Essential Air Service ProgramBy Faye Malarkey Black, RAA Vice President–Legislative AffairsWhen Congress passed the AirlineDeregulation Act of 1978, lawmakerspromised that communities receivingscheduled air service before regulationwould continue to receive scheduled airservice after deregulation. In order touphold that promise, Congress establishedthe Essential Air Service (EAS) program,which guaranteed a certain level ofscheduled air service to communities thatotherwise would have lost access to thenation’s air transportation system under aderegulated airline industry.History of the ProgramThe EAS program was initially authorizedfor 10 years with funding provided by thegeneral fund of the US Treasury. It wasmodified and extended by the Airportand Airway Safety and Capacity ExpansionAct of 1987 and was later madepermanent as part of the FAA ReauthorizationAct of 1996 with a standing annualappropriation of $50 million. Subsequentlegislation has supplemented this fundingwith additional appropriations fromother FAA revenue sources, includingforeign overflight fees and the Airport andAirways Trust Fund. The EAS program hasundergone numerous criteria adjustmentssince its inception, mainly limiting eligibility.At present, communities are no longereligible for subsidized air service if they arelocated within 70 driving miles of an FAAdesignatedLarge or Medium Hub airport,or if their per passenger subsidies exceed$200. Communities located 210 or morehighway miles from the nearest Mediumor Large Hub airport are exempt from thesubsidy cap.Managed by the DOTThe program is administered by theDepartment of Transportation (DOT), withDOT determining 1) the level of servicerequired at each eligible community 2)certain characteristics of the aircraft usedand 3) the maximum number of permissibleintermediate stops before the hub.If a carrier is the only airline serving anUnder the current program,airlines may not seek rateadjustments during theduration of the contractand must instead file 90 dayservice termination noticesin order to trigger a raterenegotiation shouldthe airline’s costsincrease significantlyduring the lifetime of therate agreement.EAS-eligible community and wishes to exitthe market, DOT regulations require thatcarrier to file a 90-day service terminationnotice. During this time, DOT may requirethe carrier to continue flying in the marketindefinitely.In cases where no carrier is willing to providereplacement service without a subsidy,DOT solicits “best and final” competitiveproposals from carriers to provide subsidizedservice for a period of two years. Aspart of this process, carriers must submitfinancial data as well as project revenuesand costs expected over the duration ofthe two-year contract. DOT then reviewsthese proposals, selects a carrier, and setsa subsidy amount to cover the differencebetween the carrier’s projected costs ofoperations and its expected passengerrevenues, providing the carrier with aprofit margin equal to five percent of totaloperating expenses. Under the currentprogram, airlines may not seek rateadjustments during the duration of thecontract and must instead file 90 dayservice termination notices in order to triggera rate renegotiation should the airline’scosts increase significantly during thelifetime of the rate agreement. Filing suchservice termination notices causes DOT toopen a new competitive bidding processwith other carriers and often damagescommunities’ perception of the air service.Essential Air ServiceRAA 2008 Annual Report 53
