable health <strong>and</strong> safety provisi<strong>on</strong>s.<br />

Dur<strong>in</strong>g the periods of suspensi<strong>on</strong> referred to above, the agency shall not be required to make any<br />

payment whatsoever to the c<strong>on</strong>tractor.<br />

If the c<strong>on</strong>tractor fails to rectify any breach of health <strong>and</strong> safety for which the work has been suspended,<br />

or if the c<strong>on</strong>tractor’s performance has <strong>in</strong>volved recurr<strong>in</strong>g breaches of health <strong>and</strong> safety, the agency may,<br />

as its opti<strong>on</strong>, term<strong>in</strong>ate the work forthwith, without further obligati<strong>on</strong> to the c<strong>on</strong>tractor. In this event, the<br />

agency’s liability shall be limited to payment for the work performed <strong>and</strong> costs <strong>in</strong>curred by the c<strong>on</strong>tractor<br />

up to the time of term<strong>in</strong>ati<strong>on</strong> or an earlier suspensi<strong>on</strong> of works.<br />

Subc<strong>on</strong>tract<strong>in</strong>g<br />

Except where a subc<strong>on</strong>tractor is <strong>on</strong>e of the specified pers<strong>on</strong>nel, the c<strong>on</strong>tractor must not, without the prior<br />

written approval of the agency, subc<strong>on</strong>tract the performance of any part of the c<strong>on</strong>sultancy services. In<br />

giv<strong>in</strong>g written approval, the agency may impose such terms <strong>and</strong> c<strong>on</strong>diti<strong>on</strong>s as it th<strong>in</strong>ks fit.<br />

The c<strong>on</strong>tractor will not enter <strong>in</strong>to any subc<strong>on</strong>tract for the purpose of directly or <strong>in</strong>directly fulfill<strong>in</strong>g its<br />

obligati<strong>on</strong>s under this c<strong>on</strong>tract unless such a subc<strong>on</strong>tract obliges the subc<strong>on</strong>tractor to comply with<br />

equivalent provisi<strong>on</strong>s to those c<strong>on</strong>ta<strong>in</strong>ed <strong>in</strong> clause [INSERT clause number(s) with which subc<strong>on</strong>tractor<br />

In high/medium risk c<strong>on</strong>tracts, the successful tenderer should prepare <strong>and</strong> submit a health <strong>and</strong> safety<br />

plan before beg<strong>in</strong>n<strong>in</strong>g the c<strong>on</strong>tracted work. The health <strong>and</strong> safety plan should outl<strong>in</strong>e how the c<strong>on</strong>tractor<br />

be determ<strong>in</strong>ed. Generally, a risk assessment worksheet is compiled. Us<strong>in</strong>g the worksheet, assessments<br />

of c<strong>on</strong>sequence <strong>and</strong> likelihood can be translated <strong>in</strong>to levels of risk. Areas of high risk can be given first<br />

priority for elim<strong>in</strong>ati<strong>on</strong> or c<strong>on</strong>trol <strong>in</strong> the workplace. An example of a risk assessment worksheet is provided<br />

at Appendix 7.<br />

safe work procedures may need to be developed <strong>on</strong> the basis of particular c<strong>on</strong>tract hazards.<br />

Encompasses the whole process of acquir<strong>in</strong>g goods or services<br />

the acquisiti<strong>on</strong> of c<strong>on</strong>sumables (goods), real property, capital<br />

equipment such as computers, built assets such as hospitals,<br />

schools, roads <strong>and</strong> major facilities <strong>and</strong> services such as office<br />
