OFFICE OF THE DEPUTY COMMISSIONER, CENTRAL EXCISE DIVISION, CHANDIGARH-I,PLOT NO.19, SECTOR-17-C, 5TH FLOOR, CHANDIGARH.ANNEXURE-BGENERAL TERMS AND CONDITIONS1. Rates/ Quotations duly filled in will be received upto the date and time mentioned inthe Limited Tender Notice. Rates/quotations should be for the specified area for therespective formations and Rate quoted on per Square feet basis, duly indicatingNo. of persons proposed to be engaged by the Service Providers.2. The Central Excise Division, Chandigarh (hereinafter referred to as theCommissionerate) reserve the right to postpone and/ or extend the date of receipt/opening of Rates/Quotation or to withdraw the same, without assigning any reasonthereof.3. The Service Providers are required to submit the complete Rates/ Quotations onlyafter satisfying each and every condition laid down in the Annexure enclosed.4. All the rates must be written both in figures and in words. Corrections, if any, are tobe made by crossing out, initialing dating and rewriting. In case of discrepancybetween the words and figures the rates indicated in figures shall prevail. Alloverwriting/ cutting, insertions shall be authenticated and attested.5. Rates/Quotations should be submitted and signed by the firm with its currentbusiness address and contact number.6. The rates shall be valid for a period from the date of contract to the end of nextfinancial year i.e. 03/2014 .7. The Service Providers should satisfy themselves before submission of the Rates/Quotations to the Cnetral Excise Division, Chandigarh that they meet the qualifyingcriteria and capability as laid down in the Annexure.8. The Service Providers must comply with the Rates/ Quotations, specification and allterms and conditions of contract. No deviation in the terms & Conditions of theContract shall be entertained unless specifically mentioned by the contractor in theRates/ Quotations and accepted by the Central Excise Division, Chandigarh.9. The contract will be awarded for a period from the date of contract to the end of nextfinancial year i.e. 31.03.2014.4

In case of any of any default by the Contractor and in any of the terms & conditions(whether General or Special), the Central Excise Division, Chandigarh may, withoutprejudice to any other right / remedy which shall have accrue or shall accruethereafter, terminate the contract, in whole or part, by giving 15 days notice in writingto the Contractor.11. Notwithstanding anything contained herein, the Division/Commissionerate reservesthe right to terminate the contract by giving 15 days notice in writing withoutassigning any reason and without incurring any financial liability whatsoever to theContractor.12. Insurance cover protecting the agency against all claims applicable under theWorkmen’s Compensation Act, 1948 shall he taken by the contractor. The contractorshall arrange necessary insurance cover for any persons deployed by him even forshort duration. The Central Excise Division, Chandigarh shall not entertain any claimarising out or mishap, if any that may take place. In the event of any liability/ claimfalling on this Central Excise Division, Chandigarh the same shall be reimbursed/indemnified by the Contractor.13. The Service Provider shall in no case lease/ transfer/sublet/appoint care taker forservices.14. No other person except Service Provider’s authorized representative shall beallowed to enter the office premise of Chandigarh-I.15. Within the premises of the Central Excise Division, Chandigarh, the ServiceProvider’s personnel shall not do any private work other than their normal duties.16. The Service Provider shall be directly responsible for any/all disputes arisingbetween him and his personnel and keep the Central Excise Chandigarh indemnifiedagainst all actions, looses, damages, expenses and claims whatsoever arisingthereof.17. The Service Providers shall be solely responsible for payment of wages/salaries other benefits and allowances to his personnel that might becomeapplicable under any Act or Order of the Govt. The Central Excise Division,Chandigarh shall have no liability whatsoever in this regard and the Contractorshall indemnify this Central Excise Division, Chandigarh against any/ all claimswhich may arise under the provisions of various Acts, govt. Orders etc.5
