Ipay taxes.“Why are these peoplebothering me?” he posed arhetorical question. “I’ll tellyou why. Because I’ve beenat war with these people forfive years. If there’s a representativehere of the homeownersassociation, they’vebroken federal law in mycase. They’ve refused to giveme paperwork.”He said he had takenthe HOA to court twice, “sothey retaliated against me.That’s the way I feel.”He told the council theheadline in the Krum Newsfollowing the May 6 meetingthat said ‘SaddlebrookHome Owners fight ATFand Federal Fire Arms license’“is totally misleading.”He was concerned, too, that the material presentedto the council by theHOA resulted in the newspaperstory publishing hisaddress, “so any nutcasewho has anything againstme on this would have readCouncil considersNovember electionfor fire station bondthat part of the bond packagefailed on May 11, 177-175, and how to get the fullstory of the need for the newfacilities to the voters.Councilmember BertWitherspoon, who was absentat the council’s firstmeeting after the election, suggested that the fire stationand public works issuesbe split into two separatevotes, but CouncilmemberPaul Meine and newly electedMayor Pro Tem MichaelWilkes agreed that the siteuse plan presented to thevoters last month was thebest use for the property thecity is purchasing from DentonCounty.Mayor Terri Wilsonsaid the $250,000 purchaseprice would not be part of aNovember bond issue. Thepayment is due earlier andborrowing the funds locallyis in the works, she said.Fire Chief KennethSwindle emphasizedstrongly that the proposedconstruction is “the mostcost-effective use of the taxpayer’sdollar” for both departments.Wilkes and Meine repeatedtheir contentionmade at the May 20 councilmeeting that last-minutemisinformation led to thedefeat of the fire station/public works bond issue.Swindle agreed that waspart of the problem, but saidhe had talked to a lot of peopleand heard 10 or 15 differentreasons why the bondissue failed.(Continued on pg. 6)He suggested, also, thatas many people as possibleshould be encouraged totour the current fire stationand see how unsatisfactorythe building is. I had tried, inthe time between the May6 council meeting and thedeadline to find a phonenumber or an e-mail addressfor Mernatti, but was unsuccessful.By not mentioningthat fact in the story, I misledArcher and, presumably, other readers into thinkingthat I did not want to share“the other side.”There was another elementI had hoped to cover inthe original story, a reactionfrom the Police Department, particularly in light of myfinding the Bureau of Alcohol,Tobacco, Firearms andExplosives website that listedthree FFL-holders withKrum addresses, includingone inside the city limits. A voice mailand an e-mail from me tothe Police Department toseek comment along thoselines went unanswered. For me, the ATF websiteand others that dealtwith the mechanics of theFederal Firearms Licenseprocess were important elementsof the story thatwould at least show that theprocedure, established byCongress in 1968, that resultedin more than 40,000FFLs issued in all 50 states, was legal, common, andseemingly caused few problems.I add the last clausebecause, if major problemshad evolved around theFFL process, I would expectthat they would have beenreported in news sources Iread, watch and hear. When I found the list ofFFL licenses with Krum addresses,I considered addingthe names and addresses ofthe licensees to the story, butI quickly remembered my reactionto consternation thata newspaper in New YorkState had used its Freedomof Information right to obtainand publish the namesand addresses of all licensedgun owners in its coveragearea. My reaction was thatsuch a list would give burglarsintent upon stealingweapons a target list, and, thus, was in my opinion irresponsiblejournalism.Given my approach tothe New York story and thedecision not to give namesand/or addresses for thethree existing Krum FFLsfound on the ATF website,I had to face up to the factthat I violated my own standardby listing the specificstreet address of the Mernattiresidence. Our joint discussionprior to the council meetingMonday night helped Mernatti,Archer and I come toa clearer understanding ofwhere we stood in relationshipto one another. As Troy Mernatti pointedout in his presentationto the council, limited bycouncil edict to three minutes, his argument was withthe homeowners associationand not with the ATF. Hetold me and Archer that theATF description of what anFFL holder could do wasaccurate. As far as the fearsexpressed by the HOA representativesat the May 6council meeting, Mernattiamplified his description oftheir scenario in our conversationafter the meeting.“It was a hypotheticalfairy tale,” he said. “I don’tdo anything remotely closeto the way they describedit. It’s just something I hopedoesn’t spread in this townbecause if you let them rollover one person, they’ll do itto other people.”My job as a reporter, even as a volunteer as I havebeen for the past decade, isto keep my personal opinionsout of news stories. It also is to give readers asmuch accurate informationas possible so they couldcome to their own conclusionsas to the bottom lineof the full story. In a column such asthis, I trust that readers understandthat this is whereanalysis can be made andopinions can be expressed.Since the laws dealingwith FFLs have been clearand in operation since 1968,I do consider the current argumentto be less one of guncontrol and more one of thepower homeowners associationshave, or believe theyhave, over individual propertyowners in subdivisionscovered by HOAs.I have heard stories elsewhereabout HOA-propertyowner conflicts as well ascomplaints from Krum residentswho live in HOA subdivisionsabout landscaping, outbuilding, exterior sidingand paint color, flag flying, satellite dishes, antenna towers, roofing colors to wonderif HOAs are developerdriven quasi-governmentalagencies to limit the abilityof property owners to expresstheir individual tastesand property uses becausetheir taste might offend otherproperty owners. At least I’ll never haveto write a story about thecontroversy between JustinBieber and his alleged 24-7loud party and his speedingthrough his neighborhoodand those who would withholdtheir $1,000-a-monthdues until the HOA clampsdown on the young singer. As a federally-licensedham radio operator, I amaware of the oppositionfellow hams face to tall antennatowers built into someHOA contracts and intosome city ordinances. I amalso aware that it is easierto get a court ruling thatfederal law governing hamequipment, such as towers, overcomes local ordinancesin conflict than it is to overturnan HOA restriction thatwas built into the deed document. No HOA membershipfor me.It’s been a long timesince our last two propertypurchases —1970 and 2000(plus a later purchase ofproperty next door) — so Ihaven’t had to worry aboutprotecting my right to buildKRUMCALENDARKRUM WRITERS’ CLUBPublished authors, pre-publishedwriters and those whowrite just for fun are invited toshare their work, receive gentlecritiques and learn about writingevents and tips.
