<strong>CalWORKs</strong> <strong>Handbook</strong><br />

If the emergency situation is an eviction, and the applicant is found to<br />

be eligible for an immediate need payment, the applicant shall be<br />

permitted to choose, in writing, either the immediate need payment<br />

OR the expedited determination <strong>of</strong> AFDC cash aid eligibility when all<br />

<strong>of</strong> the following conditions are met:<br />

� The applicant is in receipt <strong>of</strong> the notice <strong>of</strong> eviction, including a<br />

three day notice to pay or quit, AND<br />

� The applicant has insufficient funds to pay the owed rent, AND<br />

� The applicant is currently residing in his/her home<br />

Before the applicant chooses between the two options, staff shall<br />

inform the applicant in writing <strong>of</strong> the information and verification<br />

necessary to determine eligibility for aid.<br />

The applicant's decision shall be documented in the case record (case<br />

comments).<br />

If the applicant chooses expedited processing <strong>of</strong> benefits, and they<br />

have provided all requested verifications, eligibility determination and<br />

payment shall be completed within three working days from the date<br />

immediate need request was made.<br />

Staff shall issue the immediate need payment no later than the third<br />

working day if the eligibility determination cannot be completed (e.g.<br />

the applicant does not comply with providing necessary information or<br />

verifications).<br />

I. Meeting the immediate need request by referral to a community resource:<br />

The county has the option to refer the applicant to another public or private<br />

resource to meet the emergency situation, other than the need for shelter<br />

or food. The immediate need payment may be denied when all the<br />

following conditions are met:<br />

1. During the application period not more than one referral was made,<br />

and when made it is to meet no more than one need<br />

2. Staff have verified in advance that the specific need will be fully met<br />

by the referral agency by the end <strong>of</strong> the following working day. This<br />

shall be documented in the case record.<br />

3. The applicant has the mental and physical capabilities to travel to<br />

the referral agency. Staff must complete the referral with due regard<br />

to the family as a whole.<br />

4. Staff shall not refer the applicant when travel to the agency will<br />

create another emergency situation.<br />
