PROPOSED RULESschedules. The employing agency shall arriveat an agreement with the employee as to whatconstitutes the normal number <strong>of</strong> hoursworked during a given workweek, taking intoconsideration the time that the employeeengages in private pursuits such as eating,sleeping, entertaining and the time they areable to be away from the facility for personalreasons. The following basis <strong>of</strong> pay may beadopted for employees in such categories:(2) Salary - The annual salary and monthly salaryrates <strong>of</strong> an employee shall be established undercurrent personnel policy. With the employee'sagreement, this salary is to represent theemployee's straight-time pay for the agreedupon normal number hours on duty per week.(3) Overtime Compensation - It is anticipated thatweekly schedules will fluctuate. When it isnecessary to work in excess <strong>of</strong> the agreed uponworkweek hours, the employees will be paidtime and one-half the hourly rate for all hoursworked in excess <strong>of</strong> the normal workweek.(e)(d) <strong>Register</strong>ed Nurses:(1) When possible, the compensation shall be inthe form <strong>of</strong> time <strong>of</strong>f. When the employeenormally has 24 hours responsibility, (as in thecase <strong>of</strong> some supervisors and most directors),overtime compensation provisions shall not beapplicable.(2) Where an employee is assigned duties at alower classification level; the base rate <strong>of</strong> paymay not exceed the maximum rate <strong>of</strong> the lowerlevel assignment.(f) Law Enforcement Activities:(1) The requirements for law enforcementactivities are outlined in the Fair LaborStandards Act, Code <strong>of</strong> Federal Regulations,Title 29, Part 553.200-553.233.(2) Under Section 7(k) <strong>of</strong> the Act, agencies maychoose to pay law enforcement personnelovertime compensation in work periods <strong>of</strong> 28consecutive days after 171 hours <strong>of</strong> work.Authority G.S. 126-4.25 <strong>NC</strong>AC 01D .<strong>19</strong>46 OT/COMP TIME OFF OPT/LAWENF: FIRE PROT/EMGCY RESP PERSThe following provisions are applicable only to agencies whoemploy persons in nonexempt law enforcement/fireprotection/emergency response positions. Such agencies may,by letter to the State Personnel Director, choose to utilize thefollowing overtime compensation provisions in lieu <strong>of</strong> thecustomary overtime compensation provisions elsewhere in thisSection:(1) Under these provisions, nonexempt persons inlaw enforcement positions who work morethan 171 hours (or 212 hours for nonexemptpersons in fire protection or emergencyresponse positions) in a 28 consecutive daywork period may be given compensatory time<strong>of</strong>f in lieu <strong>of</strong> cash payment for those overtimehours worked.(2) Compensatory time <strong>of</strong>f earned must be usedno later than 180 days from the date thecompensatory time <strong>of</strong>f was earned.(3) Compensatory time <strong>of</strong>f earned, but not usedwithin 180 days from its being earned must bepaid for in cash in the first pay periodfollowing the expiration <strong>of</strong> the 180 days.(4) Overtime earned under these provisions mustbe compensated at the rate <strong>of</strong> one and one-halftime the regular hourly rate or one andone-half hours <strong>of</strong> compensatory time <strong>of</strong>f foreach hour <strong>of</strong> overtime earned.(5) If an employee under these provisions has apositive balance <strong>of</strong> earned compensatory time<strong>of</strong>f and is promoted to an exempt position, theaccumulation <strong>of</strong> earned compensatory time <strong>of</strong>fmust be paid in cash before the employee goesinto the exempt position.(6) Employees cannot accumulate more than 320overtime hours (480 straight-time hours). Anyovertime earned in excess <strong>of</strong> 320 hours mustbe paid in cash as earned.Authority G.S. 126-4.25 <strong>NC</strong>AC 01D .<strong>19</strong>47 TOUR OF DUTY ANDCOMPENSABLE HOURS OF WORKThe term "tour <strong>of</strong> duty" is a unique concept applicable only toemployees in law enforcement and fire protection activities.This term means the period <strong>of</strong> time during which an employee isconsidered to be on duty for purposes <strong>of</strong> determiningcompensable hours. It may be a scheduled or unscheduledperiod. Scheduled periods also include time spent in workoutside the "shift" which the public agency employer assigns tothe employee. Unscheduled periods include time spent in courtby <strong>of</strong>ficers, time spent handling emergency situations and timespent working after a shift to complete an assignment. Suchtime must be included in the compensable tour <strong>of</strong> duty eventhough the specific work performed may not have been assignedin advance. The tour <strong>of</strong> duty does not include time spentworking on an occasional or sporadic and part-time basis in adifferent capacity from the regular work. Neither does it includetime spent substituting for other employees by mutualagreement. The tour <strong>of</strong> duty also does not include time spent involunteer law enforcement and fire protection activitiesperformed for a different jurisdiction.Authority G.S. 126-4.25 <strong>NC</strong>AC 01D .<strong>19</strong>48 OCCASIONAL OR SPORADICEMPLOYMENT//DIFFERENT CAPACITY(a) Where employees, solely at their option, work occasionallyor sporadically on a part-time basis for the same public agencyin a different capacity from their regular employment, the hoursworked in the different jobs shall not be combined for the<strong>19</strong>:<strong>06</strong> NORTH CAROLINA REGISTER September 15, 2004627
