AVAILABILITY OF COURSE MATERIALSStudents enrolled on a resident campus will receive books for both online and on campus courses at thecampus. Course materials for online courses offered through the Indianapolis online program will be mailedto the student prior to the start of the course. Materials for all courses the student is registered to take in thequarter will be mailed together prior to the start of that quarter. Online materials for online courses will notbe made available more than ten (10) days prior to the start of the course.BIAS-RELATED CRIME PREVENTION INFORMATION (NEW YORK)In compliance with Article 129-A of the New York State Education Law, information about bias-relatedcrime prevention is printed below in order to assure that all students at <strong>ITT</strong> <strong>Technical</strong> <strong>Institute</strong> are aware ofthe laws, penalties and standards of conduct with respect to these crimes.What is a Hate Crime?In enacting the Hate Crimes Act of 2000, the New York Legislature found that:Criminal acts involving violence, intimidation and destruction of property based upon bias andprejudice have become more prevalent in New York state in recent years. The intolerable truth is thatin these crimes, commonly and justly referred to as “hate crimes”, victims are intentionally selected,in whole or in part, because of their race, color, national origin, ancestry, gender, religion, religiouspractice, age, disability or sexual orientation.A hate crime is committed when a person commits a specified offense and intentionally selects the personagainst whom the crime is committed in whole or in substantial part because of a belief or perceptionregarding the race, color, national origin, ancestry, gender, religion, religious practice, age, disability orsexual orientation of a person, regardless of whether the belief or perception is correct. A hate crime is alsocommitted when a person commits a specified offense and intentionally commits the act or acts constitutingthe offense in whole or in substantial part because of such belief or perception.For purposes of this definition, specified offenses include the following offenses, or any attempt or conspiracyto commit the following offenses:- assault in the first, second or third degree;- aggravated assault upon a person less than 11 years old;- menacing in the first, second or third degree;- reckless endangerment in the first or second degree;- manslaughter in the first or second degree;- murder in the second degree;- stalking in the first, second, third or fourth degree;- rape in the first degree;- criminal sexual act in the first degree;- sexual abuse in the first degree;- aggravated sexual abuse in the first or second degree;- unlawful imprisonment in the first or second degree;- kidnapping in the first or second degree;- coercion in the first or second degree;- criminal trespass in the first, second or third degree;- burglary in the first or second degree;- criminal mischief in the first, second, third or fourth degree;14
