Humanscale shall invoicethe customer for the product and monthly storage fees. If a customer isunable to accept a scheduled product upon delivery, customer shall beresponsible for placing the product in storage and bears the risk of loss.However, payment of the balance due is Net 30 from date of shipment.RETURN AUTHORIZATION FOR UNUSED PRODUCTAll returns are subject to a thirty percent (30%) restocking fee. Thecustomer must request a Return Authorization Number through theHumanscale Customer Service Department within 90 days of productreceipt to return any unused product. If Humanscale agrees torepurchase the product, the customer must return it freight prepaid toHumanscale, F.O.B. the original shipping point or as otherwise instructedby Humanscale Customer Service. If product is returned without a ReturnAuthorization Number, Humanscale will notify the customer of theunauthorized return and the customer must provide instructions for itsdisposition within one week thereafter. Failure of the customer to respondwithin one week will result in Humanscale’s right to dispose of the productwith no credit. Return Authorization Numbers expire sixty (60) days afterthe date of issue. If the returned product is not in resalable condition, thecustomer will not receive credit for the return. The customer mustpromptly provide a purchase order or other acceptance of fees/creditreduction as required.WARRANTY (US, Canada, Mexico) Limited Lifetime Warranty.THE FOLLOWING WARRANTY IS IN LIEU OF ALL OTHERWARRANTIES EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITEDTO, THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESSFOR A PARTICULAR PURPOSE. WARRANTY DOES NOT COVER"CUSTOMER’S OWN MATERIAL" (I.E. FABRIC SPECIFIED BY BUYER).Humanscale warrants on all seating products:5 Years: High wear parts: Fabric/Cushions, Casters, Glides.Lifetime: All Other PartsThis WARRANTY is applicable to the initial purchaser only and is nontransferable.Humanscale warrants that, at the time of customer’sacceptance, the product will be in good working order and will be freefrom defects in material and workmanship and does not apply to normalwear and tear or damage caused by accident, neglect, misuse orimproper installation or operation. Humanscale will not be responsible fordamage due to service, maintenance, modifications or tampering byanyone other than a Humanscale authorized representative. Thiswarranty is based upon a single 8-hour shift usage only and shall be proratedfor double-shift or triple-shift usage.In the event a product is defective and Humanscale receives writtennotice of the defect within the warranty period, Humanscale, at its option,will either repair or replace the defective product. This warranty does notcover damage caused by a carrier or transportation of the product fromone location to another, or alterations made by owner.LIMITATION OF LIABILITYIn no event will Humanscale be liable to purchasers for any special,collateral, incidental or consequential damages however caused, whetherby Humanscale’s negligence or otherwise.11
