(iv)(v)ESI Clause:a) If the contractor is engaging more than 20 employees for the work,the ESI for them shall be paid by the contractor and the documentaryproof shall be furnished along with the Tender.b) If the contractor is engaging less than 20 employees for the work, theESI for them shall be paid by the contractor through Chennai Port Trustfailing which the amount will be recovered from the final bill of thecontractor. The contractor shall submit the list of employees proposed tobe engaged alongwith their father’s name, identification proof, pass portsize photo and the monthly wages paid to them before commencementof the work.InsuranceThe Tenderer advised to take necessary insurance at his cost forhis employees, materials and machineries etc.33. Fore Closure of Contract:I. Not withstanding anything in the contract agreement the contractor agreesthat the Trust (on its won or acting on behalf of the Government of India) or theGovernment of India shall be entitles to foreclose the contract on occurrenceof the following events:i. In the event of breach of contract by the Contractorii.iii.An emergency orfor national security and /or national interest and /or publicreasons.II. Upon the occurrence of the events specified in the above I (i),(ii) and (iii)above the Trust or Government of India reserve the right to fore close thecontract at any point of time during the contract period on the issue of thetermination notice under provision of the termination clause , the Trust shallnot be liable to compensate the contractor or any other person for any lossesor estimated loss of profits during such period.34. FURTHER INSTRUCTIONSThe Chief Mechanical Engineer shall have full power and authority to supply tothe Contractor from time to time during the progress of the works suchinstructions as necessary for the purpose of the proper and adequateexecution and maintenance of the works and the Contractor shall carry outand be bound by the same.37
