Section 3TerminationA. Terminated employees shall be removed from the seniority roster as provided for bythe rules and working conditions of this <strong>Agreement</strong>.B. After the seniority of an employee is terminated, such person shall not be permitted towork or be re-employed by the Company in service coming under the scope of this<strong>Agreement</strong> unless otherwise mutually agreed.Section 4Demoted EngineersEmployees hired subsequent to the effective date of this <strong>Agreement</strong> and who are demotedwill be used to fill Engineers' vacancies in accordance with their seniority when extraEngineers are unavailable to fill such vacancies. This applies to vacancies ordinarily filledby extra men.Note:Section 5"Availability" as used in this article means the demoted Engineer isrested according to law or <strong>Agreement</strong> and is contacted under theterms of the calling rule.Re-Entering ServiceEngineers reinstated retain their rank of seniority. Engineers reemployed lose their formerrank and enter the service as new employees.Section 6Seniority Maintenance FeeEffective with the date of this <strong>Agreement</strong>, Engineers transferring from train service shall besubject to payment of their fair share of the expenses of negotiating and administeringthe collective bargaining agreement governing their rates of pay, rules and workingconditions within the craft of locomotive Engineers and in the protection of theircontinued Engineers' seniority as follows:A. Engineers demoted to train service will have their Engineers' seniority placed in leave ofabsence status and will continue to accumulate such seniority. This will apply to theperiod of time that such employees are required to protect their train service seniority.A service fee payment to the BLE will be required while maintaining and accumulatingEngineers' seniority.B. A service fee will be required of Engineers transferring from train service who do nothold membership in the BLE in order to defray the cost of negotiating andadministering the collective bargaining agreement governing their rates of pay, rulesand working conditions and for the maintenance and accumulation of Engineers'seniority.C. The service fee specified in the preceding paragraphs shall be based upon the costs ofnegotiating and engaging in all collective bargaining matters, but in no event shallexceed the amount of full monthly dues of the BLE.D. The provisions outlined in Section 6 herein shall only be implemented upon thirty (30)days written notice by the General Chairman of the Brotherhood of LocomotiveEngineers.8
