Vacation shall be taken between January 1 and December 31; however, it is recognizedthat the exigencies of the service create practical difficulties in providing vacations in allinstances. Due regard, consistent with requirements of the service, shall be given tothe preference of the senior engineer when granting vacations. Representatives of theCompany and of the BLE will cooperate in arranging vacation periods, administeringvacations and releasing engineers when requirements of the service will permit. It isunderstood and agreed that the Company will pay vacationing engineers their vacationallowances as soon as possible after the vacation period, but the parties recognize thatthere may be some delay in such payments. It is understood that in any event suchengineer will be paid his vacation allowance no later than the second succeedingpayroll period following the date claim for vacation allowance is filed.C. An Engineer receiving a vacation, or pay in lieu thereof, shall be paid for each week ofsuch vacation at 1/52 of the compensation earned by such employee during thecalendar year preceding the year in which the vacation is taken, but in no event shallsuch pay for each week of vacation be less than five (5) minimum basic days’ pay.D. Engineers shall perform one hundred sixty (160) days or equivalent hours ofcumulative compensated service in any calendar year to qualify for vacation in theensuing year as provided under paragraph A above. Calendar days on which anEngineer is available for service (within the meaning of Articles 11, 18, 31 32 and 33)and on which he performs no service, shall be included in the determination ofqualification for vacation; also, calendar days not to exceed 45 days on which anEngineer is absent and unable to perform service because of illness or injury shall beincluded.E. Single day vacation days pursuant to Article 21 Section 3 paragraph C. shall be paid atthe rate of ten (10) hours at the basic rate of pay.36
