A Regular Meeting of the Board of Cooperative Educational Services of Albany-Schoharie-Schenectady-
Saratoga Counties, 900 Watervliet-Shaker Road, Suite 102, Albany, New York, was held on September
20, 2010 at the Administrative Offices, Meeting Room. The meeting was called to order by President
Bradt at 6:33 p.m.

It was moved by Dr. Bergeron and seconded by Mrs. Surman to accept the
August 30, 2010 Meeting Minutes. The motion passed unanimously.
Mr. Mark Jones, Assistant District Superintendent for Management Services,
introduced Thomas Cappa of Energy Education who presented BOCES with
the Award for Energy Stewardship which recognized BOCES’ efforts to
implement an innovative people-oriented energy conservation and management
program. Also present and acknowledged for their efforts was Mr. H. Douglas
Harple, BOCES' Energy Education Specialist and Mr. Daniel Haggerty, BOCES'
Superintendent of Buildings and Grounds. Capital Region BOCES is the only
BOCES in New York State working with Energy Education.
Audit Committee - Mr. Phelan (Chair) - Mr. Phelan reported that the committee
met at 5:30 p.m. prior to the start of this Board Meeting. Mr. Jones introduced
Mr. James Cusack and Mr. Terrance Gillooley, Cusack and Co. who presented
an overview of the audit as presented to the Audit Committee. Mr. Cusack
explained that this is the 2 nd year of recording the post employment liability.

There were minor comments noted in the Single Audit relating to Special
Education. BOCES legal counsel provided an updated opinion relating to the
workers compensation reserve noting that BOCES does have the legal authority
to hold this reserve fund. The auditors shared that BOCES is in good general
fiscal health. It is suggested accounting for workers compensation be handled
by a trust in the near future. It was also mentioned that because of our RIC and
the fact that we provide services to over 137 districts that there are cash flow issues
that arise during the year. 2009-10 refunds go out late in the school year but
calculations are complete. It is hopeful that payments can go out earlier (March/April).
Committee Members voiced concerns over submission of travel and asked about
verifying meal reimbursements based on agenda. Mr. Jones and Mr. Bonacquist
shared that staff members are encouraged to submit travel frequently during the
year and also stated that quite a bit of staff time would be involved if every travel
submission was verified with an agenda, etc. Mr. Mattox will be doing a new risk
assessment and it was recommended that the committee discuss with him any
concerns they might have. Mr. Cusack and Mr. Gillooley reassured the committee
that they did not feel there are any major abuses with travel.
Mr. Phelan also shared that the Claims Auditor will be at the October Audit
Committee which will be held in Schoharie at 6:00 p.m. prior to the start of the
October Board Meeting. Mr. Phelan also reported that Mr. John Mattox has been
offered the position as the Internal Auditor and that he will also meet with the
Audit Committee in October.

pertaining to the 2009-10 School Year. The motion passed unanimously.

Policy Advisory Committee - Dr. Bergeron (Chair) - Dr. Bergeron reported the
Policy Advisory Committee will meet in Schoharie at 5:30 p.m. prior to the
start of the October Board Meeting. Policy No. 6770 needs to be updated.
Administration will make the suggested changes and share with the Policy
Committee for their review prior to the October committee meeting.
Legislative Advisory Committee - Mrs. Lenhardt (Chair) - Mrs. Lenhardt shared
that the tax cap is a big issue especially for small school districts. Board
Members were encouraged to voice their concerns with the governmental
officials to make sure they are aware of the impact the tax cap will have
on school districts. School Aid payments will be late and they will also
be reduced.

1. Permission for the Career and Technical Education Division (Adult
Education) to apply for a grant entitled “Manufacturing Skills Standards
Project” in an amount not to exceed $30,000. The purpose of the grant is to
fund a collaborative proposal by Washington-Saratoga-Warren-Hamilton-
Essex and Capital Region BOCES to establish two (2) training sites for
Manufacturing Skills Standards Council (MSSC) adult manufacturing
certification.
2. Permission for the Career and Technical Education Division (Adult
Education) to apply for a grant entitled “2011-2013 Literacy Zone
Initiative: WIA Title II Federal Adult Education and Family
Literacy Act” in the amount of $250,000 yearly. The purpose of the
grant is to develop and initiate services services and programs needed
to establish a Literacy Zone as developed by the New York State Board
of Regents and the State Education Department, with a goal of closing the
achievement gap in urban and rural communities of concentrated poverty
and high concentrations of families and individuals with limited literacy
or English language proficiency.
3. Permission for the Instructional Services Division to apply for a grant
entitled “New York’s Tech Valley Smaller Learning Community 21
Consortium” in the amount of $6,250,000 for five years (October 1,
2010 through September 30, 2015). The purpose of the grant is to radically
change the structure and outcomes of three large area high schools:
Mohonasen Central School District, City School District of Albany and
South Colonie Central School District.

WHEREAS, the Albany-Schoharie-Schenectady-Saratoga Board of
Cooperative Educational Services desires to enhance existing or acquire
additional equipment, products or services, and

work in a specific manner and
WHEREAS, staff has been or will be specially trained in the use of said
equipment, products or services, and use of a single manufacturer’s equipment,
products or services results in services being delivered more efficiently and in
a more cost effective manner, and
WHEREAS, member districts have specifically requested specific
equipment, products or services, and
NOW, THEREFORE, BE IT RESOLVED, that there is a need to
standardize future purchases of equipment, products or services in order to
provide efficiency and economy of operation, and
BE IT FURTHER RESOLVED, that the Albany-Schoharie-
Schenectady-Saratoga Board of Cooperative Educational Services hereby
authorizes to standardize on future purchases of all such equipment, products
or services by limiting such future purchases of equipment, products or
services, and
BE IT FURTHER RESOLVED, that contracts for the purchase of
such standardized equipment products or services be made to the lowest
responsible bidders after advertisement for sealed bids, as provided in
General Municipal Law, Section 103, and

WHEREAS, items which can only be purchased from one source are

the Career and Technical School Albany Campus-Phase I. The roof on buildings

01-90-00-00-0-010-004. BOCES will pay $802,000. The contract period is

3. An agreement between the Albany-Schoharie-Schenectady-Saratoga BOCES
and Compass Company Consultants, LLC, 125 State Street, Suite 3, Albany,
New York 12207. Compass will provide consulting services regarding the
development of a pharmacy RFP and insurance issues. BOCES will pay a
retainer fee of $10,000. The contract period is August 12, 2010 through

4. An agreement between the Albany-Schoharie-Schenectady-Saratoga BOCES
and Access Compliance, LLC, 776A Watervliet-Shaker Road, Latham, New
York 12110. Access Compliance, LLC will assist in the capacity of School
Physician and AED Medical Director. The contract period is July 1, 2010
through June 30, 2011. BOCES will pay an annual fee of $11,748.00. In the
event that BOCES requests the contractor to create a new policy for BOCES,
consideration on a medical topic, or consultation/evaluation, the fee would be

5. An agreement between the Albany-Schoharie-Schenectady-Saratoga BOCES
and Hudson Valley Community College (HVCC), 80 Vandenburgh Avenue,
Troy, New York 12180. HVCC will provide students in five (5) of the BOCES
programs articulated credit toward an A.A.S. degree program. The contract
period is September 1, 2010 through June 30, 2011. There are no fees involved.

and Hudson Valley Community College (HVCC), 80 Vandenburgh Avenue,

Technician (HEAT) curricula into BOCES’ building trades or construction
technology program for the 2010-2011 academic year. The contract period is

12203. The college will provide extended classroom/work based learning

Media Studies Program. The contract period is September 1, 2010 through June

12203. The college will provide collegiate instruction in the area of New

14. Rescission of the following agreement between the Albany-Schoharie-
Schenectady-Saratoga BOCES and Tech Valley Communications, 87 State
Street, Albany, New York 12207, previously approved on August 30, 2010.
Tech Valley will provide 1000 Mbps (Gigabit Ethernet) dedicated access service connecting the
Cairo-Durham High School Campus to the Cairo Elementary School. BOCES will pay $19,080
per year. The contract period is approximately October 1, 2010 through September 30, 2015.
The agreement is based on RFP No. 07-038, which was awarded on January 17, 2008. (2009-

and Time Warner Rescom of New York d/b/a Time Warner Cable, 20

contract is based on RFB 07-038. The original contract was approved on
February 14, 2008. The contract period is approximately September 1, 2010

Treasurer=s Report as submitted. The motion passed unanimously.

budget adjustments/transfers as submitted. The motion passed unanimously.
It was moved by Mr. Phelan and seconded by Mrs. Beloncik to adopt
the 2011-12 Budget Development Calendar. The motion passed
unanimously.
Board Members and the Administration reviewed the proposed resolutions.
Board Members discussed the following:
- Participation at Opening Day which was held at Union College. The
Board asked that Administration thank staff members who assisted in
organizing the day.
- Recent article in the Times Union regarding SAT scores.
- Complementary letter from a parent of a Coxsackie-Athens student who
attended a New Visions Program during the 2009-10 School Year.
- Going away gathering at Questar III on October 7 th from 3:00 - 5:00 p.m.
for Dr. James Baldwin
- Article in the September issues of the American School Board Journal
on the use of assessments
It was moved by Mr. Kutzscher and seconded by Mrs. Lenhardt to enter into
Executive Session at 7:37 p.m. to discuss Matters Pertaining to Collective
Bargaining Unit Negotiations, the Evaluation of the District Superintendent
and to Review Tenure Recommendations. The motion passed unanimously.
