Disciplinary Notice – Terry D Mulvey,
Lloydminster, AB
An investigation into the conduct of Mr Mulvey was
commenced by the Investigation Committee of
APEGBC, following notice from APEGGA of a copy of
its Appeal Board’s Decision revoking his membership.
Mr Mulvey was a member of both APEGGA
and APEGBC.
APEGBC’s Investigation Committee
requested that Mr Mulvey provide information
or records related to APEGGA’s
disciplinary matter and Mr Mulvey’s
subsequent activities. Mr Mulvey failed
to provide the requested information and
the Investigation Committee recom-
mended that an inquiry be held.
The Discipline Committee has
approved an agreement that, in lieu
of the Association proceeding with
the inquiry, Mr Mulvey will resign
from the Association. If Mr Mulvey
applies for reinstatement as a member
of the Association, the Association
will be at liberty to continue with
an inquiry or investigation. In addition,
if Mr Mulvey applies for reinstatement,
he will be required to pay
the Association’s costs in connection
with the Notice of Inquiry.
As there is no greater penalty than
loss of practice rights, the Association
is satisfi ed with the resolution of
this matter.
Disciplinary Hearing –
Dr Anthony A Salway PGeo,
Nelson, BC
On January 24, 2008, a Panel of the Discipline
Committee of APEGBC considered
allegations that Dr Anthony Salway
demonstrated unprofessional conduct
by his neglect or refusal to provide a
timely response to communications
from his clients. The Panel found Dr
Salway liable.
In its Determination the Panel found
that “While in many cases a failure to
provide a timely communication may
not constitute unprofessional conduct,
in this case the fi nding of liability turns
on the gravity, consequences and
importance to Dr Salway’s clients of the
failure to respond to their requests for
further information.” In the Discipline
Committee’s Order regarding Penalty
and Costs, Dr Salway was reprimanded
and ordered to pay $16,373 towards
APEGBC’s costs.
