<strong>2013</strong> MANUAL OF MOTORCYCLE SPORT11 ANTI-DOPING POLICY11.27.0.1 ScopeThis Policy applies to:a) all people who are required to be licensedunder the <strong>Manual</strong> (for the avoidance <strong>of</strong>doubt, this includes all riders, <strong>of</strong>ficials(whether paid or volunteers), coaches andmechanics);b) all people who enter the “pit” or “paddock”area at an event; andc) anyone else who MA or any SCB requires tocomply with it from time to time, for example asa condition <strong>of</strong> entry to an event.11.27.0.2 PurposeThe purposes <strong>of</strong> this Policy are as follows.a) To create a safe and healthy environment forall participants in Events that is free from thehazards that may be associated with the use<strong>of</strong> drugs and alcohol.b) To ensure that MA complies with its legalobligations to provide a safe environment forparticipants.c) To communicate this policy on the use <strong>of</strong>drugs and alcohol during Events, and thedrug and alcohol testing regime.d) To communicate that it is unacceptable to beunder the influence <strong>of</strong> drugs or alcohol duringEvents.11.27.0.3 DefinitionsFor the purposes <strong>of</strong> this Policy, the following terms shallhave the following meanings.Anti-Doping Policy means MA’s “Anti-Doping Policy” asamended from time to time.ASADA means the <strong>Australia</strong>n <strong>Sport</strong>s Anti-DopingAuthority.Event means a motorcycling event sanctioned by MAdirectly, or indirectly through a SCB. This may include,but is not limited to, a race, training or testing andexhibitions.Event Organiser means MA, a SCB, MA member club,promoter or any other entity having control <strong>of</strong> an Event.Location means any venue where an Event is takingplace.MA means <strong>Motorcycling</strong> <strong>Australia</strong> Limited.<strong>Manual</strong> means the “<strong>Manual</strong> <strong>of</strong> <strong>Motorcycle</strong> <strong>Sport</strong>”produced by MA, as amended from time to time. Thismeans and includes any policies, rules or documentswhich MA determines amend or supplement the“<strong>Manual</strong> <strong>of</strong> <strong>Motorcycle</strong> <strong>Sport</strong>” from time to time.Policy means this policy (including any schedules orannexures) as adopted and amended by MA from timeto time.Prohibited Substance means any substance which islisted in the “List <strong>of</strong> Prohibited Illicit Drugs” publishedby the <strong>Australia</strong>n <strong>Sport</strong>s Commission from time to time.Sample means a sample provided in conjunction witha Test.SCB means a “State Controlling Body” for the sport<strong>of</strong> motorcycling as recognised by MA under itsconstitution.Significant Incident means any incident which occursduring an Event that results in a person requiringmedical treatment, property damage, or any otherincident which, in the opinion <strong>of</strong> the Event Organiser (orits nominee) requires further investigation. This lattercategory may include dangerous occurrences or nearmisses during a race.Test means any test conducted under this Policyto detect the presence <strong>of</strong> alcohol or a ProhibitedSubstance.11.27.0.4 Prohibited ActivitiesThe use <strong>of</strong> drugs or alcohol can affect an individual’sability to safely participate in Events and can contributeto dangerous incidents. Any person to whom thisPolicy applies must not:a) use, consume, possess, manufacture, sell,purchase or otherwise transfer a ProhibitedSubstance at a Location;b) have a blood alcohol reading <strong>of</strong> more than0.00 at a Location;c) have any Prohibited Substances in theirsystem at a Location;d) refuse to provide a Sample as part <strong>of</strong> a Test;ore) give false answers to any questions from anyperson administering a Test.11.27.0.5 Sanctionsa) Any person who breaches any <strong>of</strong> theprovisions <strong>of</strong> clause 5 will be refusedparticipation in the relevant Event at theLocation.b) There will be no sanction on a person under thisPolicy except as set out in sub-clause (a) above.However, for the avoidance <strong>of</strong> doubt, this doesnot restrict or limit the possibility <strong>of</strong> sanctions orpenalties under any other rule, regulation, policy,procedure <strong>of</strong> MA, a SCB, Event Organiser orother controlling body (including, but not limitedto, under the procedures in the <strong>Manual</strong> or theAnti-Doping Policy).89
11 ANTI-DOPING POLICY11.27.0.6 Prescribed Medicationa) If a person to whom this Policy appliesconsiders there is a possibility that prescribedmedication is affecting their ability toparticipate safely in an Event, that personshall inform the Event Organiser immediately.It is not necessary for the person to disclosethe illness, ailment or the medication whichthey are taking.b) If a participant follows the procedure in subclause(a) above, then:(i) they can participate in an Event if theycan provide a medical clearance fromtheir treating medical practitioner clearlystating the medication will not affect theparticipant’s ability to perform their duties(for a rider, it must state the medicationdoes not affect the ability <strong>of</strong> the rider tocontrol a motorcycle); or(ii) they can not participate in the Event ifthey can not provide such a medicalclearance.11.27.0.7 Testinga) At a Location, an Event Organiser mayconduct a Test upon any person to whomthis Policy applies to detect the presence<strong>of</strong> alcohol or a Prohibited Substance in thefollowing circumstances:(i) on a voluntary basis if a participantrequests a Test prior to or during theEvent;enjoy the ride(II) randomly as determined by the EventOrganiser;(iii) when the Event Organiser suspects, onreasonable grounds, that the personis under the influence <strong>of</strong> alcohol or aProhibited Substance.b) An Event Organiser may conduct a Test bytesting the breath, urine or saliva <strong>of</strong> a person.However, such method <strong>of</strong> testing must beapproved by MA.c) The result <strong>of</strong> any Test and any decision madeby the Event Organiser which follows is final.There is no appeal process and a person isnot entitled to undergo a second Test.11.27.0.8 ConfidentialityThe results <strong>of</strong> all Tests will be kept confidential to theorganisation conducting the Test, the Event Organiser,any relevant SCB, and MA.11.27.0.9 Rehabilitation and CounsellingMA recognises drug and alcohol dependency as atreatable condition.
