PROPOSED RULESthan one year, then the eight hours <strong>of</strong> instruction shall be waivedfor this shortened term and Full General Detention <strong>Office</strong>rInstructor Certification will be issued provided all otherconditions for Full status as set out in Paragraph (b) <strong>of</strong> thisSection are met.(b) The probationary instructor shall be awarded full Detention<strong>Office</strong>r Instructor Certification at the end <strong>of</strong> the probationaryperiod if the instructor, instructor's certification required in 12<strong>NC</strong>AC 10B .0904(a)(2) remains valid, and that the instructorthrough application, submits to the Division documentation thatcertification required in 12 <strong>NC</strong>AC 10B .0904(a)(2) remainsvalid, and either:(1) a favorable recommendation from a schooldirector accompanied by certification on acommission Instructor Evaluation Form thatthe instructor satisfactorily taught a minimum<strong>of</strong> eight hours as specified in Paragraph (e) <strong>of</strong>this Rule in a commission-accreditedDetention <strong>Office</strong>r Certification Course duringhis/her probationary year; or(2) an acceptable written evaluation as specified inParagraph (e) <strong>of</strong> this Rule by a commissionmember or staff member based on an on-siteclassroom evaluation <strong>of</strong> the probationaryinstructor in a commission-accreditedDetention <strong>Office</strong>r Certification Course. Suchevaluation shall be certified on a commissionInstructor Evaluation Form. In addition,instructors evaluated by a commission or staffmember must also teach a minimum <strong>of</strong> eighthours in a commission-accredited Detention<strong>Office</strong>r Certification Course during his/herprobationary year.(c) As <strong>of</strong> August 1, 2002, the expiration dates <strong>of</strong> any existingcommission-issued Full General Detention <strong>Office</strong>r InstructorCertifications will be amended to expire concurrently with theexpiration <strong>of</strong> the instructors' General Instructor Certificationissued by the North Carolina Criminal Justice Education andTraining Standards Commission. If the time-period before theexpiration date is less than two years, then the eight hours <strong>of</strong>instruction shall be waived for this shortened term and FullGeneral Detention <strong>Office</strong>r Instructor Certification will berenewed. Full Detention <strong>Office</strong>r Instructor Certification iscontinuous so long as the instructor, instructor's certificationrequired in 12 <strong>NC</strong>AC 10B .0904(a)(2) remains valid, and thatthe instructor submits to the Division every two years a renewalapplication to include documentation that certification requiredin 12 <strong>NC</strong>AC 10B .0904(a)(2) remains valid, and which includeseither:(1) a favorable recommendation from a schooldirector accompanied by certification on acommission Instructor Evaluation Form thatthe instructor satisfactorily taught a minimum<strong>of</strong> eight hours as specified in Paragraph (e) <strong>of</strong>this Rule in a commission-accreditedDetention <strong>Office</strong>r Certification Course duringthe previous two year period. The date fullInstructor Certification is originally issued isthe anniversary date from which each two yearperiod is figured; or(2) an acceptable written evaluation as specified inParagraph (e) <strong>of</strong> this Rule by a commissionmember or staff member based on a minimumeight hours, on-site classroom observation <strong>of</strong>the instructor in a commission-accreditedDetention <strong>Office</strong>r Certification Course.(d) In the event a General Detention <strong>Office</strong>r InstructorCertification (either Probationary or Full ) is terminated forfailure to have been satisfactorily evaluated for eight hours <strong>of</strong>instruction in a Detention <strong>Office</strong>r Certification Course, theindividual may re-apply for certification meeting the initialconditions for such certification, but must also providedocumentation that he/she has audited eight hours <strong>of</strong> instructionin a delivery <strong>of</strong> an accredited Detention <strong>Office</strong>r CertificationCourse.(e) An Instructor Evaluation Form records a rating <strong>of</strong> theinstructor's qualities, organization and presentation <strong>of</strong> materialsconsistent with the requirements for successfully completing theCriminal Justice Instructor Training as set out in 12 <strong>NC</strong>AC 09B.0209. Instructor qualities, organization and presentation arerated on a scale <strong>of</strong> 1 (poor), 2 (fair), 3 (good), 4 (excellent) and 5(superior). Instructor qualities include, but may not be limited toappearance, gestures, verbal pauses, grammar, pronunciation,enunciation, voice, rate (too slow or too fast), eye contact, andenthusiasm. Organization and presentation include, but may notbe limited to:(1) Major objectives <strong>of</strong> the course made clear;(2) Class Presentation planned and organized;(3) Important ideas clearly explained;(4) Instructor's mastery <strong>of</strong> the course content;(5) Class time well used;(6) Encouragement <strong>of</strong> critical thinking andanalysis;(7) Encouragement <strong>of</strong> student involvement;(8) Reaction to student viewpoints different frominstructors;(9) Student's attitude toward instructor; and(10) Instructors use <strong>of</strong> training aids.A rating <strong>of</strong> 1 or 2 is unacceptable or unsatisfactory; and a rating<strong>of</strong> 3, 4, or 5 is acceptable or satisfactory.Authority G.S. 17E-4.12 <strong>NC</strong>AC 10B .0911 SUSPENSION: REVOCATION:DENIAL OF DETENTION OFFICER INSTRUCTORCERTIFICATION(a) The Division may notify an applicant for instructorcertification or a certified instructor that a deficiency appears toexist and attempt, in an advisory capacity, to assist the person incorrecting the deficiency.(b) When any person certified as an instructor by theCommission is found to have knowingly and willfully violatedany provision or requirement <strong>of</strong> these Rules, the Commissionmay take action to correct the violation and to ensure that theviolation does not recur, including:(1) issuing an oral warning and request forcompliance;<strong>19</strong>:<strong>06</strong> NORTH CAROLINA REGISTER September 15, 2004605
