MANAGEMENT OF <strong>OHS</strong><br />

Elements and performance criteria<br />
1. Establish and maintain participative arrangements for the <strong>management</strong> of <strong>OHS</strong>.<br />
1.1 Establish and maintain appropriate participative processes with employees and their<br />
representatives in accordance with relevant <strong>OHS</strong> legislation, regulations and<br />
relevant industry standards consistent with enterprise procedures.<br />
1.2 Deal with and resolve issues raised through participation and consultation promptly<br />
and effectively in accordance with procedures for issues resolution.<br />

As a worker and potential manager in the community services and health sectors, you will<br />
be required to have a comprehensive understanding of the <strong>OHS</strong> regulations, your<br />
employer‟s responsibilities and your own responsibilities in a <strong>workplace</strong> environment. In<br />
this section you will learn about the state‟s legislation and related policies, and its<br />
application to your <strong>workplace</strong>. You will be required to participate in the implementation<br />
of legislation and policy as it relates to the development and maintenance of a safe and<br />
healthy <strong>workplace</strong>. It is suggested that you access websites to gather current data on <strong>OHS</strong><br />
Act and Regulation and resources, e.g. Publications and test cases.<br />
Occupational Health and Safety (<strong>OHS</strong>) is fundamental to the effective and efficient<br />
functioning of all <strong>workplace</strong>s. It is to the benefit of all in the <strong>workplace</strong> that <strong>OHS</strong><br />
processes are not only adhered to, but also supported and endorsed by the entire work<br />
team. For this to happen, both employers and employees must be part of the process of<br />
creating, sustaining and developing the <strong>OHS</strong> process.<br />
<strong>OHS</strong> is more than the application of legal policies and procedures, as set out by the<br />
Occupational Health and Safety Act, 2000 and the WorkCover Occupational Health and<br />
Safety Regulation 2001 (the two main legislative documents that underpin all <strong>workplace</strong><br />
<strong>OHS</strong> issues). <strong>OHS</strong> must also be promoted as important and beneficial to all workers,<br />
whether permanent, casual or visitors.<br />

<strong>Manage</strong>rs, coordinators and supervisors usually have the day-to-day responsibility of<br />
overseeing service provision. Although it is an employer‟s responsibility to ensure that<br />
managers, coordinators and supervisors are adequately trained, managers themselves have<br />
the responsibility to ensure that premises, equipment and substances under their control,<br />
are safe and without risks to health - they are accountable for implementing the practical,<br />
ongoing procedures and measures relating to <strong>OHS</strong>.<br />
SAMPLE<br />
Throughout this unit of competency much of what is presented and discussed, as „employer<br />
responsibilities‟ are in practice the shared responsibility of employers, managers,<br />
coordinators or directors. Anyone in a <strong>management</strong> position in community services needs<br />
to have a thorough understanding of these responsibilities.<br />

Duty of care<br />
Under the Occupational Health and Safety Act, the employer must accept a duty of care (or<br />
responsibility) for the health and safety of all people in the <strong>workplace</strong>. Employers and<br />
managers must take care of the health and safety requirements of:<br />

all employees<br />
colleagues<br />
clients (this includes children)<br />
volunteers<br />
contractors<br />
suppliers<br />
visitors<br />
children being cared for while their carers or parents are attending the <strong>workplace</strong> as<br />
clients or workers.<br />
According to WorkCover (2007), these groups should be given reasonable information and<br />
instruction regarding:<br />

<br />
safe use of the site and equipment<br />
emergency procedures<br />
activities of clients<br />
other <strong>OHS</strong> issues to which they have exposure.<br />
Therefore, employers and managers must ensure that the principles of duty of care are<br />
incorporated into all <strong>management</strong> strategies, policies and procedures.<br />
As a worker you must also exercise a duty of care to those in your <strong>workplace</strong> environment.<br />
You are required ensure the health and safety of all colleagues, clients and visitors to your<br />
service at all times. These duty of care requirements include the following legislation and<br />
Acts:<br />
Disability Services Standards (NSW Disability Services Act, 1993)<br />

NSW Supported Assisted Accommodation (NSW SAAP Standards 1998).<br />
Further information on duty of care is found later in this guide. As you can see there are a<br />
great number of legislative duties and requirements to be met when creating individual<br />
<strong>workplace</strong> procedures and policies. The employer is legally bound to follow all of the<br />
above-mentioned requirements, and tailor them to the specific <strong>workplace</strong>. They also have<br />
an obligation to consult or confer with employees, both formally and informally, regarding<br />
all <strong>OHS</strong> decisions.<br />
