Instructor evaluations shall beprepared on commission-approved forms inaccordance with the rules in this Chapter.These evaluations shall be kept on file by theschool for a period <strong>of</strong> three years and shall bemade available for inspection by arepresentative <strong>of</strong> the Commission uponrequest;(13)(12) Ensure that any designated certified instructorwho is evaluating the instructionalpresentation <strong>of</strong> another shall, at a minimum,hold certification in the same instructionaltopic area as that being taught;(14)(13) Administer or designate a person to administerappropriate tests as determined necessary atvarious intervals during course delivery;(15)(14) Maintain direct supervision, direction, andcontrol over the performance <strong>of</strong> all persons towhom any portion <strong>of</strong> the planning,development, presentation, or administration<strong>of</strong> a course has been delegated;(16)(15) During a delivery <strong>of</strong> the TelecommunicatorCertification Course, make available toauthorized representatives <strong>of</strong> the Commissiontwo hours <strong>of</strong> scheduled class time andclassroom facilities for the administration <strong>of</strong> awritten examination to those trainees who havesatisfactorily completed all course work; and(17)(16) Not more than 10 days after receiving from theCommission's representative the Report <strong>of</strong>Examination Scores, the school director shallsubmit to the Commission a Post-DeliveryReport <strong>of</strong> Training Course Presentation (Form7-B-T).(b) In addition to the requirements in 12 <strong>NC</strong>AC 10B .0708(a),the school director shall be readily available to students andDivision staff at all times during course delivery by telephone,pager, or other means. The means, and applicable numbers,shall be filed with the accredited training delivery site and theDivision prior to the beginning <strong>of</strong> a scheduled course delivery.Authority G.S. 17E-4.12 <strong>NC</strong>AC 10B .0713 ADMISSION OF TRAINEES(a) The school may not admit any individual younger than 21years <strong>of</strong> age as a trainee in any non-academic Commissionaccreditedbasic training course without the prior writtenapproval <strong>of</strong> the Director <strong>of</strong> the Standards Division for thoseindividuals who will turn 21 years <strong>of</strong> age during the course, butprior to the ending date.(b) The school shall give priority admission in Commissionaccreditedbasic training courses to individuals holding full-timeemployment with criminal justice agencies.(c) The school shall administer the reading component <strong>of</strong> astandardized test which reports a grade level for each traineeparticipating in the Detention <strong>Office</strong>r Certification Course. Thespecific type <strong>of</strong> test instrument shall be determined by the schooldirector and shall be administered no later than by the end <strong>of</strong> thefirst two weeks <strong>of</strong> a presentation <strong>of</strong> the Detention <strong>Office</strong>rCertification Course. The grade level results on each traineeshall be submitted to the Commission on each trainee's Report <strong>of</strong>Student Course Completion (Form F-7d).(d) The school shall not admit any individual as a trainee in apresentation <strong>of</strong> the Detention <strong>Office</strong>r Certification Course or theTelecommunicator Certification Course unless as a prerequisitethe individual has provided to the certified school director aMedical Examination Report Form (F-2) and the MedicalHistory Statement Form (F-1) in compliance with 12 <strong>NC</strong>AC 10B.0304. .0304, properly completed by a physician licensed topractice medicine in North Carolina. The Medical ExaminationReport Form (F-2) and the Medical History Statement Form (F-1) required by the North Carolina Criminal Justice Educationand Training Standards Commission shall be recognized by theCommission for the purpose <strong>of</strong> complying with this Rule.Authority G.S. 17E-7.SECTION .0800 – ACCREDITATION OF JUSTICEOFFICER SCHOOLS AND TRAINING COURSES12 <strong>NC</strong>AC 10B .0802 ACCREDITATION:DELIVERY/DETENTION OFFICER CERTIFICATIO<strong>NC</strong>OURSE(a) An institution or agency must be accredited to deliver aDetention <strong>Office</strong>r Certification Course.(b) In order to obtain accreditation, an institution or agencyshall meet or exceed the following minimum standards foroverall course delivery:(1) the institution or agency shall conduct aminimum <strong>of</strong> one Detention <strong>Office</strong>rCertification Course each calendar year;(2) the executive <strong>of</strong>ficer shall comply with therequirements <strong>of</strong> 12 <strong>NC</strong>AC 10B .0703; and(3) the executive <strong>of</strong>ficer shall comply with theadditional accreditation requirements asspecified in the "Detention <strong>Office</strong>rCertification Course Management Guide".(c) An institution or agency meeting the requirements <strong>of</strong> 12<strong>NC</strong>AC 10B .0802(b) may submit a "Request for Accreditation"(Form F-7) to the Division. Upon receipt <strong>of</strong> the request, theDivision staff shall:(1) review the application for completeness;(2) contact the institution or agency executive<strong>of</strong>ficer or designated school director toschedule an on-site visit and tour <strong>of</strong> theproposed training facilities;(3) during the on-site visit note any deficienciesand attempt to provide assistance andrecommendations in correcting thosedeficiencies; and(4) notify the applying institution or agency, inwriting, <strong>of</strong> the approval or denial <strong>of</strong> theaccreditation request.(d) In cases where the deficiencies prohibit the immediateaccreditation <strong>of</strong> the institution or agency, the application shall beplaced in a pending status:<strong>19</strong>:<strong>06</strong> NORTH CAROLINA REGISTER September 15, 2004603
