OFFICE OF THE DEPUTY COMMISSIONER, CENTRAL EXCISE DIVISION, CHANDIGARH-I,PLOT NO.19, SECTOR-17-C, 5TH FLOOR, CHANDIGARH.all related legislations as applicable to it from time to time including Minimum Wages Act,Employees Provident Fund ES! Act etc and this office shall not incur any liability for any expenditurewhatsoever on the persons employed by the Service Provider on account of any obligation. TheService Provider will require to provide particulars of EPF, ESI of its - employees engaged in thisoffice. The Agency will comply all statutory provisions of law, rules and regulations of Act and keepthis office informed about any amendment in the law from time to time.(xv)Payments to the Service Provider would be made only after the receipt of Satisfactory certificate from Head ofOffice of respective formation/premises. In case of unsatisfactory performance of work or partialcompletion of work on any day/period, no charges would be paid for that day /period.(xvi) The Service Provider shall be contactable at all time and messages sentb y p h o n e / e - m a i l/f a x / s p e c ial m e s s e n g e r f r o m t h i s o f f i c e s h a ll b e acknowledged immediately onreceipt on the same day. The Service Provider shall strictly observe the instructions issued by the Departmentin fulfillment of the contract from time to time.(xvii) This office shall not be liable for any loss, damage, theft, burglary or r o b b ery o f a ny pe rson alb e lo ng in g s, e qu ip me nt o r ve h ic les o f th e personnel of the Service Provider.(xviii) That the Service Provider on its part and through its own resources shall ensure that the goods material s andequipment etc. are not damaged in the process of carrying out the s of negligence, default or theft on thepart of the employees/agents of the Service Provider, then the Service Provider shall be liable to reimburse tothis office for the same. The Service Provider shall keep this office fully indemnified against any such loss ordamage. Any accident/casualty occurred during the course of working to any staff engaged by the ServiceProvider shall be borne by firm and this office will no way be responsible for it or any other clause mentionedabove.(xx) The successful bidder will enter into an agreement with this office for providing of suitable serviceas per requirement of this office on these terms and conditions on non-judicial Rs.100/ -stamppaper. The above stamp paper will be arranged by the bidder for execution of agreement. Theagreement will be valid for a period of contract period. The service charges/ rates quoted by theService Provider shall be fixed for contract period and no request for any change /modification shall beentertained before expiry of the period of contract. Any statutory increase inwages/DA etc. is to be absorbed by the service provider.(xxi)The service provider shall not assign, transfer, pledge or sub contract the performance of services.(xxii) The agreement can be terminated by either party by giving one month's notice in advance. Ifthe Service Provider fails to give one month's notice in writing for termination of theAgreement then one month's amount due to the Service Provider from the office shall be forfeited.(xxiii) That on the expiry of the agreement as mentioned above, the Service Provider will withdraw all itspersonnel and clear their accounts by paying them all their legal dues. In case of any dispute on12
OFFICE OF THE DEPUTY COMMISSIONER, CENTRAL EXCISE DIVISION, CHANDIGARH-I,PLOT NO.19, SECTOR-17-C, 5TH FLOOR, CHANDIGARH.account of the termination of employment or non-employment by the personnel of the ServiceProvider, it shall be the entire responsibility of the Service Provider to pay and settle the same.(xxiv) In the event, if any dispute arises touching any of the clauses of the agreement, the matter will bereferred to The Commissioner of Central Excise, Chandigarh-I, whose decision shall be binding on boththe parties.(xxv) That if any amount is found payable by the bidders towards, any liability in connection with housekeeping services orany loss to this office property, the same shall be adjusted from monthly bill to the extent of the amount sodetermined reserving right to recover the deficit amount through other modes of recovery including theright to terminate the agreement without notice(xxvi) This office reserves the right to reject any or all the tenders without assigning any reason whatsoever andthe decision of the management shall be final and binding on all the bidders.NB. 1.
