He set off from Dijonin his replica Second WorldWar aircraft in the morning,aiming to stop off at Bergeracbefore heading for Bordeaux.During the flight, a problemwith the fuel system led to anengine failing and the pilot toattempted to land in a field. “Atthat moment, the motor firedup again, before cutting outonce more shortly afterwards,”explained the pilot. “Bythen I had no choice but themotorway. It would have beenbetter for me to try and land inthe field, but in aviation, whenyou have made a decision, younever go back on it.”Although he was able towalk away from the accident,the same could not be said forthe plane, which had severelydamaged landing gear andhad also lost half of onewing following a collisionwith the central reservationcrash barriers. The plane hadonly recently been servicedand exactly what caused thefailure was not immediatelyapparent.Fortunately for allinvolved, there was littletraffic at 12h47 when theMustang made its impromptulanding, although themotorway was closed in theClermont-Ferrand directionfor several hours before thepilot, the debris and the planecould be removed. ■New TGV line proposed linking Guéret to ParisThere has been muchdebate, and a gooddeal of controversy,surrounding the new ligne àgrande vitesse (LGV) betweenLimoges and Poitiers, due tobe finished in 2017. But whilstall the focus has been in theHaute-Vienne, there are plansfor another high-speed line forthe Limousin that have slippedsomewhat under the radar: theso-called POCL line linkingParis, Orléans, Clermont-Ferrand and Limoges.Altro, the organisationlobbying for this newhigh-speed line, has beencampaigning since 2000 forthe Transline project, whichaims to create a high-speed raillink from the Atlantic coast tothe Alps and forms the Frenchpart of a wider European-wideproject aimed at linking Lisbonwith Kiev by one continuoushigh-speed network.The argument for the newPOCL line is helped by the factthat it could re-use much ofthe route currently being usedfor the Paris-Lyon-MarseillesTGV, greatly reducing boththe cost and the environmentalimpact.“A public debate will belaunched in October about r<strong>eu</strong>singthe Paris-Lyon route,”explained Michel Caniaux,representative for Altro, at arecent meeting in Guéret toback the proposed new line.“We are supporting a routefor the POCL line that passesthrough Montluçon, andwould put Guéret 2h30 fromParis and 2h15 from Lyon.This route would be a valuabletool for the development ofthe Cr<strong>eu</strong>se. A TGV link is nota magic wand, but it does nothurt!”Politicians from the Cr<strong>eu</strong>sehave long supported the LGVLimoges-Poitiers line, despitethe fact that the departmentstands to gain very littlefrom it, and support is nowalso strong for the proposedMontluçon link. MichelVergnier, MP for Cr<strong>eu</strong>se andGilles Pailler, vice president ofthe Conseil régional have bothpublicly offered their backing.With almost unanimoussupport for the project, theremaining hurdles will befinancing, opposition fromenvironmental groups andprotests from those withproperties near any new highspeedrail line. ■

Ifan illegal amount of alcohol isdetected in the driver’s breath,the ignition is disabled.The technology for theseéthylotests anti-démarrage(EAD machines), has beenunder test with significantsuccess since 2004 in Haute-Savoie, where re-offending rateswere cut to just 25%, althoughan increase was noted once thedevice was removed.Local magistrates will havethe power to offer a reducedsentence in return for thefitting of an EAD machine for aperiod of between 6-36 months.Currently, drivers found with ablood-alcohol level greater than1g/litre will face on averagean €800 fine, 6 points off theirlicence and a 4-5 month drivingban. With the fitting of an EADmachine, this would be reducedto just a 15-day ban, therewould be no loss of points andno offence on their criminalrecord. Following an alltimelow in April of this year whenit hit just 30%, according to an IFOPpoll conducted in September, hispopularity has now risen to 37%.President Sarkozy has not officiallydeclared his intention to run in nextyear’s elections, but most expect himto seek a second term in office andhis campaign has received severalunexpected boosts in recent months.Pictures of him holidaying on thebeach with his pregnant wife, CarlaBruni-Sarkozy, have softened hisimage. The producers of FoieGras, therefore, claim that theyare simply maximising thebenefits of a naturally occurringprocess.It’s not just Trish Deseinewho has been vocal about herboycott of Foie Gras. OtherBritish celebrities such as KateWinslet and Sir Roger Moorehave headed up PETA (Peoplefor the Ethical Treatment ofAnimals) campaigns, narratingvideos and urging people tojoin them in their boycott ofthe “inhumane” production thathas already been banned in 15countries. One article on thesubject on PETA's website goesa step further and urges peopleto join PETA activists and tolive as a vegan for a month. Thismay be a step too far and notonly is veganism a laughableconcept within the majorityof French social circles, butothers have also asked whetherit is a coincidence that so manycelebrities are becoming vegans;do they choose veganism due totheir beliefs on animal rights, oris it a convenient side effect ofeating habits which enable thosein the limelight to stay slim and‘attractive’?The PETA website isfull of articles on variousfarming techniques whichare deemed inhumane andcruel; Foie Gras is just onedrop in a seemingly neverendingocean. One Frenchchef interviewed in response toTrish’s boycott simply claimedthat the production of FoieGras is no worse than batteryhen farms. Whilst it is easyto avoid the issue by offeringother situations that are just asbad, there is certainly a can ofworms ready and waiting to beopened.With so many badly treatedanimals in this world, why areactivists choosing to championthis cause over others? Perhapsit has something to do withthe image of the duck. Duringchildhood most Brits weremore likely to share their bathor bedtime with a duck thanthey were to eat one. Amongstothers, popular characterssuch as Jemima Puddle Duck,Donald Duck and MotherGoose endeared the duck tothe masses. Does the image wehold of a duck mean that forcefeedingand the production ofFoie Gras appears more cruel tous than battery hen farms? Howabout Kobe-style beef fromcattle fed on beer, which surelycan’t be good for the animal’sliver, or indeed any animalraised on a ‘factory farm’? Notto mention that the famousFrench snail is starved beforedeath in preparation for humanconsumption. Unless you intendto go vegan or boycott allfactory farmed foods, perhaps itwould be a little hypocritical toget up on your high horse aboutFoie Gras?It is true that the productionof Foie Gras is illegal in theUK, but with 80% of thedelicacy being produced inFrance it is far from beingeradicated. Perhaps if Foie Graswasn’t an expensive delicacythere wouldn’t be such a fightto stop people from eating it.It costs to change from buyingfactory farmed meat to organic,but Foie Gras is already anexpensive delicacy. Sir RogerMoore has certainly targetedhis fight towards those whobuy the product as an indulgenttreat, choosing the clienteleof Selfridges in London ashis audience; one particularChristmas-time campaignposter shows him holding up asign with the message “Force-Feeding Birds is Cruel, NotYule”. His fight with Selfridgesto stop selling the productcontinues.It’s not just the British whoare turning against this iconicfood, other countries are inon the act too. It was recentlyannounced that Foie Gras willbe banned at October’s Anugafood fair in Cologne. Muchto the displeasure of Frenchpoliticians, the fair’s organisersfinally gave in to the pressuresof animal rights activists, adecision which has reportedlyprovoked rising politicaltensions between Germany andFrance.As for Trish Deseine, perhapsshe feels a duty to open theeyes of the public to farmingmethods, following in thefootsteps of the likes of JamieOliver and Hugh Fearnley-Whittingstall. But whether youagree with the activists or not,the protected product will notbe disappearing off the shelvesanytime soon. I try andstream games through onthe internet but sometimesit’s so stop and start that Ifeel like throwing the laptopinto the fire.And what about the restof the TV available to us?The programme controllerof Channel 4/E4 must be theluckiest man in the world.He (or she) has bought the“Friends” box set and hasplayed them at randomfor the last 16 years. “TheGilmore Girls”, “Frasier”,“Everwood” and “One TreeHill” just start all over againwhen the final episode isbroadcast. I feel like allmembers of the cast are partof my family because I knowtheir characters so well. I’minviting them around forChristmas Dinner.Speaking of repeats...There’s only so manytimes a person can watch“Groundhog Day”, brilliantas it is. And if I hear Kevintell me that they need to getthe roof on “before the rainscome” on “Grand Designs”one more time then I thinkinsanity is a closer optionthan this keyboard.I must be that way outthis month. OCTOBER 2011 ○ <strong>THE</strong> <strong>BUGLE</strong> ○ www.thebugle.<strong>eu</strong>14 ♦ FRENCH LIFEEstablishing the boundaries of yourproperty – an invaluable precautionThe Bugle's resident lawyer, Laure CHAVERON, looksat the steps required to legally establish the borders of yourproperty and avoid land disputes with your neighbours.If you’ve recently bought aproperty with a plot of land,whether large or small, moreoften than not the boundariesof that property will be marked outeither by a fence or a hedgerow.In order to avoid potentialproblems and disputes further downthe line, it is highly recommendedto officially define the borders ofyour property (borner le terrain).One common occurrence is thata neighbour will contest ownershipof a certain part of a boundaryarea by, for example, removingor trimming a hedge or tree thatthey believe is on their land. If alarge tree is involved, for example,which infringes on a neighbour'sproperty and you cannot prove thatthe tree is on your land, you cannotcontest it being pulled down.What is ‘bornage’?Bornage is the French term forestablishing the borders of a plotof land and refers to definitivelyestablishing the border betweentwo or more private properties.If your property borders publiclyowned land, i.e. a public footpathor forest, then the rules aredifferent: you would then need toask the local authority concernedto perform the bornage andestablish the exact boundary area.Is it compulsory to legallyestablish the borders of yourproperty?No, bornage is not compulsory,but is strongly advised becausethe exact borders rarely featurein the deeds of the property,which will usually just refer toindividual parcels in the cadastralplan and what they contain.Furthermore, the cadastral planis not proof of ownership. In thecase of a dispute, you cannotuse the images on the cadastralplan to contest ownership with aneighbour.Who can request bornage?Only the owner may make arequest to establish the borders ofa property. A tenant, for examplea farmer who rents a field foragricultural purposes, cannotinstigate a request.All parties concerned must bein agreement in order to establishthe borders of two properties.If a property has joint owners,for example, both must be inagreement.Two types of bornage: amicableand judicialAmicable bornage:If you acquire a property andare not 100% sure of the exactboundaries, it is strongly advisedthat you draw up an amicablebornage with your neighbour. Youmust first ask your neighbour orneighbours if they are happy todo so. A document is then writtendetailing the agreement reachedby the property owners involved.The law does not require thisdocument to have a specificformat. In reality, this will usuallyinvolve the visit of a land surveyorwho will examine the deeds ofthe various properties and thecadastral plan. The surveyor willthen establish a verbal agreementbetween the parties and placeboundary markers into the ground.This agreement is then signed byall parties and sent to a notairewho will register the documentwith the relevant authorities, i.e.the conservation des hyptohèques.Judicial bornage:If one party refuses to enter intoan amicable bornage or refusesto sign, then the only remainingoption is a judicial bornage.In short, the law allows for allproperty owners to request theirneighbours to legally establish theborders of their properties. Thejudge will assign a land surveyorto the case, and if one neighbourstill refuses to sign the subsequentagreement, then the judge willmake an independent and bindingruling. The agreement is againsent to the relevant authorities.Who pays what?The costs come in 2 parts: thefees of the land surveyor (whois independent) and those of thenotaire (who is regulated). In thecase of an amicable bornage, thecharges are shared. Atthe same time, however, the lawannounced further measures thataffect other aspects of personalfinance and taxation and, aspromised, we will now look atthese changes.So what has changed?1. INHERITANCE TAXThe rates for the two highestbands of inheritance tax, betweenparents and children only, havenow increased from 35% to 40%for taxable assets worth between€902,838 and €1,805,677 andfrom 40% to 45% for assets worthgreater than €1,805,677.Lifetime gift allowances,which were previously renewableevery six years, have their timelimit now extended to every 10years.2. LIFE ASSURANCEINVESTMENTS (Contratsd’Assurance Vie)This type of investment isa well established method ofreducing French inheritance taxand, while still offering significantinheritance advantages, the newlaw now makes several changesto it.PreviouslyThe beneficiaries of theseinvestments, that were taken outby policyholders who were bothunder age 70 and non-Frenchresident, were totally exemptfrom tax.From now onThis exemption has nowbeen abolished and appliesretrospectively to all existingpolicies. This means that if thepolicyholder dies while Frenchresident then the beneficiaries(wherever they may live) willnow be subject to tax on theirshare of the investment deathbenefits, after an allowance of€152,500 per beneficiary.PreviouslyFor French residentpolicyholders, there was taxationat 20% on benefits receivedabove the €152,500 allowance perbeneficiary.From now onThere are now two tax ratesapplying to policy benefitsreceived above the €152,500allowance per beneficiary. Thefirst is 20% up to €1,053,338 and25% thereafter.PreviouslyIf set up correctly, apolicyholder could leave theinvestment death benefits to thesurviving spouse or PACS’dpartner, to use for the rest of his orher lifetime, and then ultimatelypass to the children (or otherbeneficiaries) on the death of thesurvivor. By doing this, there wasno tax liability for the ultimatebeneficiaries on the proceeds ofthe policy.From now onThe surviving partner will stillreceive the life interest withouta tax liability, but tax may bedue on the children’s acquiredrights. The amount of tax duewill vary according to the age ofthe surviving partner at the dateof death of the policyholder, thevalue of the investment and thenumber of children sharing thebenefits.3. PENSIONSAfter an earlier decision by theFrench tax authorities to tax thelump sums from pension funds,including UK pension schemes,a new tax rule applies to lumpsum withdrawals from pensionschemes received by Frenchresidents. After an allowance of10% of the lump sum, the capitalwill now be subject to a standard7.5% tax charge.4. TRUSTSThe new legislation includesmeasures to tax benefitsarising from trusts which haveFrench resident settlors and/orbeneficiaries.The aim appears to be to ensurethat the French resident settlor/beneficiary will have to pay taxon the Trust assets and income.However, as the taxation oftrusts is “new ground” for theFrench authorities it may be thatthe new rules will take some timeto be fully interpreted and applied.David Hardy,Siddalls Francewww.siddalls.fr

France currentlyhas over 350,000 registered players,although the sport is played far morein the south of the country than in thenorth.The story of how rugby was createdbegins in England. According to thelegend, a schoolboy invented the gameof rugby in 1823. William Webb Elliswas a pupil at Rugby School wherefootball was a popular sport at thetime. He became bored by the slownature of the game and one day “witha fine disregard for the rules of footballas played in his time, first took the ballRugby School - where themodern game was inventedin his arms and ran with it”.This variation of football, whichallowed players to run with the ballin their arms, became increasinglypopular. It spread, first across Englandand soon into neighbouring countries.Although the truth of the Webb Ellisstory is disputed, his school soon gaveits name to this new sport. Later inhis life, Webb Ellis moved to France,where he died on 24th January 1872- he is buried in the town of Menton,near the Italian border. His story wasfirst documented after his death by aschool friend and could therefore notbe verified, which is why many believeit to be false.The new game of rugby started togrow in popularity around the world.The first international rugby match wasplayed between England and Scotlandin Edinburgh in 1871, a match that waswon by the Scottish. France played itsfirst official international match in 1906against the All Blacks of New Zealand.They lost, but the national team hasgrown to become an important team inworld rugby. Les Bl<strong>eu</strong>s have won theSix Nations (in its various formats) 25times and have reached the World Cupfinal twice, in 1987 and 1999. Also on display will be a large numberof objects such as tools used by masons, stone cutters, plasterers,carpenters etcThere will also be a chance to see the construction of a dry stone walland a stone cutter will carve a lintel.Finally census data about the masons of Glénic in the eighteenthcentury and second half of the nineteenth century should enablethose who wish to find the identity and possibly the migration areasof their ancestors.14h-17h.
